2. INTERPERENCE: Each party shall be free from
interference, authority, and contact by the other, as fully as if
he or she were single and unmarried except as may be necessary to
carry out the provisions of this Agreement. Neither party shall
molest the other or attempt to endeavor to molest the other, nor
compel the other to cohabit with the other, or in any way harass or
malign the other, nor in any way interfere with the peaceful
existence, separate and apart from the other.
3. WIPE'S DEBTS: Wife represents and warrants to Husband
that since the separation she has not and in the future she will
not contract or incur any debt or liability, except as set forth
hereafter in this agreement, for which Husband or his estate might
be responsible and shall indemnify and save harmless Husband from
any and all claims or demands incurred by her.
4. HUSBAND'S DEBTS: Husband represents and warrants to
Wife that since the separation he has not and in the future he will
not contract or incur any debt or liability, except as set forth
hereafter in this agreement, for which Wife or her estate might be
responsible and shall indemnify and save harmless Wife from any and
all claims or demands made against her by reason of debts or
obligations incurred by him.
5 . OUTSTANDING JOINT DEBTS: Husband agrees to pay the
following outstanding debt:

All other debts, contracts, obligations or liabilities incurred at
any time in the past by either of the parties will be paid promptly
by said party, unless and except as otherwise specifically set
forth in this Agreement; and each of the parties hereto further

promises, covenants and agrees that each will now and at all times
hereafter save harmless and keep the other or his or her estate
indemnified and saved harmless from all debts or liabilities
incurred by him or her, as the case may be, and from all actions,
claims and demands whatsoever with respect thereto, and from all
costs, legal or otherwise, and counsel fees whatsoever appertaining
to such actions, claims and demands. Neither party shall, after
the date of this Agreement, contract or incur any debt or liability
for which the other or his or her property might be responsible,
and shall indemnify and save harmless the other from any and all
claims or demands made against her or him by reason of debts or
obligations incurred by her or him and from all costs, legal costs
and counsel fees unless provided to the contrary herein.
6.
MUTUAL RELEASE:
Subject to the provisions of this
Agreement, each party has released and discharged, and by this
Agreement does for himself or herself and his or her heirs, legal
representatives, executors, administrators and assigns, release and
discharge the other of and from all causes of action, claims,
rights, or demands, whatsoever in law or equity, which either of
the parties ever had or now has against the other, except any or
all causes of action for termination of the marriage by divorce or

annulment and except for all causes of action for breach of any
provisions of this Agreement. Husband and Wife specifically
release and waive any and all rights he or she might have to raise
claims under the Divorce Code of 19S0 and the 1985 Amendments
thereto including, but not limited to claims for equitable
distribution of marital property, support, alimony, alimony
pendente lite, counsel fees or expenses. The moving party, in the
Divorce action, shall request the Court to incorporate, but not
merge, this Agreement into any divorce decree. If this Agreement
is incorporated into a divorce decree, the parties shall have the
right to enforce this Agreement under the Divorce Code of 1980 and
the 1985 Amendments thereto in addition to any remedies in law or
equity and these enforcement rights are not waived or released by
any of the provisions of this Agreement. The fact that a party
brings an action to enforce the property agreement as incorporated
in the divorce decree, under the Divorce Code of 1980 and the 1988
Amendments thereto, does not give either party the right to raise
other claims under the Divorce Code, specifically waived and
released by this paragraph and all rights and obligations of the
parties arising out of the marriage shall be determined by this
Agreement.
7. DIVISION OF PERSONAL PROPERTY: The parties have divided
between them, to their mutual satisfaction, the personal effects,
household furniture and furnishings, and all other articles of
personal property which have theretofore been used by them in

common, and neither party will make any claim to any such items
which are now in the possession or under the control of the other.
Should it become necessary, the parties each agree to sign any
titles or documents necessary to give effect to this paragraph upon
request.
S. DIVISION OF REAL PROPERTY: Wife agrees to transfer all
right, title and interest in and to the real estate situated at 325
Hogestown Road, Mechanicsburg, PA 17055-3121, now titled in the
name of Husband and Wife as tenants by the entireties to the
Husband and agrees to immediately execute now or in the future any
and all deeds, documents, or papers necessary to effect such
transfer of title upon request. wife further acknowledges that she
has no claim, right, interest, or title whatsoever in said property
and further agrees never to assert any claim to said property in
the future.
Husband acknowledges that the Mortgage secured by the marital
home is in his name alone and he agrees that he will assume sole
responsibility for payment of said debt.
9. AUTOMOBILES: Husband agrees to transfer all his right,
title and interest whatever it may be to the 1992 Toyota Corolla to
the Wife. wife agrees to transfer all his right, title and
interest whatever it may be to the 1992 Saturn to the Husband.
Each party shall be responsible for any and all payments of
outstanding balances due on or arrising from ownership of the
automobile transferred to him/her.

