NOTICE OF AVAILABILITY OF COUNSELING
TO THE WITHIN-NAMED DEFENDANT:
You have been named as the Defendant in a Complaint in a divorce proceeding filed in
the Court of Common Pleas of Cumberland County. This notice is to advise you that in
accordance with Section 3302(d) of the Divorce Code, you may request that the court
require you and your spouse to attend marriage counseling prior to a divorce being handed
down by the court. A list of professional marriage counselors is available at the Domestic
Relations Office, 13 North Hanover Street, Carlisle, Pennsylvania, You are advised that this
list is kept as a convenience to you and you are not bound to choose a counselor from this
list. All necessary arrangements and the cost of counseling sessions are to be borne by you
and your spouse,
If you desire to pursue counseling, you must make your request for counseling within
twenty days of the date on which you receive this notice, Failure to do so will constitute a
waiver of your right to request counseling.

AND NOW comes the above-named Plaintiff, SUSAN E, LEHMER, by her attorney,
Samuel L Andes, and makes the following Complaint in Divorce:
1, The Plaintiff is SUSAN E, LEHMER, an adult individual who temporarily resides in
Dauphin County, Pennsylvania, but whose legal residence is still 812 North Market Street,
Mechanicsburg, Cumberland County, Pennsylvania,
2, The Defendant is THOMAS D, LEHMER, an adult individual who currently resides
at 812 North Market Street, Mechanicsburg, Cumberland County, Pennsylvania,
3, Both the Plaintiff and Defendant have been bona fide residents of the Common-
wealth of Pennsylvania for at least six months immediately previous to the filing of this
Complaint,
4. The Plaintiff and Defendant were married on 22 June 1985 in Shiremanstown,
Pennsylvania,
5, There have been no prior actions of divorce or annulment between the parties,
6, This marriage is irretrievably broken,
7, Plaintiff has been advised of the availability of marriage counseling and the
Plaintiff may have the right to request that the Court require the parties to participate in
counseling,

COUNT I
8, The Plaintiff requests this Court to enter a Decree of Divorce,
WHEREFORE, Plaintiff requests this Court to enter a decree in divorce pursuant to
the Divorce Code of Pennsylvania,
COUNT II . EQUITABLE DISTRIBUTION
9, During the course of the marriage, the parties have acquired numerous items of
property, both real and personal, which are held in joint names and in the individual names
of each of the parties hereto,
WHEREFORE, Plaintiff prays this Honorable Court, after requiring full disclosure by
the Defendant, to equitably divide the property, both real and personal, owned by the
parties hereto as marital property,
COUNT III . ALIMONY
10, Plaintiff lacks sufficient property to provide for her reasonable needs in
accordance with the standard of living of the parties established during the marriage,
11, Plaintiff is unable to support herself in accordance with the standard of living of
the parties established during the marriage through appropriate employment,
12, The Defendant is employed and enjoys a substantial income from which he is
able to contribute to the support and maintenance of Plaintiff and to pay her alimony in
accordance with the Divorce Code of Pennsylvania,
WHEREFORE. Plaintiff prays this Honorable Court to enter an Order awarding Plain-
tiff from Defendant permanent alimony in such sums as are reasonable and adequate to
support and maintain Plaintiff in the station of life to which she has become accustomed
during the marriage,
COUNT IV . ALIMONY PENDENTE LITE
13, Plaintiff is without sufficient income to support and maintain herself during the
pendency of this action,
14, Defendant enjoys a substantial income and is well able to contribute to the

AND NOW, comes the Defendant, Thomas D, Lehmer, by and through his
attorney, Charles Rector, Esquire, and files the following Answer to Plaintiffs Complaint
for Divorce:

the parties and counsel having entered into an agreement and
stipulation resolving the economic issues on October 1, 1998,
the date set for a Master's hearing, the agreement and
stipulation having been transcribed and subsequently signed by
the parties and counsel, the appointment of the Master is
vacated, and counsel can conclude the proceedings by the filing
of a praecipe to transmit the record with the affidavits of
consent of the parties so that a final decree in divorce can be
entered.

