Mother will do whatever is reasonably neeessary to ensure thutthe visitation periods described herein take place to promote the positive relationship between Father and the minor child; WIIEREAS, the parties wish to speeify the respective rights and obligations of each other with respect to the eustody of the minor child and to promote the best interest of the minor child; NOW TIIEREFORE, the parties intending to be legally bound, do agree as follows: A. Leeal Custody. The parties agree to share legal custody as thattenn is defined in the Custody Act 1985, October 30,1'.L. 264, No. 66, Section 1.23 Pa.C.S.A, 53011:1IDJ,. 8. Primary Physical Custody. Primary physical custody of the minor child, as thattenn is defined in the Custody Act 1985, October 30, I',L. 264. No 66, Section 1,23 Pa.C.S.A. 53011:1 Sl:ll., is confinned in Mother. Father shall enjoy periods of partial physical custody according to the following schedule, I, Fall Visitation: During the third week of October. Father will travel to Tennessee to visit with the minor child. This is to begin immediately after school on Friday and continue until Sunday at 6:00 p.m. The pick up point will be the minor child's school. The drop ofTpoint will be Mother's residence. 2. Christmas Vacation: During odd numbered years, Father shall enjoy the entire Christmas vacation with the minor child. In even numbered years, the minor child will spend Christmas Day with Mother and Father shall enjoy the remainder oflhe Christmas vacation with the minor child, beginning the day after Christmas, Mother will provide transportation to Father's home. The parties will share transportation tiJr the return. 3. Sprin~ Visitation: During the second week in March. Father will travel to right to (a) seek relief through any appropriate Domestie Relations olliee. (b) suspend all visitation periods between Father and minor ehild. and (e) seek a contempt ruling against Father lilr violatiun of this agreement lInd subsequent Court Order. E. Medieallnsurance. Mother shall provide medical insurance for the minor ehild. An 80-20 insurunce plan is required, Any unrcimbursed medical expenses shall be divided equally between the purties. Copies of all receipts and/or bills are mandatory to trigger Father's obligation to pay. F. School Reports. Mother shall provide copics of all rcport cards and cach ycar's school calcndar to Father, Mother agrces to keep father updated on all school and extracurricular activities in which the minor child participates. G. Contact Information. Each party shall keep the other apprised ofthcir current addresses and phone numbers. H. Applicable Law and ,Jurisdiction. It is the intention of the parties that Pennsylvania law govern and Pennsylvania courts retain jurisdiction of this custody action. I. Input of Minor Child. At any time aner the minor child reaches the age of thirteen (13), she may decide with whom she would like to reside. J. Modification.