10. EACH PARTY RETAINS OWN PENSION PLANS:

Each of the parties does specifically waive, release, renounce
and forever abandon all of his or her right, title, interest or

claim, whatever it may be, in any Pension Plan, Retirement Plan,
Profit Sharing Plan, 401-K Plan, Keogh Plan, Stock Plan, Tax
Deferred Savings Plan and/or any employee benefit plan of the other
party, whether acquired through said party's employment or
otherwise, and hereafter said Pension Plan, Retirement Plan,
Savings Plan, Tax Deferred Savings Plan and/or any employee benefit
plan shall become the sole and separate property of the party in
whose name or through whose employment said plan is carried.
As clarification of the foregoing, wife specifically waives
any and all right, title and interest to Husband's PSERS pension.
A copy of a statement from this pension as of June 30, 1996, is
attached hereto and marked as Exhibit "A".
11. DIVISION OF BANK ACCOUNTS/STOCK/LIFE INSURANCE:
The parties acknowledge and agree that they have previously
divided to their mutual satisfaction all of their bank accounts,
certificates of deposit, IRA accounts, bonds, shares of stock,
investment plans and life insurance cash value and hereafter Wife
agrees that all said bank accounts, certificates of deposit, IRA
accounts, bonds, shares of stock, investment plans and life
insurance cash value in the possession of Husband shall become the
sole and separate property of Husband; and Husband agrees that all
the said bank accounts, certificates of deposit, IRA accounts,

bonds, shares of stock, investment plans and life insurance cash
value in the possession of Wife shall become the sole and separate
property of Wife. Each of the parties does specifically waive,
release, renounce and forever abandon whatever right, title,
interest or claim, he or she may have in any bank account,
certificates of deposit, IRA accounts, bonds, shares of stock,
investment plans and life insurance cash value that is to become
the sole and separate property of the other pursuant to the terms
hereof.
12. HEALTH INSURANCE: Husband agrees to maintain Wife as a
covered party under his Blue Cross/Blue Shield Health Insurance as
provided by his employer until September 1, 1995.
13. LUMP SUM PAYMENT TO WIFE: Husband shall pay Wife the sum
of SIX THOUSAND ($6,000.00) DOLLARS within sixty (60) days of the
signing of this Agreement.
14. WIFE SUPPORT: The parties hereby acknowledge that the
Husband is currently the subject of a spousal support order in the
amount of FIVE HUNDRED FORTY ($540.00) DOLLARS plus arrears, if
applicable, from Allegheny County, pennsyl vania. Both parties
agree that they shall take no steps to modify said order except
that Wife agrees to seek to have that order terminated effective
September 1, 1998 and acknowledges and agrees that Husband owes no
spousal support from September 1, 1998, forward.
15. WAIVERS OF CLAIMS AGAINST ESTATES: Except as herein
otherwise provided, each party may dispose of his or her property

in any way, and each party hereby waives and relinquishes any and
all rights he or she may now have or hereafter acquire, under the
present or future laws of any jurisdiction, to share in the
property or the estate of the other as a result of the marital
relationship, including without limitation, dower, curtesy,
statutory allowance, widow's allowance, right to take in intestacy,
right to take against the Will of the other, and right to act as
administrator or executor of the other's estate, and each will, at
the request of the other, execute, acknowledge, and deliver any and
all instruments which may be necessary or advisable to carry into
effect this mutual waiver and relinquishment of all such interests,
rights and claims.
16. SUBSEOUENT DIVORCE: The parties agree and acknowledge
that they will seek to finalize this divorce in September of 1995.
Both parties agree to execute Affidavits of Consent to Divorce and
Waiver of Notice of Intention to Request Entry of a Divorce Decree
pursuant to Section 3301(c) of the Divorce Code, concurrent with
the signing of this agreement, and shall direct their respective
counsel to file with the Court said documents. Husband agrees that
he shall direct his counsel to file with the Court a Decree in
Divorce from the bonds of matrimony under Section 3301(c) of the
Divorce Code.
17. BREACH: If either party breaches any provision of this
Agreement, the other party shall have the right, at his or her
election, to sue for damages for such breach or seek such other

remedies or relief as may be available to him or her, and the party

breaching this contract shall be responsible for payment of legal
fees and costs incurred by the other in enforcing their rights
under this Agreement.
1S. ADDITIONAL INSTRUMENTS: Each of the parties shall from
time to time, at the request of the other, execute, acknowledge,
and deliver to the other party any and all further instruments that
may be reasonably required to give full force and effect to the
provisions of this Agreement.
19. VOLUNTARY EXECUTION: The provisions of this Agreement
and their legal effect have been fully explained to the parties by
their respective counsel.
The Wife has employed and had the
benefit of counsel of Christopher C. Houston as her attorney. The
Husband has employed and had the benefit of counsel of J. Paul
Helvy as his attorney. Each party acknowledges that he or she has
received independent legal advice from counsel of his or her
selection and that each fully understands the facts and has been
fully informed as to his or her legal rights and obligatio~s, and
each party acknowledges and accepts that this Agreement is, under
the circumstances, fair and equitable, and that it is being entered
into freely and voluntarily after having received such advice and
with such knowledge, and that execution of this Agreement is not
the result of any duress or undue influence and that it is not the
result of any collusion or improper or illegal agreement or
agreements.
Also, each party hereto acknowledges that he or she