The Master has been advised that after negotiations
this morning the parties have reached a settlement with respect
to the outstanding economic claims. An agreement is going to be
placed on the record in the presence of the parties. The
agreement as placed on the record will be considered the
substantive agreement of the parties, not subject to any changes
except for correction of typographical errors which may be made
during the transcription. That means that after you leave this
conference/hearing room today, after the statement of the
agreement has been placed on the record, that you will not be
able to make any substantive changes to the agreement. The
agreement will be submitted to you for review for correction of
typographical errors. After the errors, if any, are corrected,
we will ask that you affix your signatures by way of affirmation
of the terms of the settlement which is being reached at this
time.
After the agreement has been reviewed for
typographical errors and the signatures of the parties and
counsel have been affixed affirming the settlement terms, the
Master will prepare an order vacating his appointment and
counsel will then be able to prepare a praecipe transmitting the
record to the Court requesting a final decree in divorce.
It is assumed that during this process, that the
affidavits and waivers will be filed with the prothonotary so
that the Master can proceed with the vacation of his appointment
to allow the divorce to proceed to conclusion. Mr. Andes.
MR. ANDES: Mr. Elicker, the parties have agreed to
settle all of the economic issues in their divorce case on the
following terms:
1. The marital residence at 812 North Market Street,
Mechanicsburg, Pennsylvania, will be transferred to wife.
Husband will, within thirty (30) days of today, execute a
deed making that transfer and deliver that deed to his
attorney who will deliver it to wife's attorney or
anyone else designated by wife's attorney prior to the
time scheduled for a settlement on wife's refinancing as
described in this paragraph.
Wife will be obligated and shall refinance that
property and the debt against it and conclude the
settlement on that refinancing within ninety (90)
days of today's date. At that settlement she will pay
the balance owed on the existing mortgage against the
property so that the mortgage is satisfied and she will
pay husband $7,500.00 as part of the equitable
distribution of the marital assets in this case.
Husband waives any and all further interest in or claim
to the property and confirms it to be the sole and
separate property of wife subject to her obligation to
refinance the mortgage and make the payment provided for
in this paragraph.
Wife shall bear the costs of the refinance and until the
current mortgage is refinanced, wife shall continue to
assume full responsibility for all payments associated
with the marital home, including the home mortgage.
2. Husband shall release or transfer to wife any interest he
has or claim he has to the 1993 Dodge Caravan automobile
now being operated by wife, and that vehicle shall remain
the sole and separate property of wife hereafter.
Wife hereby releases any claim to and will transfer to
husband the 1990 Mazda Protege automobile which husband
now operates and that vehicle shall be the sole and
separate property of husband hereafter.
J. Husband has a pension, a 401(k) plan, both of which he
holds through his present employer, and an IRA account
with Members 1st Federal Credit Union. wife waives any
and all right to or claim in those assets and confirms
them to be the sole and separ~te property of husband
hereafter.
4. Wife hereby waives any claim to any bank accounts, credit
union accounts, or similar assets currently in husband's
name or possession, her share of the federal income tax
return for the tax year 1996, and three items of women's
jewelry, which are currently in husband's possession.
5. Husband hereby waives any claim to or interest in an IRA
account in wife's name with Members 1st Federal Credit
Union, any bank accounts, credit union accounts, or
similar assets now in wife's name or in her possession.
6. The parties acknowledge that they have previously
divided their household goods and tangible personal
property. Each party waives any claim to any of those
items now in the possession of the other and each party
shall, hereafter, be the sole and separate owner of all
such items now in their possession or control.
7. The parties in this action are parties to a support
action and alimony pendente lite order which is entered
before this court to No. 1128 Support 1996 (PACSES No.
658000028). The parties agree to modify the order
entered in that case on 13 July 1998 by removing the
spousal support provisions of that order.
Further, the parties agree that husband shall continue to
pay $692.00 per month for the two minor children in
wife's custody and shall otherwise be bound by the
terms and provisions of that order, as such order may be
modified at any time in the future.
The parties agree further that any credit shown on the
Domestic Relations Office records as of the 1st of
October of 1998 will be canceled and wife shall, within
five (5) days of today's date, notify the Domestic
Relations Office that she has withdrawn the appeal she
filed to the order of 13 July 1998. The changes to the
order, deleting the spousal support provisions, will be
effective this day, 1 October 1998.
8. Each of the parties waives any further claim to alimony,
spousal support, or alimony pendente lite, and any
frame limitation on that?
MR. RECTOR: Yes. I think on the record we can
reconfirm that your wife is required to refinance within ninety
(90) days of today's date and that that money will be received
by you on or before the 90th day following today's date.
MR. LEHMER: Is there any kind of action taken if
it's not?
MR. RECTOR: Let's go off the record.
(A discussion was held off the record.)
MR. RECTOR: Tom, we've discussed several questions
you had regarding the refinancing, are you satisfied with the
substance of that conversation?
MR. LEHMER: Yes.
MR. RECTOR: And the fact that you will receive
your money within the period of time that the property is
refinanced?
MR. LEHMER: Yes, I am.
MR. RECTOR: Do you agree with the agreement that
you've heard on the record?
MR. LEHMER: Yes, I do.
MR. RECTOR: I've been your attorney now for
several years, are you satisfied with my representation of you
in this case?
MR. LEHMER:
MR. RECTOR:
Yes, I am.
Are you satisfied with the settlement
reached in this case?
MR. LEHMER: Yes, I am.
MR. RECTOR: One last question, are you under the
influence of alcohol or any prescription drugs today such that
your ability to understand what you've heard dictated on the
record would in any way be compromised?
MR. LEHMER: No, I am not.
MR. ANDES: Ms. Lehmer, you've heard the agreement?
MS. LEHMER: Yes.
MR. ANDES: I explained to you beforehand that
whether we actually come back here or met somewhere else today
or tomorrow to sign the agreement, that when we sit in this room
and all of us say in front of the court reporter, that this is
the agreement we have reached, it is a final agreement, do you
understand that?
MS. LEHMER: I understand that completely.
MR. ANDES: And the only changes we can make to
this agreement hereafter, other than typographical corrections,
would be changes to which both you and your husband agree, you
understand that?
MS. LEHMER: Yes, I do.
MR. ANDES: I want to clarify one point for you.
Mr. Rector included language that said all ancillary or
connected claims and litigations were disposed of by this. That
does not include child support. We specifically carved the

