5, Counsel for Petitioner confirmed with the United States Postal Office at
Carlisle, Pennsylvania that the references to the fact that the Respondent was notified of

the certified mail through her post office box: is confirmation that the Respondent
continues to maintain the aforesaid post office box at Carlisle,
6. Upon confirmation by counsel for Petitioner, a representative of the United
States Post Office at Carlisle, Pennsylvania confirmed that if the address used for the
Respondent was not correct the mail would have been returned with a designation
reflecting the fact that the address was incorrect.
7, Following the return of the certified mail referenced above as unclaimed,
counsel for Petitioner wrote on two separate occasions to the Respondent asking for her
cooperation relative to the finalization of the divorce and that mail was not returned but
rather was delivered to and remained with the Respondent by forwarding it through the
aforementioned post office box in Carlisle,
8, Counsel for Petitioner has reviewed the records at the Cumberland County
Voter Registration Office, the Cumberland County Occupational Assessment Office, and
the Cumberland County Real Estate Assessment Office and determined that the
aforementioned Respondent is not listed at any of those offices and, therefore, no
additional address could be secured,
9, Petitioner is incarcerated at the State Correctional Institute at Waymart and, as
such, has been unable to secure or maintain any type of contact with any of the relatives of
the Respondent.

10, Neither Petitioner nor his counsel have any other means of locating the precise

residence address of the Respondent nor any other mcans of securing service upon the

11, Petitioner has been incarcerated in the state prison system since May 1990
while the parties were married on May 10, 1993; thus the parties have remained separate

L Plaintiff is 10hn Ernest Toineeta, an adult individual currently residing at Rockview
State Prison, Bd-2237, Bellefonte, Centre County, Pennsylvania,
2, Defendant is Margarita Eva Toineeta, an adult individual whose current address is
P,O, Box 672, Carlisle, Cumberland County, Pennsylvania but whose specific residence
address is not known to the Plaintiff although it is believed to be in Cumberland County
and it is believed that the Defendant has resided in Cumberland County for in excess of six
months,
3, Plaintiff and Defendant are bonafide residents of the Commonwealth of
Pennsylvania and have been so for at least six months immediately previous to the filing of
this Complaint.
4, Plaintiff and Defendant were married on May 10, 1993, in Centre County,
Pennsylvania,
5, There have been no prior actions for divorce or annulment between the parties.