has been fully advised by his or her respective attorney of the
impact of the new Pennsylvania Divorce Reform Act, whereby the
Court has the right and duty to determine all marital rights of the
parties, including divorce, alimony, alimony pendente lite,
equitable distribution of all marital property or property owned or
possessed individually by the other, counsel fees and costs of
litigation and, fully knowing the same and being fully advised of
his or her rights thereunder, each party hereto still desires to
execute this Agreement acknowledging that the terms and conditions
set forth herein are fair, just, and equitable to each of the
parties and waives their respective right to have the Court of
Common Pleas of Cumberland County or any other Court of competent
jurisdiction to make any determination or order affecting the
respective parties' right to a divorce, alimony, alimony pendente
lite, equitable distribution of all marital property, counsel fees
and costs of litigation.
20. ENTIRE AGREEMENT: This Agreement contains the entire
understanding of the parties, and there are no representations,
warranties, covenants, or undertakings other than those expressly
set forth herein.
21. MODIFICATION AND WAIVER: A modification or waiver of any
of the provisions of this Agreement shall be effective only if made
in writing and executed with the same formality as this Agreement.
The failure of either party to insist upon strict performance of

any of the provisions of this Agreement shall not be construed as
a waiver of any subsequent default of the same or similar nature.
22. DESCRIPTIVE HEADINGS I
The descriptive headings used
herein are for convenience only.
They shall have no effect
whatsoever in determining the rights or obligations of the parties.
23. MUTUAL ACCEPTANCE: The parties accept the provisions of
this Agreement in lieu of and in full and final settlement and
satisfaction of all claims and demands that they may now or
hereafter have against each other for their support and
maintenance, and also alimony, alimony pendente lite, counsel fees
or for any other provision for their support and maintenance, and
also alimony, alimony pendente lite, counsel fees, costs and
expenses and any other charge of any nature whatsoever pertaining
to any divorce proceeding which may have been or may be instituted
by the parties in any court in the Commonwealth of Pennsylvania or
any other jurisdiction and/or any divorce proceeding which may be
instituted by either party in any court in the Commonwealth of
pennsylvania or any other jurisdiction or any other counsel fees,
costs or expenses incurred or to be charged by any counsel arising
in any manner whatsoever for breach of this Agreement.
24 . INDEPENDENT SEPARATE COVENANTS I
It is specifically
understood and agreed by and between the parties hereto that each
paragraph hereof shall be deemed to be a separate and independent
covenant and agreement.

25. APPLICABLE LAW: This Agreement shall be construed under
the laws of the Commonwealth of Pennsylvania.
26. PRIOR AGREEMENTS: It is understood and agreed that any
and all property settlement agreements which mayor have been
executed prior to the date and time of this Agreement are null and
void and of no effect.
27. VOID CLAUSES:
If any term, condition, clause or
provision of this Agreement shall be determined or declared to be
void or invalid in law or otherwise, then only that term,
condition, clause or provision shall be stricken from this
Agreement and in all other respects this Agreement shall be valid
and continue in full force, effect and operation.
2S. DISCLOSURE: The respective parties do hereby warrant,
represent, and declare and do acknowledge and agree that each is
and has been fully and completely informed of and is familiar with
and cognizant of the wealth, real and/or personal property, estate
and assets, earnings and income of the other and that each has made
a full and complete disclosure to the other of his or her entire
assets and liabilities and any further enumeration or statement
thereof in this Agreement is hereby specifically waived, and the
parties do not wish to make or append hereto any further
enumeration or statement.
Each of the parties hereto further
covenants and agrees for himself or herself and his or her heirs,
executors, administrators and assigns, that he or she will never,
at any time hereafter, sue the other party or his or her heirs,

COMPLAINT IN DIVORCE
AND NOW comes George K. Null, by and through his counsel,
Killian & Gephart, who represents as follows:
1. Plaintiff, George K. Null, is an adult individual, who
currently resides at 325 Hogestown Road, Mechanicsburg, Cumberland
County, Pennsylvania. His date of birth is December 11, 1966 and
social security number is 177-42-4100.
2. Defendant, Levato V. Null, is an adult individual who
currently resides at 452 S. Atlantic Avenue, Pittsburgh,
Pennsylvania. Her date of birth is September 19, 1969 and social
security number is 1S3-64-8364.
3. Plaintiff avers that he has been a bonafide resident in
the Commonwealth of Pennsylvania for a period of at least six (6)
months previous to the filing of this Complaint.
4. The Plaintiff and Defendant were married on August 7,
1993 in Mechanicsburg, Pennsylvania.
5. Plaintiff avers that there are no children of the parties
under the age of lB.