1. ASSETS. Attached hereto and marked as Schedule A is a list of the marital

2. EXPERT WITNESSES. Plaintiff anticipates the parties will be able to agree
upon the valuation of most of the assets and that, therefore, expert testimony will not be
necessary. If the parties are not able to so agree, Plaintiff reserves the right to call a real

estate appraiser, an actuary or other qualified expert to appraise husband's pension, and a !
personal property appraiser to the extent their testimony may be necessary.

7. PENSION INFORMATION. Plaintiff has no interest in a pension plan which is
marital property. Defendant has an individual retirement account, which represents the
proceeds of a roll over from a prior pension in which he participated. That IRA can be
valued by inspection of a current statement showing its balance. Defendant also is a
participant In the Pennsylvania Blue Shield/Hlghmark pension plan. If the parties are not
able to stipulate as to the marital value of husband's benefits within that plan, Plaintiff will

8. COUNSEL FEES. Plaintiff has engaged Samuel L. Andes to represent her and
has agreed to pay him $150.00 per hour. At the hearing she will present a statement of

RE: Pre-Hearing Conference Memorandum

Present for the Plaintiff, Susan A. Lehmer, is
attorney Samuel L. Andes, and present for the Defendant, Thomas
E. Lehmer, is attorney Charles Rector
The parties were married on June 22, 1985, and
separated October 9, 1996. Counsel have indicated that the
parties will sign and file affidavits of consent and waivers of
notice of intention to request entry of divorce decree prior to
the hearing to be scheduled. The parties are the natural
parents of two children, Sirena M. Lehmer, born November 22,
1985, and Tyler D. Lehmer, born June 14, 1987. Counsel have
advised that Tyler has been diagnosed with Tourette's Syndrome
and is currently under treatment and medication for that
illness.
A divorce complaint was filed on February 5, 1997,
raising grounds for divorce of irretrievable breakdown of the
marriage and the economic claims of equitable distribution,
alimony, alimony pendente lite, and counsel fees and expenses.
Counsel have indicated that there may be some testimony on the
marital misconduct factor and counsel are going to attempt to
clarify the testimony between themselves as to what will be
offered and what witnesses are going to testify. Mr. Rector is
going to draft a summary of his witnesses's testimony and Mr.
Andes will review that summary with his client to determine if
perhaps they can limit the need to have a lot of testimony about
the issue.
Wife is 34 years of age and resides at 812 North
Market Street, Mechanicsburg, Pennsylvania, where she lives with
the two children. Wife is a high school graduate and works
presently for Phillips Office Company as a salesperson. She has
been employed in that position for one year and receives
$26,000.00 per year as a draw against commissions. Mr. Andes
indicated that according to his information that he has
available today, she is basically making enough money to pay the
draws that she has been receiving but that otherwise there have
been no substantial commission payments over and above what she
has received on the draw. The net income that she receives is
$744.95 biweekly. Mr. Andes is going to inquire of wife as to
the status of her health insurance. It appears that she is
paying some small amount each pay for Health America coverage
but Mr. Andes does not know the extent of that coverage. Wife
has not raised any health issues.
Husband is 37 years of age and resides at 1429
Apple Drive, Apartment 157, Mechanicsburg, Pennsylvania, where
he lives alone. He is a high school graduate and works for
Highmark, Inc., which formally was Blue Shield. He is in data
processing and has a gross monthly income of $4,098.33. He has
not raised any health issues.
The parties own real estate at 812 North Market
Street, Mechanicsburg, Pennsylvania, where wife is living with
the two children. On February 7, 1997, the parties executed a
