4. Friedman and Clark are each the owners of an undivided

5. This Court has exclusive venue over this matter pursuant
to Pa.R.C.P. No. 1552.
6. The Property is subject to two (2) mortgages held by
Pennsylvania National Bank and Trust Company: one dated June 11,
1992 in the original principal amount of $202,300.00, recorded in
the Office of the Recorder of Deeds in and for Cumberland County
in Mortgage Book 1073, Page 435, and the other dated April 22,
1994 relating to a credit line with a credit limit of $50,000.00,
recorded in said Recorder's Office in Mortgage Book 1215, Page
449.

now JUDY L. PATURZO by virtue of her marriage to Pete A. Paturzo,
Jr., together the "Grantor" herein (such term to include the

BEING the same premises that Susquehanna Enterprises,
Inc., by its deed dated August 1, 19B3, and recorded in
Deed Book H-30, Page 95B, in the Recorder of Deeds'
Office of Cumberland County, Pennsylvania, granted and
conveyed in fee unto Pete A. Paturzo, Jr. and Judy L.
Laverty, the Grantor herein.
This conveyance is made and accepted and said realty is
hereby granted, conveyed and assigned upon and subject
to the protective covenants, conditions, restrictions,
reservations and limitations set forth in an instrument
entitled "Protective Covenants for Susquehanna Hills
Section No. B", dated the 2nd day of June, 197B,
executed by Susquehanna Enterprises, Inc., and recorded
in the Office of the Recorder of Deeds of Cumberland
County, Pennsylvania, in Miscellaneous Book Volume 235,
Page 815.
TOGETHER with, all and singular, the buildings and structures
thereon, and the improvements, ways, streets, alleys, passages,
waters, water-courses, rights, liberties, privileges,
hereditaments and appurtenances, whatsoever unto the hereby
granted premises belonging, or in any wise appertaining, and the
reversions, remainders, rents, issues and profits thereof; and all
of the estate, right, title, interest, property, claim and demand
whatsoever of the Grantor, at law and in equity, of, in and to the
same.
TO HAVE AND TO HOLD the said land and real estate, with the
messuage or tenements thereon, and the hereditaments and premises
hereby granted, or mentioned and intended so to be, with the
appurtenances, unto the Grantees, their heirs and assigns, to and

AND NOW, comes the Defendant, Keith A. Clark, by his
attorneys Saidis, Guido, Shuff & Masland and answers and
counterclaims as follows:

mortgages are attached hereto, made a part hereof and marked
Exhibits "A" and "B".

9. It is admitted that the Defendant is presently in
possession of the Property and has been since December 2, 1996.
By way of further answer, Plaintiff left the Property voluntarily
and has chosen not to return.
10. It is admitted that no partition or division of the
property has ever been made. By way of further answer, Defendant

has made good faith efforts to resolve the parties' differences
including securing a mortgage to refinance the existing
obligations which required settlement on or before January 7,
1997.
Plaintiff refused to cooperate, thereby causing the
Defendant to lose the mortgage and incur expenses.
11. After reasonable investigation, Defendant is without
knowledge or information sufficient to form a belief as to the
truth of said averment.
WHEREFORE, Defendant prays Your Honorable Court to enter an
Order directing partition, schedule a preliminary conference
pursuant to Pa. R.C.P. 1558 and appoint a Master to hear the
matter including Defendant.s Counterclaim.
COUNTERCLAIM
12. The averments of paragraphs 1 through 11 are hereby
incorporated by reference.
13, The mortgage dated June 11, 1992 which is attached
hereto and marked Exhibit "A" provides Plaintiff and Defendant
are jointly and severally liable for the payments required by
said mortgage together with all taxes, assessments, charges,
insurance, fines and impositions attributable to the Property.
14. Since the date of acquisition of the Property,
Defendant has paid all insurance premiums, real estate taxes, all
municipal, sewer and trash bills, all repairs and maintenance.
15. Since the date of acquisition of the Property,
Defendant has paid all mortgage payments except for Plaintiff's
contribution as provided in paragraphs 19 and 20.

REPLY TO COUNTERCLAIM
AND NOW, comes the Plaintiff, SANDRA HAFER FRIEDMAN, by her
attorneys, Sne1baker, Brenneman & Spare, P.C., and responds to
Defendant's Counterclaim as follows:
12. The averments contained in Paragraphs 1 through 11 of
the Plaintiff's Complaint are restated herein in response to
Defendant's attempt to plead in his Counterclaim the affirmative
responses in his Answer by general incorporation by reference.
More specific responses follow:
(a) In response to the averment in Paragraph 9 of
the Counterclaim concerning Plaintiff's alleged
voluntary removal from the Property, it is specifically
denied that said removal was voluntary. On the
contrary, it is averred that Plaintiff was forced to
leave the Property as the result of Defendant's
obnoxious conduct toward Plaintiff making her continued
presence intolerable and life burdensome.
(b) In response to the averments in Paragraph 10

relating to Defendant's alleged efforts to settle the
controversy and Plaintiff's alleged refusal to
cooperate, Plaintiff responds as follows:

