The following is an accurate list of the marital debts incurred by Husband and Wife during the marriage: a) Auto loan on 1995 Plymouth Neon. 3. Husband and Wife hereby agree Husband will pay off the balance of the loan on the 1995 Plymouth Neon. Wife will assume all maintenance and insurance costs of the Plymouth Neon. Additionally, Wife shall assume all liability for the ownership and operation of the automobile. In the event a claim is made against Husband while he is title as a record owner of the Plymouth Neon, Wife agrees to hold Husband harmless from any and all liability and/or judgments entered against him as a result thereof. The parties agree that the 1995 Plymouth Neon will be titled in the name of Wife alone as soon as practicable. 4. The twenty-one shares ofEDS stock determined to be marital property will be sold and the proceeds used to pay the Federal income tax liability of the parties for 1996. The capital gains liability resulting from said sale will be shared in the 1997 tax year in direct proportion to the 1997 income of Husband and Wife. 5. The entire EDS Deferred Compensation Plan 401K will be transferred to wife punuant to a Qualified Domestic Relations Order. 20f3 6. Any retirement and/or pension benefit allributed to Husband by virtue of his employment with EDS will remain the property of Husband. Wife hereby rclinquishes any right, title or interest in Husband's EDS retirement. 7. Wife will remove Husband's name from the lease for her apartment as soon as practicable. 8. The parties hereto agree that they have had filii and fair disclosure of all property of their spouse for the purposes herein contained. Plaintiff is aware of no pending custody proceeding concerning the child in a court of this Commonwealth. 14. The Plaintiff seeks primary physical and shared legal custody of the child, Ryan Mallhew. IS. The best interests and permanent welfare ofthe child will be served by granting the relief requested because: a) Plaintiff has been and continues to be the primary caregiver to the child. b) Plaintiff is most likely to facilitate a relationship between the child and the non-custodial parent. d) Plaintiff is best able to provide a nurturing, stable, and loving environment for her child, 16. Accordingly, the parties are negotiating a Custody Agreement to be filed at a later date in this case. 17. GARDNER(hereinafter referred to as "Mother") thaI: WHEREAS, Father and Mother were married on March 23, 1992, in Fort Lauderdale, Florida; and WHEREAS, RYAN MATTHEW GARDNER was born from the marriage on November 2, 1992, and Father and Mother are the biological parents of the child; and WHEREAS, Father and Mother now live separate and apart; THEREFORE, Father and Mother have agreed to the following custody schedule for the care and welfare of RYAN MATTHEW to be enforced by subsequent Order of Court: I. The Father and Mother will have shared legal custody of the child. 2. Mother will have primary physical custody of the child and Father will have secondary physical custody of the child on the following rotating two week schedule: a. Father will have custody of the child every Wednesday and Thursday in week 1; and Father will have custody of the child every Friday and Saturday in week 2, The exchange time for these visits will be approximately 6:00 p,m. b. In odd years, Father shall have custody of the child on Memorial Day weekend, the Fourth of July(and the weekend jfthe holiday so falls), Halloween and the Thanksgiving Holiday(which shall run from Thursday to the following Sunday), lof3 c. In even years, Father shall have custody of the child on Valentine's Day, Good Friday through Easter Sunday, Labor Day weekend, and Christmas Eve through Christmas Day, 4. Once the child begins school, The Father and Mother will share custody ofthe child during the child's school Christmas vacation at times to be agreed upon by the parties. 6. The Father and Mother will share custody of the child on his birthday at times to be agreed upon by the parties. 7. The Father will have custody of the child on the Father's birthday at times to be agreed upon by the parties. The Mother will have custody of the child on her birthday at times to be agreed upon by the parties, 8. The Father will have custody of the child on Father's Day, and the Mother will have custody of the child on Mother's Day at times to be agreed upon by the parties. 9. The Father and Mother, by mutual agreement, may vary from this schedule at any time, but such variance shall not operate to invalidate any or all provisions of this agreement, and any order of court shall remain in effect pending further order of the court. 10. The form of bene fits available under the Plan are: I) Lump Sum Distribution, 2) Periodic Payments, 3) In-kind Distributions for Stock or 4) Annuity Payment. In the event the Plan pays cost-of-living increases at any date after Alternate Payee begins to receive benefits from the Plan, Alternate Payee shall also receive a share of each increase, which share shall be proportionate to Alternate Payee's interest in the total benefit as set forth above. 4. These rights include but are not limited to the right to designate a beneficiary of retirement benefits, the right to elect from then existing retirement dates and payment options, the right to the distribution of benefits following the cessation of employment and the right to such increases in value in the account as might occur as a result of the general upgrading of the plan, plan amendments, earned interest profitability of plan investments, etc. In no event shall the Alternate Payee have greater rights than those which are available to the Participant. The Alternate Payee is not entitled to any benefit not otherwise provided under the plan. 7. In the event that actuarial computation is necessary to determine "actuarial equivalents" and/or the difference between benefits actually accrued, non-subsidized benefits, or employer subsidized benefits, for the purpose of the earliest retirement age option by the Alternate Payee, or otherwise, the Plan Administrator shall obtain the services of any actuary who is enrolled under Subtitle C ofYrtle m of the Employment Retirement Security Act of 1974, 8. Any reasonable costs incurred by the Plan Adminiotrator to effectuate the terms and provisions of this Qualified Domestic Relations Order shall be assessed against i' the parties such that Alternate Payee pays 100% ofthe costs. 9.