postnuptial agreement which provided that the house was to be
listed for sale no later than February 1999. There is no
provision in the agreement, however, regarding any distribution
of proceeds that would be derived from that sale. Counsel
probably will be able to stipulate to the market value of the
house. Husband suggests a value of $128,000.00 and wife
suggests a value of $130,000.00. The house is subject to a
mortgage with Bank America and the payoff is around $68,000.00.
The mortgage payment which wife is making is $965.00 which
includes taxes and insurances. Wife has indicated that she
would like to remain in the house with the two children. There
has been some discussion as to whether or not, looking at the
assets available to distribute, that we can accomplish an
"equitable" distribution by giving wife the house without having
some cash pass to husband. Counsel are going to try to arrive
at some values for the other assets to see if an immediate
offset disposition is reasonable without having to sell the real
estate. Mr. Andes has suggested that one possibility is that
perhaps his client can refinance the mortgage.
Husband is currently paying child support in the
amount of $707.00 per month and spousal support in the amount of
$436.00 per month. With respect to wife's alimony claim, Mr.
Andes has proposed in his pre-trial statement that wife receive
the sum of $500.00 per month as indefinite alimony.
The parties owned two vehicles, a 1993 Dodge Grand
Caravan which is in wife's possession and which according to
husband's pre-trial statement has a net value of $10,625.00.
Mr. Andes indicates that the net value on the vehicle is
$8,000.00. Husband has in his possession a 1990 Mazda Protege
which husband suggests has a value of $2,800.00 and wife
suggests has a value of $5,000.00. The Dodge Caravan is subject
to a lien; the Mazda is free of any encumbrances.
Husband rolled over an IRA which is currently with
Member's 1st from his prior employment with CACI. As of
December 31, 1997, the IRA had a value of $9,057.00.
currently husband is involved in a 401(k) with his
employer and counsel have suggested that that has a value of
$7,847.00. Also husband is vested in a defined benefit plan
with his current employer. According to a statement which Mr.
Rector has provided, the value in that plan, as of October 15,
1996, was $4,968.47. Mr. Andes has questioned whether or not
that figure represents husband's contributions only or whether
that represents, in fact, an accurate present value of the plan.
Mr. Rector has provided Mr. Andes with some documentation.
Hopefully counsel will be able to determine the accuracy of the
evaluation provided by Highmark, Inc., without having to employ
the services of an actuary.
Husband has valued the household tangible personal
property in wife's possession at $12,325.00 and in his
possession at $270.00. No appraisals have been offered and
apparently wife has not yet determined the value of the property
which husband has already valued. In any event, Mr. Andes has
suggested that perhaps one way to resolve the case would be for
wife to turn over to husband the tangible personal property at
the value which husband has suggested.
The marital debt consists of the mortgage and the
lien against the Dodge Caravan.
Mr. Andes has also indicated on his pre-trial
statement that there are savings and checking accounts with
Member's 1st and he has placed a value on those accounts at
$5,000.00. Mr. Rector is going to talk to his client to see if
that information is accurate.
Mr. Rector has indicated that husband is seeking
credit on account of credit card debt which he paid subsequent
to the separation. Mr. Rector is going to provide the
information regarding that payment and the existence of the
debt. In addition, Mr. Rector has indicated that wife withdrew
$1,250.00 from an account in husband's name and his father's
name. Mr. Rector is going to also provide verification of that
withdrawal to Mr. Andes to determine if that money was actually
received by wife. There is a question as to how wife had access
to that account.
