AND NOW, this J'1{/, day of January, 1997, comes thc Plaintiff, Adams County
National Bank, by its attorneys, Bigham & Puhl, who brings this action in mortgagc
foreclosure against David M. Eichelbcrger and Susan S. Eichclberger, Dcfendants, whereof
thc following is a statement:
1. The Plaintiffis Adams County National Bank, MOI1gagce, a national banking
corporation organized and cxisting undcr thc laws of Congrcss rclating to national banks,
with its main officc at 675 Old Harrisburg Road, Cumbcrland Township, Adams County,
Gettysburg, Pennsylvania 17325.
2. Thc Defendants are David M. Eichclberger and Susan S. Eichelhcrger, thcy arc
adult individuals, who reside at 455 Lake Meadc Drivc, East Berlin, York County,
Pennsylvania 17316.
3. Dcfendants arc not in thc military or naval scrvicc of thc United StaleS or iL~ allies
within thc provisions of thc Soldicrs' and Sailors' Civil Relicf Act of thc Congress of 1940
and its amendments.
4. On March 6, 1992, thc Defcndants exccuted and delivered a mortgagc upon real
estate hereinafter dcscribed to Plaintiff as Mortgagee, which mOI1gage is recorded in thc

officc of thc Rccon!er of Deeds of Cumbcrland County, Pcnnsylvania, in Mortgagc Book
1051 at page 922, a copy of said rnortgagc bcing attachcd hcreto and marked Exhibit A.
5. Said mortgagc has not bcen assigned.
6. Thc description of thc real estate is as dcscribcd as follows:
ALL that ccrtain lot of ground with thc improvcmenL~ thcrcon crected located in the
Founh Wan! of thc Borough of Carlislc, Cumberland County, Pennsylvania, boundcd and
described as follows:
On thc Nonh by property formerly of S. M. Rci17.cIl, later of John Kitncr
and now or formcrly of Andrcw Brooks; on thc East by a 60 fect widc NOnh Pitt
Street; on the South by propcrty formcrly of Samuel Sunday and now or formcrly
of Guy Provazzo; and on the Wcst by Bretz Allcy;
CONTAINING in front along thc Wcstern line of 60 feet wide NOnh Pill
Strect a distance of 30 feet and extending Westerly therefrom to said Bretz AlIcy,
a distance of 120 feet, morc or Icss.
The above described tract of land is improved with a double brick
dwelling house known as and numbered 152, 152Yz and 154 Nonh Pill Street, and
a brick building on the rear of said tract of land known as I Bretz Avcnuc.
BEING the same tract ofland which Brian G. Wolf and Barbara A. Wolf, husband
and wife, by deed dated Mareh 6, 1992, and rccon!ed in the office of the Rccon!er of Deeds
ofCumhcrland County, Pennsylvania, in Deed Book N, Volumc 35, at pagc 1012, grantcd
and conveyed unto David M. Eichelbergcr and Susan S. Eichelberger, husband and wife, thc
Defendants hcrcin.
ALL that certain lot of ground with the improvements thereon erected, situate in the
Borough of Mcchanicsburg, Cumberland County, Pennsylvania, boundcd and describcd as
follows:
BEGINNING at a point at the Nonhwest comer of NOnh Markct Street
and West Factory Street; thencc along said West Factory Street, South 81 dcgrccs
45 minutes West 268.5 feet to a point on thc Eastern line of Railroad Avenuc;
thencc along said Railroad Avcnuc, Nonh 12 dcgrees 5 minutes Wcst25 feet to a
post; thcnce along lands now or formerly or Gary P. Turpcning, Nonh 82 degrees
30 minutes East 125.45 feet to a point; thence by Lot No.2 on thc plan of lots
hcreinafter mentioned, South 12 degrccs 5 minutcs East 1.36 feet to a point;
thence funher by said Lot No.2, North 77 dcgrees 55 minutes East 17 feet to a
point; thcncc funher by lands now or late of said Gary P. Turpcning and through
a pany wall, Nonh 77 degrees 55 minutes East 26.3 fectto a point on the Western
line of said Nonh Markct Strect; thencc along thc Wcstlinc of said Nonh Markct

Street, South 12 degrces 5 minutes East 25 feet to thc point and placc of
BEGINNING.
HA VING thcreon erected a two-story framc dwclling housc known and
numbered as 301 Nonh Market Street.
BEING thc samc tract of land which Charlcs H. Eichclbcrger and Evelyn G.
Eichelbergcr, his wife, by deed dated Junc 13, 1983, and rccorded in thc officc of thc
Recordcr of Deeds of Cumbcrland County, Pennsylvania, in Deed Book F, Volumc 30, at
pagc 835, granted and conveyed unto David M. Eichelbcrger and Susan S. Eichclhcrgcr, his
wife, the Defcndants hercin.
7. The said mortgage is in dcfault in that the monthly paymcnt of principal and
intercst amounting to $514.67, which has becomc duc and payablc on Octohcr 6, 1996, and
the monthly payments of principal and interest amounting to $898.55 each, which have
become due and payable on Novembcr 6, 1996, and on thc 6th day of cvcry month thcreafter
have not been madc, and by thc terms of said mortgagc upon default in such monthly
payments for a space of 5 days after any such payment is duc, thc whole of the said rnortgagc
debt and intercst shall, atthc option of thc Plaintiff, beeome duc and payable fonhwith.
8. The prcsent owncrs of the real estate arc David M. Eichelbergcr and Susan S.
Eichelbergcr, the Defendants hcrein.
9. The amount duc thc mortgagcc on the mortgage is computed as follows:
(a) Balance of principal $79,677.07
(b) Intercst from Sept. 7,
1996. to January 23, 1997 1,945.42
(c) Attorncy's commissions 4.081 12
TOTAL $85,703.61

10. In accordance with provisions of Act6 of 1974, Plaintiff has sent to Defcndants
Notices of Intention to Foreelosc prior to thc commcncemcnt of thc within proccedings.
