Plaintiff, Midfirst Bank f/k/a Midfirst Bank, State Savings
Bank, through its counsel, Leon P. Haller, Esquire, hereby
respectfully submits:
1. Plaintiff has brought a mortgage foreclosure action
whereupon it seeks to foreclose against certain pro~erty owned by the
Defendants located at 223 South 2nd Street, Wormleysburg, PA 17043.
2. The Sheriff attempted service at the property address and
reported it to be padlocked and abandoned. Alternative addresses were
provided for both Defendants and when attempted, it was reported that
Defendant William C. Hernandez was not found. Defendant Rhonda K.
Hernandez a/k/a Rhonda K. Shawver was served at the Sheriff's office
of Dauphin County. No further addresses were found through the
investigation.
3. Plaintiff has conducted an investigation in order to
determine the whereabouts of the Defendants as set forth on the
attached Affidavit.
4. Notwithstanding the investigation as set forth in the
within Affidavit, Plaintiff has been unable to serve said Defendants.

says that he is the attorney for the Plaintiff in the above action in
mortgage foreclosure, that he has personal knowledge concerning the
facts set forth in the attached Motion for Service of Process
Pursuant to Rule 430, that he has authority from the Plaintiff to
make this affidavit, and that the facts set forth in the affidavit
are true and correct to the best of his knowledge, information, and
belief, to wit:
That he has attempted to confirm the whereabouts of the
Defendants in the above case, by conducting a reasonable search,
which search included one or more of the following as indicated by a

1. Plaintiff, HOMES IDE LENDING, INC" F/K/A BANCBOSTON MORTGAGE
CORPORATION, is a corporation with an office at Post Office Box
44090, Jacksonville, Florida 32231.
2. Defendants, WILLIAM HERNANDEZ a/k/a WILLIAM C. HERNANDEZand
RHONDA K. HERNANDEZ a/k/a RHONDA K. SHAWVER, are both adult .
individuals whose last known residence is 223 South Second Street,
Wormleysburg, Pennsylvania 17043 and/or 5079 Stacey Drvie,
Harrisburg, Pennsylvania 17043 and/or 1075-A Huron Drive, Harrisburg,
Pennsylvania 17111.
3. On or about September 17, 1990, Defendants executed ,and
delivered a Mortgage Note in the sum of $56,415.00 payable to
MARGARETTEN & COMPANY, INC., (original mortgagee), a copy of said
Note is attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of the
aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to the original Mortgagee, a
certain real estate Mortgage which is recorded in the within
Commonwealth and County in the Office of the Recorder of Deeds in
Mortgage Book 990, page 1165, conveying to the original Mortgagee t~s
real estate described therein. Said Mortgage was subsequently
assigned to BancBoston Mortgage Corporation, in the within County ar.d

8. No Judgment has been entered Upon said Mortgago in any
juriSdiction.
9, Notice of intention to foreclosure and accelerate the loan
balance pursuant to Pennsylvania Act No, 6 of 1974 is not required in
that the original principal balance exceeds $50,000,00.
10. Defendants are not members of the Armed Forces of the United
States of America, nor engaged in any way which would bring them
within the Soldiers and Sailors Relief Act of 1940, as amended.
11. The subject Nortgage is insured by the Federal Housing
Administration under Title II of the National Housing Act (12
U.S.C.A. Section 707 - 1715z11) and therefore does not fall within
the provisions of Pa. Act 91 of 1983 (Homeowners' Emergency
Assistance Act of 1983),
WHEREFORE, Plaintiff demands judgment in mortgage foreclosure

COM P L A I N T
1. Plaintiff, HOMESIDE LENDING, INC., F/K/A BANCBOSTON MORTGAGE
CORPORATION, is a corporation with an office at Post Office Box
44090, Jacksonville, Florida 32231.
2. Defendants, WILLIAM HERNANDEZ a/k/a WILLIAM C. HERNANDEZand
RHONDA K. HERNANDEZ a/k/a RHONDA K. SHAWVER, are both adult
individuals whose last known residence is 223 South Second Street,
Wormleysburg, Pennsylvania 17043 and/or 5079 Stacey Drvie,
Harrisburg, Pennsylvania 17043 and/or 1075-A Huron Drive, Harrisburg,
Pennsylvania 17111.
3. On or about September 17, 1990, Defendants executed and
delivered a Mortgage Note in the sum of $56,415.00 payable to
MARGARETTEN & COMPANY, INC., (original mortgagee), a copy of said
Note is attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of the
aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to the original Mortgagee, a
certain real estate Mortgage which is recorded in the within
Commonwealth and County in the Office of the Recorder of Deeds in
Mortgage Book 990, page 1165, conveying to the original Mortgagee the
real estate described therein. Said Mortgage was subsequently
assigned to BancBoston Mortgage Corporation, in the within County and
Commonwealth in Book 391, Page 364 on December 10, 1990. (BANCBOSTON
MORTGAGE CORPORATION is N/K/A HOMESIDE LENDING INC.,) Said Mortgage
~
and assignments are incorporated herein by reference.
5, The land subject to the Mortgage is: 223 South Second Street,
Wormleysburg, Pennsylvania 17043, and is more particularly described
in Exhibit "B" attached hereto.
6. Defendants are the real owners of the land subject to the
Mortgage.
7. The Mortgage is in default due to the fact that Mortgagors have
failed to pay the installment due on June 1, 1996, and all subsequent
installments thereon, and the following amounts are due on the
Mortgage:
(a) Unpaid principal balance
(b) Interest at $14.85 per day
from 5/1/96 to 1/31/97
(based on contract rate of 10%)

