COMPLAINT
AND NOW, comes Financial Trust Company, through its attorney, William A. Duncan,
Esquire, and files this Complaint in Mortgage Foreclosure, of which the following is a statement:
I. Plaintiff is Financial Trust Company, a corporation organized and existing under the laws
of the Commonwealth of Pennsylvania with its main office and principal place of business located
at I West High Street, Carlisle, Cumberland County, Pennsylvania 17013.
2. Defendant, Rosario Cecco, an adult individual, and Defendant, Cynthia B. Cecco, an
adult individual, are husband and wife, and reside at I Stonehedge Way, Carlisle, Cumberland
County, Pennsylvania, 17013.
3. On or about November 16, 1994, Defendants made, executed and delivered to Plaintiff a
note and a real estate mortgage financing Seventy Thousand and 00/100 Dollars ($70,000,00), a
copy of said note and said real estate mortgage being attached hereto as Exhibits "A" and "B",
respectively, and are incorporated herein by reference as though fully set forth.
4. Said note and said real estate mortgage have not been assigned,
5, Rosario Cecco and Cynthia B. Cecco are the sole record owners in fee simple of said
premises subject to said mortgage, by virtue of a Deed dated November 16, 1994, and recorded in
the Cumberland County Recorder's Office in Deed Book "114", Page 1079, more specifically set
forth in Exhibit "C", attached hereto and made a part hereof by reference.

addItion, Grantor grants 10 Lender a Uniform Commercial Code security interest In the Personal Property and Rents.
DEFINITIONS. The lollowing words shall have Ihe following meanings when used in this Mortgage. Terms not olherwise defined In this Mortgege shall
have the meanings allribuled 10 such terms in the Uniform Commercial Code. All references 10 dollar amounts shall mean amounts in lawful money of
the Unlled Stetos of America.
Granlor. The word 'Grenlor" meens Rosario Cecco and Cynlhla B. Cecco. The Grantor is Ihe mortgagor under Ihis Mortgage,
Guarantor. The word "Guarantor" means and Includes without limitalion each and all of the guarantors. sureties. and accommodation parties in
connection with the Indebtedness.
Improvements. The word 1mprovements" means and includes without limitation all existing and future Improvements. fixtures. buildings,
slructures, mobile homes affixed on the Real Property,lecililies, additions, replacements end olher construction on the Real Property.
Indebledness. The word 'ndebtedness' means all principal and Inlerest peyable under the Note and any emounts expended or edvanced by
lender 10 discharge obligations 01 Grantor or expenses incurred by lender 10 enforce obligalions 01 Grantor under this Mortgage. together with
interesl on such amounts as provided in this Mortgage.
Lender. The word "lender" means Farmers Trusl Company. its successors and assigns. The lender is the mortgagee under thIs Mor1gage.
Morlgage. The word "Mortgege' means Ihis Purchase Money Mortgage bttween Grantor and Lender, and includes wilhout Iimilalion all
assignments and security interest provisions retaling 10 the Personal Property and Rents.

Nole. The word "Note" means the promissory note or credil agreement dated November 16, 1994, In the original principal amount of
$70,000,00 from Granlor to Lender, together wilh all renewals aI, exlensions 01, modifications 01, refinancings of, consolidalions 01, and
subslilulions for the promissory note or agreement.
Personal Property. The words 'Personal Property" meen all equipmenl, fixtures, and other erticles of personal property now or hereafter owned
by Granlor, and now or hereafter ellached or affixed 10 the Real Property; logether wrlh all accessions, parts, end addiUons to, ell replacemenls aI,
and all substitutions for, any of such property; and logether with all proceeds (including wilhoullimllallon all Insurance proceeds and relunds of