6. Neither Plaintiff nor Defendant is in the military or
naval service of the United States or its allies within the
provisions of the Soldiers' and Sailors' Civil Relief Act of the
Congress of 1940 and its amendments.
7. There have been no other prior actions of divorce or
annulment filed by either of the parties hereto.
B. Plaintiff has been advised of the availability of
counseling and that Plaintiff has the right to request that the
Court require the parties to participate in counseling.
9. The marriage is irretrievably broken.
CLAIM FOR EQUITABLE DISTRIBUTION OF
MARITAL PROPERTY UNDER SECTION 401 OF THE DIVORCE CODE
10. The averments of Paragraphs 1 through 9 are hereby
incorporated by reference thereto.
11. Plaintiff and Defendant are the joint owners as tenants
by the entireties of certain real estate known as 325 Hogestown
Road, Mechanicsburg, Pennsylvania which is subject to equitable
distribution by this Court.
12. The Plaintiff and Defendant are the owners of various
items of personal property, furniture, household goods, and
furnishings acquired during their marriage which are subject to
equitable distribution by this Court.
13. The Plaintiff and Defendant are the owners of various
motor vehicles, bank accounts, insurance policies, pension, profit

sharing and retirement plans, and other tangible and intangible
personal property acquired during their marriage which are subject
to equitable distribution by this Court.
WHEREFORE, the Plaintiff requests the Court enter a Decree:
a. Dissolving the marriage between Plaintiff and
Defendant;
b. Equitably distributing all marital property owned by
the parties hereto;
c. Such further relief as the Court may determine
equitable and just.

have a brief meeting in order to determine whether it is necessary
to schedule a hearing in this matter.

MEMORANDUM OF UNDERSTANDING
Tuesday, April 7, 1998
THE MASTER: This is the date set for a pre-hearing
conference. Counsel for the Plaintiff, George K. NUll, is
attorney J. Paul Helvy, and counsel for the Defendant, Levato V.
NUll, is attorney Christopher C. Houston.
Both counsel appeared this morning to review the
information that we normally discuss for a pre-hearing
conference. At which time, before we got into the details of
the case, counsel had a discussion and advised that the case is
tentatively settled pending review of the final agreement by
their clients.
We are going to have counsel place on the record a
memorandum of the understanding between counsel of the
settlement, understanding that the parties are not bound because
they are not here in the conference room today; however, the
Master understands that the memorandum is an outline of what the
parties and counsel have agreed to and counsel are going to
reduce the memorandum to a formal agreement which will be signed
by both parties and witnessed by counsel. Upon receipt of the
signed agreement by the parties, the Master will prepare an
order vacating his appointment.
The parties will sign and file affidavits of
consent and waivers of notice of intention to request entry of
divorce decree. These documents will be submitted when the
signed copy of the agreement is provided to the Master.
Mr. Helvy is going to state the agreement on the
record in the presence of Mr. Houston. The memorandum agreement
will be transcribed and a copy submitted to each counsel. Mr.
Helvy.
MR. HELVY: The substance of the agreement between
the parties is substantially similar to the draft that ~as
prepared on February 12, 1998, and forwarded to attorney
Houston. A summary of the agreement is as follows:
1. Each party will keep whatever personal property is in
their possession.
2. Husband agrees to pay the $5,000.00 Discover Card debt.
Husband further agrees to indemnify and hold wife
harmless from any responsibility for that debt.
3. Wife agrees to transfer the 325 Hogestown Road,
Mechanicsburg, Pennsylvania, property to husband.
Husband agrees to indemnify and hold wife harmless from
any responsibility from the mortgage, which is in his
name alone.
4. Wife is to get the 1992 Toyota Corolla. Husband is to
get the 1992 Saturn. To the extent that there is any
debt on the vehicles, the party receiving the vehicle
will be responsible for the debt on that vehicle.
5. Husband gets his PSERS pension and any other deferred
savings plan he has.
6. Wife gets her pension and any deferred savings plan she
has.
7. Husband agrees to maintain wife on the health insurance
until September 1, 1998.
8. Husband will pay wife within 60 days of the signing of an
agreement $6,000.00.
9. Husband will continue to pay support until September
1, 1998. Wife agrees to take the necessary steps to
terminate the spousal support order through the Domestic
Relations Office by September 1, 1998. The support
order is through the Domestic Relations Office of
Allegheny County in the amount of $540.00 per month
plus payment on the arrears, to the extent that there are
any arrears. The payments will not be modifiable
between now and September 1, 1998.
10. The parties agree to file the necessary documents to get
divorced in September of 1998 and not before then, except
that affidavits of consent and waivers of notice of
intention to request entry of divorce decree will be
provided to the Master at the time a signed agreement
is transmitted to the Master.
11. Both parties waive any claims they may have for alimony,
alimony pendente lite, or any other claims they have
arising through the divorce code as well as counsel fees,
costs, and expenses.