1. Plaintiff, HOMES IDE LENDING, INC., F/K/A BANCBOSTON MORTGAGE
CORPORATION, is a corporation with an office at Post Office Box
44090, JaCksonville, Florida 32231.
2. Defendants, WILLIAM HERNANDEZ a/k/a WILLIAM C. HERNANDEZand
RHONDA K. HERNANDEZ a/k/a RHONDA K. SHAWVER, are both adult
individuals whose last known residence is 223 South Second Street,
Wormleysburg, PennSYlvania 17043 and/or 5079 Stacey Drvie,
Harrisburg, Pennsylvania 17043 and/or 1075-A Huron Drive, HarriSburg,
Pennsylvania 17111.
3. On or about September 17, 1990, Defendants executed and
delivered a Mortgage Note in the sum of $56,415.00 payable to
MARGARETTEN & COMPANY, INC., (original mortgagee), a copy of said
Note is attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of the
aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to the original Mortgagee, a
certain real estate Mortgage which is recorded in the within
Commonwealth and County in the Office of the Recorder of Deeds in

failed to pay the installment due on June 1, 1996, and all subsequent
installments thereon, and the following amounts are due on the
Mortgage:

States of America, nor engaged in any way which would bring them
within the Soldiers and Sailors Relief Act of 1940, as amended.
11. The subject Mortgage is insured by the Federal Housing
Administration under Title II of the National Housing Act (12
U.S.C.A. Section 70~ - 1715z11) and therefore does not fall within
the provisions of Pa. Act 91 of 1983 (Homeowners' Emergency
Assistance Act of 1983).

Worm1eysburg, County of Cumberland, State of Pennsylvania, more particularly bounded and
described according to a survey of William B. Whittock, Registered Professional
Engineer, dated December 16, 1961, as follows:
BEGINNING at a point on the Easterly line of South Second Street, which point is one hundred
sixteen feet t~rth of the lbrtheasterly corner of Second and Poplar Streets, and at
Northerly line of land na~ or late of Miss Catherine SWartz and at dividing line between
Lots Nos. 54 and 55 on the hereinafter mentioned Plan of Lots; thence along same North

C 0 M P L A I N T
1. Plaintiff, HOMES IDE LENDING, INC., F/K/A BANCBOSTON MORTGAGE
CORPORATION, is a corporation with an office at Post Office Box
44090, Jacksonville, Florida 32231.
2. Defendants, WILLIAM HERNANDEZ a/k/a WILLIAM C. HERNANDEZand
RHONDA K. HERNANDEZ a/k/a RHONDA K. SHAWVER, are both adult
individuals whose last known residence is 223 South Second Street,
Wormleysburg, Pennsylvania 17043 and/or 5079 Stacey Drvie,
Harrisburg, Pennsylvania 17043 and/or 1075-A Huron Drive, Harrisburg,
Pennsylvania 17111.
3. On or about September 17, 1990, Defendants executed and
delivered a Mortgage Note in the sum of $56,415.00 payable to
MARGARET TEN & COMPANY, INC., (original mortgagee), a copy of said
Note is attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of the
aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to the original Mortgagee, a
certain real estate Mortgage which is recorded in the within
Commonwealth and County in the Office of the Recorder of Deeds in
Mortgage Book 990, page 1165, conveying to the original Mortgagee the
real estate described therein. Said Mortgage was subsequently
assigned to BancBoston Mortgage Corporation, in the within County and
Commonwealth in Book 391, Page 364 on December 10, 1990.
(BANCBOSTON
MORTGAGE CORPORATION is N/K/A HOMESIDE LENDING INC,,) Said Mortgage
and assignments are incorporated herein by reference.
5. The land subject to the Mortgage is: 223 South Second Street,
Wormleysburg, Pennsylvania 17043, and is more particularly described
in Exhibit "B" attached hereto.
6. Defendants are the re8i'owners of the land subject to the
Mortgage.
7. The Mortgage is in default due to the fact that Mortgagors have
failed to pay the installment due on June I, 1996, and all subsequent
installments thereon, and the following amounts are due on the
Mortgage:
(a) Unpaid principal balance
(b) Interest at $14.85 per day
from 5/1/96 to 1/31/97
(based on contract rate of 10%)

*Together with interest at the per diem rate noted in (b) above after
January 31, 1997, and other charges and costs to date of Sheriff's
Sale.
The attorney's fees set forth above are in conformity with the
Mortgage documents and Pennsylvania law, and will be collected in tr.e
event of a third party purchaser at Sheriff's Sale. If the Mortgage
is reinstated prior to the sale, reasonable attorney's fees will be
charg8d that are actually incurred by ?laintiff.
8. No Judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclosure and accelerate the loan
balance pursuant to Pennsylvania Act No. 6 of 1974 is not required in
that the original principal balance exceeds $50,000.00.
10. Defendants are not members of the Armed Forces of the United
States of America, nor engaged in any way which would bring them
within the Soldiers and Sailors Relief Act of 1940, as amended.
11. The subject Mortgage is insured by the Federal Housing
Administration under Title II of the National Housing Act (12
U.S.C.A. Section 707 - 1715z11) and therefore does not fall within
the provisions of Pa. Act 91 of 1983 (Homeowners' Emergency
Assistance Act of 1983) .
WHEREFORE, Plaintiff demands jUdgment in mortgage foreclosure
in rem for the aforementioned total amount due together with interest
at the rate of 10% ($14.85 per diem), together with other charges and
costs, including escrow advances incidental thereto, to the date of
Sheriff's Sale, and for foreclosure and sale of the property within
described.
