2, Subsequently, a second cause of action was filed in the Court of Common
Pleas of Cumberland County, Pennsylvania on December 24, 1996 to Docket No, 96,
6932 naming the operator of the forklift, Caterpillar, Inc, and Hyster Company, as
Defendants,
3, A third cause of action was initiated by the Plaintiff in the Court of Common
Pleas of Cumberland County, Pennsylvania to Docket No, 97-447 on January 27, 1997.
This ceuse of action was initiated by the Plaintiff because of her concern whether Hyster
Company, as idontified in the previous suit, was the proper Hyster Company, A search
of cortain records indicated that there were various companies throughout the United
States that bore the name "Hyster" or "Hyster Forklift" as part of their names,
4. An Entry of Appearance has been entered on behalf of Aycock, Inc, and its
employee, Jack McClain, by Lisa M, DiBernardo, Esquire of Griffith, Strickler, Lerman,
Solymos & Calkins,
5, An Entry of Appearance has been entered on behalf of Caterpillar, Inc, by
Ronald L. Daugherty, Esquire of White & Williams,
6. An Entry of Appearance has been entered on behalf of Hyster Company,
now NACCO Handling Group, Inc" by Charles W, Rubendall, II, Esquire of Keefer, Wood,
Allen and Rahal, LLP,
7, Informal discovery has revealod that the forklift in question is apparently not
a piece of equipment manufactured by Caterpillar, Inc" including an Affidavit of a True
Temper employee (co-worker) of the Plaintiff and statements made by Jack McClain, and
consequently, the partios hereby agree to dismiss, with prejudice, Caterpillar, Inc. from
the suit proceedings.

8, The parties hereby agree and stipulate that the proper name of the corporate
entity that manufactures forklifts with the brand name known as "Hyster" is Hyster
Company, now known as NACCO Materials Handling Group, Inc, Based on this
representation, the Plaintiff hereby agreas to discontinue with prejudice the action to
Docket No. 97-447, Cumberland County Court of Common Pleas,
9. The parties hereby agree that the two suits docketed to No, 96-5438 and
No. 96-6932 shall be consolidated and that the caption of said proceedings shall be