Attached as exhibits hereto are copies of the Fee Agreement and
invoices for services rendered to date for Defendant's attorney's
fees. Defendant will supplement at the hearing the invoices for
services rendered up to the hearing.
(9) DISPUTED VALUATIONS OP
TANGIBLE PERSONAL PROPERTY AND OTHER ASSETS
It appears that there will be a dispute as to the date of
separation of the parties. It appears that it is the Plaintiff's
position that the parties separated in September of 1995, when the
Defendant started attending school at Duquesne University in
Pittsburgh. It is the Defendant's position that the parties were
not separated at that time. The Defendant returned to the marital
residence on several occasions including holidays during that time
period, while she was attending school.
It is the Defendant's
position that the parties did not separate until the beginning of
January 1996. This dispute in the date of separation would affect
the valuations for the following items:
A. Date of separation value of Husband's PSERS pension;
B. Date of separation values of bank accounts and Certificates of
Deposit;

C. The Defendant's vehicle was acquired after the date that
Plaintiff's claimed the parties separated. Cash from the
Members 1"t Federal Credit Union account of Husband was
utilized for the acquisition of this vehicle. Accordingly, if
September 1995 is found to be the date of separation, what may
need to be considered as marital property as of that date is
not the 1992 Toyota Corrola but, instead, the cash utilized
for the acquisition of that vehicle;
D. Plaintiff claims that $9,S32 of his Members lot Federal Credit
Union account is pre-marital. An issue for consideration is
to the extent that those funds were replaced with marital
funds;
E. With respect to the marital residence, Defendant is not in a
position to set forth what she believes the marital equity in
the residence actually is. She has no information pertaining
to loan balances as of the date of marriage and current loan
balances. There may be a need to present testimony concerning
improvements that were made to the marital residence just
prior to the parties' marriage for which, however, the
Defendant and her family greatly contributed. The non-marital
portion of the value of this asset would, therefore, be the
value more associated with the purchase price of this
property; and
F. With respect to Husband's 401(k), a portion of this mayor may
not be deemed to be a marital asset depending upon the date of
separation.
There are no issues with respect to miscellaneous household goods
and furnishings in that Defendant has received those items from the
marital residence that she wishes to receive and does not feel that
it is necessary to have any appraisals performed on any household
goods and furnishings.

FEE AGREEMENT
We are pleased that you have asked our firm to represent you. This
document sets forth the Agreement concerning our representation of
you and will become effective upon our receipt of a countersigned
copy of this Agreement and the retainer fee. We cannot undertake
to do any work on your case until we receive this Agreement signed
by you and the retainer fee.
1. We request that you pay to our firm a retainer in the amount
of $500. We will apply our retainer against time expended on
your behalf, and at such time as that amount is exhausted, you will
be billed regularly for additional time expended.
If the matter involves going to trial, we may request that you
increase the amount of the retainer.
2. Our representation of you will be charged at an hourly rate.
Our hourly rate is $125 per hour. These rates may be modified over
time, although at this moment, we do not anticipate any changes.
Our monthly statem~nts to you will reflect the rates in effect at
the time the service was performed. We do not ordinarily notify
our clients of changes in the rates. We will keep you advised of
all time expended by us in representing you. It is impossible to
determine in advance the amount of time that will be needed to
complete your case. We will keep you fully informed of time used
for conferences, drafting documents, research, court time, and any
other time spent on your case.
3. We will bill you periodically on a time expended basis. We
reserve the right to terminate our attorney/client relationship for
non-payment of fees and costs. We expect you to keep current with
our billings. We will charge a finance charge of one per cent (1'1
per month (annual rate of 12'1 to any account balance which remains
outstanding for more than 30 days from the date such balance is
invoiced.
4. Costs are our out-of-pocket expenses, such as filing fees,
process serving fees, transcripts, photocopies, long distance phone
calls, travel mileage, investigators, appraisers, and accountants.
Costs will also be itemized and billed on a periodic basis. In
most instances, you will be required to advance all costs necessary
for your case.

5. We shall keep you informed as to the progress of Jour case.
When necessary, we shall send copies of all papers co ng in and
going out of our offices including correspondence, pleadings and
other documents. If I am unavailable when you telephone, your call
will be returned with reasonable promptness. There will be time
when I will be in Court, at meetings, or otherwise unavailable to
answer your call. At such times, please feel confident to talk
with my secretary. If you are passing on information, they can
delivery it to me without the necessity of your waiting to have me
return the call. If you have a questions that requires an answer
from me, it is far easier for them to obtain the background from
you, bring the matter to my attention when I am free, and then have
a response to you. If it is necessary that you speak with me
directly, I will attempt to return your call as soon as possible.
I have also found that in many instances that if you have a
particularly detailed question or concern that it is best that you
schedule an appointment to review that matter. If you are calling
to set up an appointment only, you need not ask for me personally.
Please ask to speak to my secretary who will be able to set up an
appointment at a time convenient to you.
6. Frequently, courts will send doc~entfi directly to you, as a
party to the litigation, and they will not send copies to us, as
your attorney of record. For this reason, it is very important
that you forward to us any documents, papers, or correspondence
which have been sent directly to you from the Court or from any
other source which may have any bearing on this matter.
7. We shall have at all times the right to terminate our services
upon written notice to that effect in the event that you either
fail to cooperate with us in any reasonable request, to timely pay
the monthly statements in full as submitted, or if we determine in
our reasonable discretion that to continue our services to you
would be unethical or impractical.
Please date and countersign this Agreement and return it to us
together with your retainer payment.

