Haas, hereinafter referred to as Mother, and Ernest G. Moppin, hereinafter referred to as Father. WITNESSETH: WHEREAS, Mother and Father are the parents of Stephen Michael Haas, born November 14, 1991; and WHEREAS, Mother and Father wish to enter into this Custody Agreement to settle and resolve the outstanding issues regarding custody of their child; NOW THEREFORE, it is agreed by the parties that: 1. The Mother and Father shall have shared legal custody of Stephen Michael Haas, born November 14, 1991; 2. The Mother shall have primary physical custody subject to Father's periods of partial custody at the following time.l '" A. Every other weekend, beginning Friday, March 21, from 5:30 p.m. Friday evening until 4:00 p.m. Sunday every weekend. - f""I B. On the Child's birthday in odd numbered years; the Mother shall have the Child on his birthday in even numbered years. C. Every year on Father's Day; the Mother shall have the Child every year on Mother's Day. D. The Father shall have the Child on New Year's Day, Memorial Day and Labor Day in even numbered years and on Easter Sunday and July 4th in odd numbered years. The Mother shall have the Child on New Year's Day, Memorial Day and Labor Day in odd numbered years and on Easter Sunday and July 4th in even numbered years. E. Every Thanksgiving Day from 10:00 a.m. until 3:00 p.m. F. On Christmas Eve from 8:00 p.m. Christmas Eve until 2:00 p.m. Christmas Day in even numbered years; the Father shall have custody of the Child from 2:00 p.m. Christmas Day until 8:00 p.m. in odd numbered years. G. Every Tuesday from the earlier of when the child is finished with school or the father is off work until 7:30 p.m. 3. Each parent shall be entitled to two weeks of uninterrupted vacation during the year with thirty days written notice; the weeks shall not be consecutive unless agreed to by the parties. 4. Neither party shall do or say anything which may estrange the child from the other parent, injure the opinion of the child as to the other parent or hamper the free and natural development of the child's love and respect for the other parent. 6. The provisions of the holiday periods of custody supersede the regular custody schedule. 7. The terms of the Agreement may be modified by mutual agreement; in absence of mutual agreement, the terms of this agreement shall control. 8. Leaal Custodv. The Mother, Michelle L. Barry, and the Father, Ernest G. Moppin, III, shall have shared legal custody of Stephen Michael Haas, born November 14, 1991. Each parent shall have an equal right, to be exercised jointly with the other parent, to make all major non-emergency decisions affecting the child's general well-being including, but not limited to, all decisions regarding his health, education and religion. Pursuant to the terms of 23 Pa, C. S. ~5309, each parent shall be entitled to all records and information pertaining to the child including, but not limited to, medical, dental, religious or school records, the residence address of the child and of the other parent. To the extent one parent has possession of any such records or information, that parent shall be required to share the same, or copies thereof, with the other parent within such reasonable time as to make the records and information of reasonable use to the other parent. 2. Phvsical Custodv. Effective September 21, 2005, Father shall have custody each Wednesday after school until Saturday at 9:00 p.m, Mother shall have custody commencing each Saturday at 9:00 p.m. until Wednesday at the time of school dismissal. The parties intend that this schedule be in effect year-round. 3. The following holiday and vacation schedules shall supersede the regular schedule. A. Mother's Dav I Father's Dav. Mother shall have custody on Mother's Day and Father shall have custody on Father's Day. B. Alternatina Holidavs. Falher shall have custody on New Year's Day, Memorial Da~ and Labor Day in even-numbered years and on Easter Sunday and July 4t in odd-numbered years. " " ... .J ".1 I NO, 97-437 CIVIL TERM C. Thanksaivina, Father shall have custody each year on Thanksgiving Day from 10:00 a.m, un1il4:00 p.m. D. Christmas, Christmas shall be divided into two segments, Segment A and Segment B. Segment A shall be from December 241h at Noon until December 25th at Noon. Segment B shall be from December 25th at Noon until December 26th at 8:00 p.m. In even-numbered years, Mother shall have Segment A and Father shall have Segment B. In odd-numbered years, Father shall have Segment A and Molher shall have Segment B. 4. Each parent shall be entitled to two (2) uninterrupted periods of custody for purposes of vacation each year. The weeks may be consecutive or non-consecutive. The parties shall provide each other with at least a thirty (30) day notice of their planned vacation time. In the event that the parties have arranged conflicting schedules for vacation, the party first providing written notice to the other party shall have choice of the vacation weeks, Additionally, the vacationing parent shall provide a telephone number and location where they can be reached during the vacation. 5. Father shall provide transportation at the beginning of his periods of custody on Wednesday and in the mornings on each school day that he has custody. Mother shall provide transportation incident to the custodial exchange at the beginning of her custodial period at 9:00 p.m. on Saturday nights, unless the parties make an agreement otherwise, 6, Neither party shall do or say anything which may estrange the child from the other parent, injure the opinion of the child as to the other parent, or hamper the free and natural development of the child's love and respect for the other parent. Each parent shall ensure that third parties also comply with this provision during his or her periods of custody. 7. The terms of this agreement may be modified by mutual agreement of the parties, In the absence of mutual agreement, the terms of this Order shall control. 8, The Custody Conciliation Conference shall reconvene on November 18, 2005 at 9:00 a.m. at the office of the Custody Conciliator, Melissa Peel Greevy, Esquire, 1901 State Street, Camp Hili, PA 17011.
