AND NOW, comes William F. Rothman, Charles F, Schubert, Samuel
L. Reed and Jan B. Castner t/d/b/a, Rothman, Schubert & Reed
Realtors, a Pennsylvania partnership, by and through its attorneys,
The Law Offices of Darrell C. Dethlefs, Esquire, and in support of
their Complaint avers as follows:
1, The Plaintiffs, William F. Rothman, Charles F. Schubert,
Samuel L. Reed and Jan B, Castner t/d/b/a Rothman, Schubert & Reed
Realtors, is a Pennsylvania Partnership, fully licensed to conduct
business as a Real Estate Broker in the Commonwealth of
Pennsylvania, with business offices located at Suite 102, 355 North
21st Street, Cumberland C04nty, Camp Hill, Pennsylvania hereinafter
"Rothman, Schubert & Reed, Realtors".
2. The Defendant is Barnstable Broadcasting Inc., whose
principal place of business is located at 125 Technology Drive, Box
9042, Waltham, Massachusetts.
3. The Defendant, Barnstable Broadcasting Inc., at all times
relative to this matter was the fee simple owner of the premises
known and described as 360 Poplar Church Road, Camp Hill,
Pennsylvania. Also, know as Tax Parcel Identification Number 47-
19-1590-073, Hereinafter referred to as "The Property",
4, On or about August 15, 1995, Defendant employed Plaintiff
pursuant to a written Exclusive Listing Contract, to procure a
purchaser for the above described property. A copy of said
Exclusive Listing Contract hereinafter "the contract" is attached
hereto and made apart hereof and is marked as Exhibit "A",
5, The terms of the contract gave Plaintiff an exclusive
listing agency with respect to the property commencing on August
15, 1995 and terminating on May 15, 1996.
6, On or about April 4, 1996, Defendant and Plaintiff
executed an extension with respect to the aforementioned contract.
7, By the terms of the April 4, 1996 extension, Plaintiff'S
Exclusive Listing Contract with Defendant was extended until
October 15, 1996. A copy of said extension is attached hereto and
labeled Exhibit "B".
a, On or about September 20, 1996, Defendant and Plaintiff
executed an extension to the aforesaid contract. A copy of said
extension is attached hereto and labeled Exhibit "Co.
9, By the terms and conditions of the September 20, 1996
extension, Plaintiff's Exclusive Listing Contr.act with Defendant
was extended until April 15, 1997.
10, By the terms of the contract and subsequent extensions,
Defendant gave Plaintiff and exclusive agency relative to the
"property" commencing on April 15, 1995 and terminating on April
15, 1997 with a list price of Nine Hundred fifty thousand
($950,000.00) Dollars, and agreed to pay Plaintiff six (6\) percent
of the sales price if the property was sold or exchanged in
accordance with the terms of said contract and subsequent
extensions.
11, The six (6\) percent commission agreed upon by Plaintiff
and Defendant was a usual and customary real estate broker
commission for the sale of commercial property in the Camp Hill
Area at all times mentioned herein.
12, All contingencies relative to the aforementioned contract
have been fulfilled.
13. Plaintiff believes and therefore avers that the property
has been sold and/or exchanged to Dame Media Inc, within the terms
of the Exclusive Listing Contract and subsequent extensions
resulting in the full commission as set forth in said contract to
be presently due to Plaintiff. The exact times, dates and written
agreements relative to the same being in the sole possession of
Defendant and are not available to Plaintiff.
14, The Defendant, despite several demands, has failed to pay
Plaintiff in accordance with the aforementioned Exclusive Listing
Agreement.
15, The action of Defendant as aforesaid are willful and
constitutes a material breach of the contract entered into between
Plaintiff and Defendant.
16, As a direct and proximate result of the actions of the
Defendant as aforesaid, Plaintiff has suffered and continues to
suffer serious damage, including but not limited to loss of monies
owed to it by Defendant, loss of use of said monies, loss of
interest on the monies and other such damages as may be discovered.
17, By reason the foregoing, Defendant owes Plaintiff the sum
of Fifty-seven Thousand ($57,000.00) Dollars which Plaintiff has
demanded from Defendant and which Defendant has refused and still
refuses to pay.