PROPERTY SETTLEMENT AGREEMENT

by and between George K. Null of 325 Hogestown Road, Mechanicsburg,
Cumberland County, Pennsylvania (hereinafter referred to as
"Husband"), and Levato V. Null of 310 Washington Street, Apt. #2,
Cumberland, Maryland (hereinafter referred to as "Wife").
WITNESSETH:
WHEREAS, Husband and Wife were lawfully married on August 7,
1993, and;
WHEREAS, no children have been conceived of this marriage; and
WHEREAS, differences have arisen between Husband and Wife in
consequence of which they have been separate and apart from each
other; and
WHEREAS, Husband and Wife desire to settle and determine their
rights, obligations and the support and maintenance of the Wife by
the Husband; and
NOW THEREFORE, the parties intending to be legally bound
hereby covenant and agree:
1. SEPARATION: It shall be lawful for each party at all
times hereafter to live separate and apart from the other party at
such place as he or she may from time to time choose or deem fit.
The foregoing provisions shall not be taken as an admission on the
part of either party of the lawfulness or unlawfulness of the
causes leading to their living apart.

INTERFERENCE: Each
shall
be
free
from
party
interference, authority, and contact by the other, as fully as if
he or she were single and unmarried except as may be necessary to
carry out the provisions of this Agreement. Neither party shall
molest the other or attempt to endeavor to molest the other, nor
compel the other to cohabit with the other, or in any way harass or
malign the other, nor in any way interfere with the peaceful
existence, separate and apart from the other.
3. WIFE'S DEBTS: Wife represents and warrants to Husband
that since the separation she has not and in the future she will
not contract or incur any debt or liability, except as set forth
hereafter in this agreement, for which Husband or his estate might
be responsible and shall indemnify and save harmless Husband from
any and all claims or demands incurred by her.
4.
HUSBAND'S DEBTS:
Husband represents and warrants to
Wife that since the separation he has not and in the future he will
not contract or incur any debt or liability, except as set forth
hereafter in this agreement, for which Wife or her estate might be
responsible and shall indemnify and save harmless Wife from any and
all claims or demands made against her by reason of debts or
obligations incurred by him.
5.
OUTSTANDING JOINT DEBTS:

All other debts, contracts. obligations or liabilities incurred at
any time in the past by either of the parties will be paid promptly
by said party, unless and except as otherwise specifically set
forth in this Agreement; and each of the parties hereto further
promises, covenants and agrees that each will now and at all times
hereafter save harmless and keep the other or his or her estate
indemnified and saved harmless from all debts or liabilities
incurred by him or her, as the case may be, and from all actions,
claims and demands whatsoever with respect thereto, and from all
costs, legal or otherwise, and counsel fees whatsoever appertaining
to such actions, claims and demands. Neither party shall, after
the date of this Agreement, contract or incur any debt or liability
for which the other or his or her property might be responsible,
and shall indemnify and save harmless the other from any and all
claims or demands made against her or him by reason of debts or
obligations incurred by her or him and from all costs, legal costs
and counsel fees unless provided to the contrary herein.
6.
MUTUAL RELEASE:
Subject to the provisions of this
Agreement, each party has released and discharged, and by this
Agreement does for himself or herself and his or her heirs, legal
representatives, executors, administrators and assigns, release and
discharge the other of and from all causes of action, claims,
rights, or demands, whatsoever in law or equity, which either of
the parties ever had or now has against the other, except any or
all causes of action for termination of the marriage by divorce or

annulment and except for all causes of action for breach of any
provisions of this Agreement.
Husband and wife specifically
release and waive any and all rights he or she might have to raise
claims under the Divorce Code of 1980 and the 1988 Amendments
thereto including, but not limited to claims for equitable
distribution of marital property, support, alimony, alimony
pendente lite, counsel fees or expenses. The moving party, in the
Divorce action, shall request the Court to incorporate, but not
merge, this Agreement into any divorce decree. If this Agreement
is incorporated into a divorce decree. the parties shall have the
right to enforce this Agreement under the Divorce Code of 1980 and
the 1988 Amendments thereto in addition to any remedies in law or
equity and these enforcement rights are not waived or released by
any of the provisions of this Agreement. The fact that a party
brings an action to enforce the property agreement as incorporated
in the divorce decree, under the Divorce Code of 1980 and the 1988
Amendments thereto, does not give either party the right to raise
other claims under the Divorce Code, specifically waived and
released by this paragraph and all rights and obligations of the
parties arising out of the marriage shall be determined by this
Agreement.
7. DIVISION OF PERSONAL PROPERTY: The parties have divided
between them, to their mutual satisfaction, the personal effects,
household furniture and furnishings, and all other articles of
personal property which have theretofore been used by them in

