Father will have the child every Friday at 2:00 p.m. until Saturday at 6: 15 p.m. B. Mother shall have the child every Saturday at 6: 15 p.m. until Monday at 2:00 p.m. C. Father shall have the child on Tuesday, Wednesday, and Thursday each weak from 2:00 p.m. until 9: 15 p.m. D. Mother shall have the child at all other times. The parties agree that the maternal grandparents, Ronald and Doretha Woods shall be responsible for providing the necessary day care for the child when each party is unavailable due to their work schedules. 4. The parties acknowledge that at the time of the conciliation Mother does not have any available transportation and therefore Father or his designee will provide all transportation to effectuate this schedule. 5. If the parties are unable to reach a resolution after receipt of the evaluator's report, either party may petition the court for another conciliation. BY THE COURT, J. Keith B. The Plaintiff's position on custody is as follows: This is an unusual case in that the Plaintiffs collectively are the maternal grandparents and the Father. Their position seems to be that the Father relates that Mother is in an unstable living environment and alleges that she may have some drinking or drug problems. He believes that the child is best having a home base at the maternal grandparents house and apparently, as of the time of the conciliation, the Father moved into the maternal grandparents house. 6. The Defendant's position on custody is as follows: Mother relates that she has always been the primary care taker of the child and recently left the maternal grandparents' home on January 12, 1997. Prior to that, she says that the Father did not have much involvement but does acknowledge that the maternal grandmother was used on a continual basis for day care purposes. She does not agree, however, that the maternal grandmother should have any say in the custodial arrangement and believes that the maternal grandmother and Plsintiff sre upset with her because of her current boyfriend who is black. 7. Need for separate counsel to represent child(ren): Neither party requested. 8. Need for independent psychological evaluation or counseling: See attached Order. 9. Other matters or comments: When the partias met for the conciliation, there had been some snatching of the child back and forth between the respective parties. The Conciliator related to counsel for the Plaintiffs that the first matter that had to be resolved was a delineation of the respective positions of the Plaintiffs with regard to custody. The complaint requests that the Plaintiffs collectively be awarded custody, while the Conciliator believes that that is not an appropriate approach to the case. If the case proceeds to a hearing, the grandparents must state with clarity their position with regard to a custodial arrangement in the case, particularly if they are actually seeking custody of the child. The parties did agree to engage the services of a psychologist. Pending the evaluation, the parties did agree, at the Conciliator's suggestion, to an arrangement that maximizes the contact with both parents while they are not working. The Conciliator also suggested that the maternal grandparents be permitted to continue providing day care for the child when the child is not available to either one of the parents and the parents agreed to that provision. It is hoped that the evalustor will work out an appropriate arrangement between the parties which acknowledges the fact that the maternal grandparents have played a significant role in the child's life thus far.
