5. The payment obligations of the Defendants are secured
by a mortgage on the Premises also dated May 4, 1993 (the
"Mortgage"), made, executed and delivered by Defendants, as
Mortgagors, to Dauphin Deposit Bank and Trust Company, as
Mortgagee, which mortgage was duly recorded on May 11, 1993, in
the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Mortgage Book 1133, page 262. A true and
correct copy of the Mortgage is attached hereto, made a part
hereof and marked Exhibit B.
6. The failure of the Defendants, among other things, to
pay when due and payable the payments under the Suretyship
constitutes a default under the terms of the Mortgage.
7. The Defendants have failed and refused, among other
things, to make payments due and payable under the Suretyship.
8. The Premises subject to the lien of the Mortgage are
described in Exhibit B.
9. The terms of the Suretyship provide that upon the
occurrence of a default by the Defendants, the Plaintiff may
accelerate and demand immediate payment of all sums due under the
Suretyship.
10. The sum presently due and payable to Plaintiff by
Defendants are computed as follows:
a. Unpaid Principal
b. Unpaid Interest to 1/31/97
c. Attorney's fees @ 15%