common, and neither party will make any claim to any such items
which are now in the possession or under the control of the other.
Should it become necessary, the parties each agree to sign any
titles or documents necessary to give effect to this paragraph upon
request.
8. DIVISION OF REAL PROPERTY: Wife agrees to transfer all
right, title and interest in and to the real estate situated at 325
Hogestown Road, Mechanicsburg, PA 17055-3121, now titled in the
name of Husband and Wife as tenants by the entireties to the
Husband and agrees to immediately execute now or in the future any
and all deeds, documents, or papers necessary to effect such
transfer of title upon request. wife further acknowledges that she
has no claim, right, interest, or title whatsoever in said property
and further agrees never to assert any claim to said property in
the future.
Husband acknowledges that the Mortgage secured by the marital
home is in his name alone and he agrees that he will assume sole
responsibility for payment of said debt.
9. AUTOMOBILES: Husband agrees to transfer all his right,
title and interest whatever it may be to the 1992 Toyota Corolla to
the Wife. Wife agrees to transfer all his right, title and
interest whatever it may be to the 1992 Saturn to the Husband.
Each party shall be responsible for any and all payments of
outstanding balances due on or arrising from ownership of the
automobile transferred to him/her.

10. EACH PARTY RETAINS OWN PENSION PLANS:
Each of the parties does specifically waive, release, renounce
and forever abandon all of his or her right, title, interest or
claim, whatever it may be, in any Pension Plan, Retirement Plan,
Profit Sharing Plan, 401-K Plan, Keogh Plan, Stock Plan, Tax
Deferred Savings Plan and/or any employee benefit plan of the other
party, whether acquired through said party's employment or
otherwise, and hereafter said Pension Plan, Retirement Plan,
Savings Plan, Tax Deferred Savings plan and/or any employee benefit
plan shall become the sole and separate property of the party in
whose name or through whose employment said plan is carried.
As clarification of the foregoing, Wife specifically waives
any and all right, title and interest to Husband's PSERS pension.
A copy of a statement from this pension as of June 30, 1996, is
attached hereto and marked as Exhibit "A".
11. DIVISION OF BANK ACCOUNTS/STOCK/LIFE INSURANCE:
The parties acknowledge and agree that they have previously
divided to their mutual satisfaction all of their bank accounts,
certificates of deposit, IRA accounts, bonds, shares of stock,
investment plans and life insurance cash value and hereafter Wife
agrees that all said bank accounts, certificates of deposit, IRA
accounts, bonds, shares of stock, investment plans and life
insurance cash value in the possession of Husband shall become the
sole and separate property of Husband; and Husband agrees that all
the said bank accounts, certificates of deposit, IRA accounts,

bonds, shares of stock, investment plans and life insurance cash
value in the possession of Wife shall become the sole and separate
property of Wife. Each of the parties does specifically waive.
release, renounce and forever abandon whatever right. title,
interest or claim, he or she may have in any bank account,
certificates of deposit, IRA accounts, bonds, shares of stock,
investment plans and life insurance cash value that is to become
the sole and separate property of the other pursuant to the terms
hereof.
12. HEALTH INSURANCE: Husband agrees to maintain Wife as a
covered party under his Blue Cross/Blue Shield Health Insurance as
provided by his employer until September 1, 1998.
13. LUMP SUM PAYMENT TO WIFE: Husband shall pay Wife the sum
of SIX THOUSAND ($6,000.00) DOLLARS within sixty (60) days of the
signing of this Agreement.
14. WIFE SUPPORT: The parties hereby acknowledge that the
Husband is currently the subject of a spousal support order in the
amount of FIVE HUNDRED FORTY ($540.00) DOLLARS plus arrears, if
applicable, from Allegheny County, pennsyl vania. Both parties
agree that they shall take no steps to modify said order except
that Wife agrees to seek to have that order terminated effective
September 1, 1998 and acknowledges and agrees that Husband owes no
spousal support from September 1, 1998, forward.
15. WAIVERS OF CLAIMS AGAINST ESTATES I Except as herein
otherwise provided, each party may dispose of his or her property

in any way, and each party hereby waives and relinquishes any and
all rights he or she may now have or hereafter acquire, under the
present or future laws of any jurisdiction, to share in the
property or the estate of the other as a result of the marital
relationship, including without limitacion, dower, curtesy,
statutory allowance, widow's allowance, right to take in intestacy,
right to take against the Will of the other, and right to act as
administrator or executor of the other's estate, and each will, at
the request of the other, execute, acknowledge, and deliver any and
all instruments which may be necessary or advisable to carry into
effect this mutual waiver and relinquishment of all such interests,
rights and claims.
16. SUBSEOUENT DIVORCE: The parties agree and acknowledge
that they will seek to finalize this divorce in September of 1998.
Both parties agree to execute Affidavits of Consent to Divorce and
Waiver of Notice of Intention to Request Entry of a Divorce Decree
pursuant to Section 3301(c) of the Divorce Code, concurrent with
the signing of this agreement, and shall direct their respective
counsel to file with the Court said documents. Husband agrees that
he shall direct his counsel to file with the Court a Decree in
Divorce from the bonds of matrimony under Section 3301(c) of the
Divorce Code.
17. BREACH: If either party breaches any provision of this
Agreement, the other party shall have the right, at his or her
election, to sue for damages for such breach or seek such other