WHBRBFORB, Plaintiff demands judgment against Defendant and in
favor of Plaintiff in the amount of Fifty-seven Thousand
($57,000,00) Dollars plus interest and costs,

3, Plaintiff's Complaint fails to set forth the name of the individual partners
of Rothman, Schubert & Reed, Realtors in conformity with Pa, R,Civ,P. 21 27(a),
4, Additionally, Pa, R.Civ,P, 1018 requires that "the caption of a complaint
set forth the form of the action and the names of all the parties..,"
5. As Plaintiff's Complaint fails to conform to Pa. R,Civ,P. 21 27(a) and Pa.
Rule of Civil Procedure 1018, Plaintiff's Complaint must be stricken pursuant to Pa, Rule of
Civil Procedure 1028(a)(2).
WHEREFORE, Defendant, Barnstable Broadcasting, Inc, respectfully requests

AND NON, comes Rothman, Schubert & Reed, Realtors, a
Pennsylvania partnership, by and through its attorneys, The Law
Offices of Darrell C. Dethlefs, Esquire, and in support of their
Complaint avers as follows:
1. The Plaintiff, Rothman, Schubert & Reed, is a
Pennsylvania Partnership, fully licensed to conduct business as a
Real Bstate Broker in the Commonwealth of Pennsylvania, with
business offices located at Suite 102, 355 North 21st Street,
CUmberland County, Camp Hill, Pennsylvania.
2. The Defendant is Barnstable Broadcasting Inc., whose
principle place of business is located at 125 Technology Drive, Box
9042, Waltham, Massachusetts.
3. The Defendant, Barnstable Broadcasting Inc., at all times
relative to this matter was the fee simple owner of the premises
known and described as 360 Poplar Church Road, Camp Hill,
Pennsylvania. Also, know as Parcel
Identification #47-19-1590-073, Hereinafter referred to as "The
Property".
4. On or about August 15/ 1995, Defendant employed Plaintiff
pursuant to a written Exclusive Listing Contract, to procure a
purchaser for the above described property, A copy of said
Exclusive Listing Contract hereinafter "the contract" is attached
hereto and made apart hereof and is marked as Exhibit "A".
5. The terms of the contract gave Plaintiff an exclusive
listing agency with respect to the property commencing on August
15, 1995 and terminating on May 15, 1996.
6. On or about April 4, 1996, Defendant and Plaintiff
executed an extension with respect to the aforementioned contract.
7. By the terms of the April 4, 1996 extension, Plaintiff1S
Exclusive Listing Contract with Defendant was extended until
October 15. 1996. A copy of said extension is attached hereto and
labeled Exhibit "B".
B. On or about September 20, 1996, Defendant and Plaintiff
executed an extension to the aforesaid contract.
9. By the terms and conditions of the Spetember 20, 1996
extension, Plaintiff's Exclusive Listing Contract with Defendant
was extended until April 15, 1997.
10. By the terms of the contract and subsequent extensions,
Defendant's gave Plaintiff and exclusive agency relative to the
property commencing on April 15, 1995 and terminating on April 15,
1997 with a list price of Nine Hundred fifty thousand ($950,000.00;
Dollars, and agreed to pay plaintiff six (6\) percent of the sales
price if the property was sold, if a purchaser was secure by
plaintiff or by any other person during the term of the Exclusive
Listing Agency.
11. The six (6\) percent commission agreed upon by Plaintiff
and Defendant was a usual and customary real estate broker
commission for the sale of commercial property in the Camp Hill
Area at all times mentioned herein.
12. All contingencies relative to the aforementioned contract
have been fulfilled.
13. Plaintiff believes and therefore avers that a purchaser
has been secured for the property within the terms of the Exclusive
Listing Contract and subsequent extensions resulting in the full
commission as set forth in said contract to be presently due to
Plaintiff.
14. The Defendant, despite several demands, has failed to pay
Plaintiff in accordance with the aforementioned Exclusive Listing
Agreement.
15. The action of Defendant as aforesaid is willful and
constitutes a material breach of the contract entered into between
Plaintiff and Defendant.
16. As a direct and proximate result of the actions of the
Defendant as aforesaid, plaintiff has suffered and continues to
suffer serious damage, including but not limited to loss of monies
owed to a buy, Defendant, loss of use of said monies, loss of
