AND NOW, this ,2'1-tl, day of January. 1997. comes the Plaintiff. Adams County
National Bank. by its attorneys. Bigham & Puhl. who brings this action in mortgage
foreclosure against David M, Eichelberger and Susan S. Eichelberger, Defendants. whereof
the following is a statement:
1. The Plaintiff is Adams County National Bank. Mortgagee. a national banking
corporation organized and existing under the laws of Congress relating to national banks.
with its main office at 675 Old Harrisburg Road. Cumberland Township. Adams County.
Gellysburg. Pennsylvania 17325.
2. The Defendants are David M. Eichelberger and Susan S. Eichelberger. they are
adult individuals, who reside at 455 Lake Meade Drive. East Berlin. York County.
Pennsylvania 17316.
3, Defendants are not in the military or naval service of the United States or iL~ allies
within the provisions of the Soldiers' and Sailors' Civil Relief Act of the Congress of 1940
and its amendments.
4. On December 19. 1986. the Defendants executed and delivered a mortgage upon
real estate hereinafter described to Plaintiff as Mortgagee. which mortgage is recorded in the

office of the Recorder of Deeds of Cumberland County, Pennsylvania, in Mongage Book 846
at page 162, a copy of said mongage bcing attached hereto and marked Exhibit A.
5. Said mongage has not been assigned.
6, The description of the real estate is as described as follows:
AU that certain tract of land situate in the Borough of New Cumberland, Cumberland
County, Pennsylvania, bounded and describcd as follows:
BEGINNING at the southeast comer of Third Street and a 16 feet wide
alley; thence in an easterly direction along the southern line of Third Street 40
feet, 7 \ol inches to a point; thence in a southerly direction 100 feet; thence in a
westerly direction 40 feet, 7 \ol inches to a 16 feet alley; and thence in a northerly
direction 100 feet to the point and place of BEGINNING.
CONTAINING 40 feet, 7 \ol inches on Third Street and extending back an
even width of 100 feet.
Being improved with a frame store and apartment building known as No,
210-212 Third Street, New Cumberland, Pennsylvania, together with a brick
warehouse.
BEING the same tract of land which Robert L, Wetzel and F, Marie Wetzel, his wife,
and Dale E, Wetzel and Jean L, Wet7.cI, his wife. hy deed dated December 19, 1986, and
recorded in the office of the Recorder of Dceds of Cumbcrland County, Pennsylvania, in
Deed Book J, Volume 32, at page 1048, granted and conveyed unto David Eichelberger and
Susan Eichclberger, his wifc, the Dcfendanl~ herein,
7. The said mortgage is in default in that the monthly payment of principal and
interest amounting to $1,640.00, which has become due and payable on October 5, 1996. and
the monthly payments of principal and interest amounting to $1,745,00 each, which have
become due and payable on November 5, 1996, and on the 5th day of every month thereafter
have not becn made, and by the tenns of said mortgage upon default in such monthly
payments for a space of 5 days after any such payment is due, the whole of the said mortgage
debt and interest shall, at the option of the Plaintiff, become due and payable forthwith.

8. The present owners of the real estate arc David M, Eichelberger and Susan S.
Eichelberger, the Defendants herein.
9. The amount due the mortgagee on the mortgage is computed as follows:
(a) Balance of principal $143,029.17
(b) Interest from Sept. 6,
1996, to January 23, 1997 4.786.86
(e) Late charges 105.00
(d) Attorney's commissions 7,390 80
TOTAL $J55,3II.83
10. In accordance with provisions of Act 6 of 1974, Plaintiff has sent to Defendanl~
Notices of Intention to Foreclose prior to the commencement of the within proceedings.
Copies of said Notices and mailing rcceipl~ are attached hereto and marked Exhibits B
through G, respectively.
WHEREFORE, Plaintiff demands judgment against the Defendants, David M.
Eichelberger and Susan S. Eichelberger, in the sum of $155,311.83, plus interest from
January 24.1997. at a per diem of $35.07. any additional late charges and costs of suit.