personal obligations, which amount she is prepared to pay from
the proceeds of the sale of the Property in the course of the
partition of the Property.
(b) It is admitted that $25,000 of the line of credit
obligation was used to purchase the automobile mentioned in
paragraph 17(b), but it is denied that Plaintiff is obligated for
the payment of said amount. On the contrary, the $25,000 was
expended at Defendant's urging to fund the purchase of a new
automobile as a gift to Plaintiff in appreciation for her care to
Defendant during his long term convalescence and rehabilitation
from injuries sustained in an accident and coincident with his
purchase of a similar new automobile for himself, funded by the
proceeds of a monetary settlement for damages arising from said
accident.
18. It is admitted that "approximately $6,000" was expended
to construct a study. By way of further response, it is averred
that the study was for Defendant's exclusive benefit and after
his substantial urging.
19. After reasonable investigation, Plaintiff is without
knowledge or information sufficient to form a belief as to the
truth of the averment that the allegations in paragraph 19 were
"in the alternative" to some other matter; therefore, said
averment is deemed to be denied pursuant to Pa.R.C.P. 1029(c) and
strict proof thereof is demanded at the trial of the case, if
relevant. It is admitted that Plaintiff originally agreed to
contribute $510 per month toward the mortgage obligation in lieu

of rent during the time the parties were adjusting to their new
residence and itG attendant obligations.
20. It is admitted that Plaintiff ceased making the monthly
payments as alleged. It is denied that Plaintiff "failed" to
make such payments. On the contrary, it is averred that her
cessation of payments arose when other and unforeseen financial
obligations arose and upon Defendant's voluntary consent to make
all mortgage payments individually, excusing and releasing
Plaintiff from further obligation to make such payments.
21. The averments in paragraph 21 are denied. On the
contrary, it is averred that Defendant voluntarily and willingly
excused Plaintiff from making further monthly contributions to
the mortgage as further averred in paragraph 20 hereinabove and
in New Matter below, all of which averments are incorporated
herein by reference thereto.
22. The contents of paragraph 22 are conclusions of law to
which no response is required; therefore, all such statements are
deemed to be denied pursuant to Pa.R.C.P. 1029{d). In the event
any such statements are determined to be factual, they are denied
for all of the reasons set forth hereinabove and in New Matter
below.

which no response is required; therefore, all such statements are
deemed to be denied pursuant to Pa.R.C.P. 1029(d).
NEW MATTER
The following averments are made by way of further answer

and defense to Defendant's Counterclaim:
24. On or about May 1, 1989, the parties commenced to
cohabit and established a home as though married.
25. Throughout their relationship and cohabitation,
Plaintiff served frequently as hostess for Defendant's business
entertainment, provided cordial and gracious companionship for
Defendant's need to attain social stature for business
enhancement, and provided Defendant's requirements to have a
seemingly traditional spousal relationship without benefit of
marriage.
26. Plaintiff's performance of the matters averred in
paragraph 25 above were so acceptable to Defendant that he
frequently represented Plaintiff as his wife.
27. On or about February 13, 1991, Defendant was seriously
injured in a motor vehicle accident, requiring hospitalization
with extensive treatment, convalescence and rehabilitation.
28. During Defendant's confinement resulting from said
accident, Plaintiff provided personal care to Defendant on a
continuous and daily basis, both in the hospital and at home,
including such matters as bathing, emptying waste containers and
disposing of contents, chauffeuring, providing psychological
encouragement, massaging muscular cramps, etc.
29. During frequent periods of Defendant's depression,
Plaintiff ministered to Defendant's needs, made excuses for his
non-appearances and otherwise protected Defendant from the
potentially damaging effects to his professional standing

resulting from the debilitating nature of his condition.
30. Defendant received a substantial monetary settlement as
the result of the accident mentioned in paragraph 27 above, which
he used to purchase a new Mercedes automobile for himself.
31. Because of appreciation for Plaintiff's loyalty and
dutiful services as aforesaid, Defendant insisted that Plaintiff
should also have a new Mercedes automobile, that the source of
funds would be the line of credit loan secured by the second
mortgage on the Property and that he would pay the mortgage
payments attributable to the $25,000 borrowed to acquire
Plaintiff's vehicle. Defendant made a gift of the new automobile
to Defendant and agreed to pay the cost thereof through the
liquidation of the loan as aforesaid.
32. On or about January, 1990, Plaintiff encountered an
unforeseen and substantial financial obligation resulting from a
child support duty to her teenage son.
33. As the result of the obligation described in paragraph
32 above, plaintiff explained her financial problem to Defendant
and her inability to continue her previous monthly contributions
toward the mortgage obligation on the property.
34. At the time of the events mentioned in paragraphs 32
and 33 above, the obligations in maintaining the Property had
become stabilized, and Defendant acknowledged his ability to
service the mortgage debt without Plaintiff's monetary
contribution and voluntarily agreed to do so and in fact
undertook voluntarily and willingly to pay the debt service.