remedies or relief as may be available to him or her, and the party
breaching this contract shall be responsible for payment of legal
fees and costs incurred by the other in enforcing their rights
under this Agreement.
18. ADDITIONAL INSTRUMENTS: Each of the parties shall from
time to time, at the request of the other, execute, acknowledge,
and deliver to the other party any and all further instruments that
may be reasonably required to give full force and effect to the
provisions of this Agreement.
19. VOLUNTARY EXECUTION: The provisions of this Agreement
and their legal effect have been fully explained to the parties by
their respective counsel. The Wife has employed and had the
benefit of counsel of Christopher C. Houston as her attorney. The
Husband has employed and had the benefit of counsel of J. Paul
Helvy as his attorney. Each party acknowledges that he or she has
received independent legal advice from counsel of his or her
selection and that each fully understands the facts and has been
fully informed as to his or her legal rights and obligations, and
each party acknowledges and accepts that this Agreement is, under
the circumstances, fair and equitable. and that it is being entered
into freely and voluntarily after having received such advice and
with such knowledge, and that execution of this Agreement is not
the result of any duress or undue influence and that it is not tbe
result of any collusion or improper or illegal agreement or
agreements. Also, each party hereto acknowledges that he or she

has been fully advised by his or her respective attorney of the
impact of the new Pennsylvania Divorce Reform Act, whereby the
Court has the right and duty to determine all marital rights of the
parties, including divorce, alimony, alimony pendente lite,
equitable distribution of all marital property or property owned or
possessed individually by the other, counsel fees and costs of
litigation and, fully knowing the same and being fully advised of
his or her rights thereunder, each party hereto still desires to
execute this Agreement acknowledging that the terms and conditions
set forth herein are fair, just, and equitable to each of the
parties and waives their respective right to have the Court of
Common Pleas of Cumberland County or any other Court of competent
jurisdiction to make any determination or order affecting the
reepective parties' right to a divorce, alimony, alimony pendente
lite, equitable distribution of all marital property, counsel fees
and costs of litigation.
20. ENTIRE AGREEMENT: This Agreement contains the entire
understanding of the parties, and there are no representations,
warranties, covenants, or undertakings other than those expressly
set forth herein.
21. MODIFICATION AND WAIVER: A modification or waiver of any
of the provisions of this Agreement shall be effective only if made
in writing and executed with the same formality as this Agreement.
The failure of either party to insist upon strict performance of

any of the provisions of this Agreement shall not be construed as
a waiver of any subsequent default of the same or similar nature.
22. DESCRIPTIVE HEADINGS: The descriptive headings used
herein are for convenience only. They shall have no effect
whatsoever in determining the rights or obligations of the parties.
23. MUTUAL ACCEPTANCE: The parties accept the provisions of
this Agreement in lieu of and in full and final settlement and
satisfaction of all claims and demands that they may now or
hereafter have against each other for their support and
maintenance, and also alimony, alimony pendente lite, counsel fees
or for any other provision for their support and maintenance, and
also alimony, alimony pendente lite, counsel fees, costs and
expenses and any other charge of any nature whatsoever pertaining
to any divorce proceeding which may have been or may be instituted
by the parties in any court in the Commonwealth of Pennsylvania or
any other jurisdiction and/or any divorce proceeding which may be
instituted by either party in any court in the Commonwealth of
Pennsylvania or any other jurisdiction or any other counsel fees,
costs or expenses incurred or to be charged by any counsel arising
in any manner whatsoever for breach of this Agreement.
24. INDEPENDENT SEPARATE COVENANTS: It is specifically
understood and agreed by and between the parties hereto that each
paragraph hereof shall be deemed to be a separate and independent
covenant and agreement.

25. APPLICABLE LAW: This Agreement shall be construed under
the laws of the Commonwealth of Pennsylvania.
26. PRIOR AGREEMENTS: It is understood and agreed that any
and all property settlement agreements which mayor have been
executed prior to the date and time of this Agreement are null and
void and of no effect.
27. VOID CLAUSES: If any term, condition, clause or
provision of this Agreement shall be determined or declared to be
void or invalid in law or otherwise, then only that term,
condition, clause or provision shall be stricken from this
Agreement and in all other respects this Agreement shall be valid
and continue in full force, effect and operation.
28. DISCLOSURE: The respective parties do hereby warrant,
represent, and declare and do acknowledge and agree that each is
and has been fully and completely informed of and is familiar with
and cognizant of the wealth, real and/or personal property, estate
and assets, earnings and income of the other and that each has made
a full and complete disclosure to the other of his or her entire
assets and liabilities and any further enumeration or statement
thereof in this Agreement is hereby specifically waived, and the
parties do not wish to make or append hereto any further
enumeration or statement. Each of the parties hereto further
covenants and agrees for himself or herself and his or her heirs,
executors, administrators and assigns, that he or she will never,
at any time hereafter, sue the other party or his or her heirs,
