review of the courthouse records in order to determine the location
of a burial site, if any, on the property. A copy of that letter
is attached to this petition and marked as Exhibit "A".
7. McNaughton's title agent conducted an extensive line of
title search which revealed that the name "Mumma" does not appear
in any chain of title associated with the Good Hope Farms South
property.
8. In addition, the search did not reveal evidence of record
of a grave site or burial ground anywhere on the Good Hope Farms
South property.
9, McNaughton, the title owner of the land, is unaware that
there is a grave site and from inquiries it has made believes that
the tombstone may have been placed in the property by vandals.
10, Burial matters, specifically matters of removal of
remains, are covered by Title 9 of purdons at Section 41 et sea.
11. 9 P.S. 551 states in pertinent part:
Whenever any private burial ground by reason of the
drilling of oil wells, or the opening of mines or
quarries in the vicinity thereof, or from any other
cause, has become . . . an unsuitable place for the
repose of the dead, the court of quarter sessions
of the county in which such burial ground is
situated, on petition of the trustee or trustees
having charge thereof, or of any person having a
relative therein, shall have the jurisdiction and
power to authorize and direct the removal of the
remains of all dead from such private burial ground
to such other suitable ground as shall be provided
by the petitioner, . . for the reinterment of the
bodies. Notice of the presentation of a petition
for any such order of removal and reinterment shall
be given by advertisement, once a week for a period
of three weeks, in at least one newspaper of
general circulation published in the county and in
such other manner as the court may direct.
12. 9 P.S. 552 states:

Such removal and reinterment shall be made by the
petitioners in a careful manner, at their own
expense, to another suitable burial ground provided
by them, or, if desired by the relatives or friends
of such dead, to some properly regulated burial
ground or cemetery in the immediate vicinity, and
said court may enforce, by proper process, orders
and decrees made under this Act. provided,
however, that before the removal of the remains of
the dead, notice of such removal shall be given by
advertisement, once a week for two successive
weeks, in two daily newspapers of the county
wherein such burial ground is situated: And
provided further, that relatives and friends of
such dead shall have the right to remove the
remains, at their own expense, at any time during
the proceedings before actual removal under order
of the court: And further provided, that all
bodies when so removed shall be placed in separate
caskets and graves, and the headstones, monuments,
or other marks placed over the remains of said
bodies shall be taken, by the persons authorized to
make such removal, and placed as near as can be in
the same relative position as before removal.

remains found thereon, or, in the alternative, provide a cemetery

RE: Equity Action No. 97-405, In Re: Good Hope Farms South
Dear Judge Hess:
On January 24, 1997, my client, The McNaughton Company
("McNaughton"), commenced the above-referenced equity action. You
will recall that McNaughton, the title owner of a tract of land in
Hampden Township known as Good Hope Farms South, petitioned the
Court for permission to excavate a portion of that property in
order to determine whether any mortal remains were buried under a
grave marker discovered on the property. The grave marker
discovered on the property bore the legend "Herman J., son of Amos
and Marion Mumma, died October 11, 1671, aged 1 year 6 months."
You signed an Order on January 24, 1997, granting McNaughton
permission to excavate the possible burial site and, if any mortal
remains were found, to disinter and reinter such remains pursuant
to 9 P.S, S52, Immediately following entry of your Order,
newspaper articles about the matter were published in both the
Carlisle Sentinel and the Harrisburg Patriot News. The newspaper
articles motivated two local genealogists, Robert 0' Hara and Robert
Troup, to contact McNaughton and offer their services to provide
information about the Amos Mumma family. Intrigued, McNaughton
decided to hold off on excavating the area pending receipt of
information from the genealogists.
Mr. O'Hara and Mr, Troup conducted research on the Amos and
Marion Mumma family and found that they were indeed the parents of
a son named Herman J. who had died in infancy. I have attached
copies of the information provided by Mr. O'Hara and Mr. Troup to
this letter for your convenience, The genealogists further
determined that Amos and Marion Mumma, parents of Herman J. Mumma,
were buried in the Mt. zion Cemetery west of Churchtown, Cumberland
County.

Based on the genealogy information, McNaughton contacted
Reverend Yankovitz, the Pastor of Mt. Zion Church, in order to
request information from the burial records of the Mt. Zion
Cemetery, Reverend Yankovitz informed McNaughton that the burial
records were in the custody of James L. Shumberger, Jr" the
secretary of the Mr. Zion Cemetery Association. McNaughton then
contacted Mr. Shumberger in order to obtain information relating to
the burial site of Amos and Marion Mumma,
Mr. Shumberger, following an inspection of the records of the
Mt. Zion Cemetery, informed McNaughton that Herman J. Mumma, 1870-
1871, son of Amos and Marion Mumma, is interred along with his
mother and father in burial lot number 218 of the Mt. Zion
Cemetery. A copy of the letter so stating from Mr. Shumberger is
attached hereto for your convenience, Following receipt of Mr,
Shumberger's letter, my client took photographs of the grave marker
on lot number 218 in the Mt. Zion Cemetery. That marker reads
"Mumma; Amos, 1847-1932; Marion, 1850-1909; Herman J., 1870-1871".
I have attached copies of the photographs of the grave marker to
this letter for your convenience.
Recently, my client provided me with all of the above-
described information and requested that I petition the Court to
have our request dismissed and seek an Order granting us unlimited
use of the property. I informed my client that in my opinion the
better course of action would be simply to inform the Court of the
recent developments and, based on the newly discovered information,
withdraw the equity action,
Based on the present circumstances, I plan to discontinue the
equity action.
