At all times material hereto, FM&T Sgrignoli sub- contracted the plumbing of Plaintiffs' home to Wilbur Plumbing and Heating, Inc. 7. On or about March 16, 1995 a commode, which was installed by Defendant, leaked causing extensive water damage to Plaintiffs' home and personal property. 8. The aforesaid water leak was caused solely by the carelessness, recklessness and negligence of Defendant Wilbur Plumbing and Heating, Inc., and/or its agents, which consisted, inter alia, of the following: a. Failing to properly install the plumbing to the commode; and/or the commode itself. b. Failing to install the plumbing to the commode and/or the commode itself in a proper and workmanlike fashion according to the standards as existing in and about Cumberland County, Pennsylvania. c. Being otherwise careless, reckless and negligent. 9. Solely as a result of the aforesaid water leak, Plaintiffs' home sustained damage in the amount of Ten Thousand Three Hundred Ninety Three Dollars and Fifty-one Cents ($10,393.51). A copy of the actual damages are marked exhibit "A" attached hereto and incorporated herein by reference. VERIFICATION I, Mark J. Swab, hereby verify that I am the Plaintiff in the foregoing action, and that the averments of the attached Complaint are true and correct to the best of my knowledge, information and belief. PA 17055. 5, Admitted on information received, 6, Denied, Answering Defendant never contracted or subcontracted with FM&T Sgrignoli and never did any work on Plaintill's home until the installation of a water heater some time in late 1995, 7.
