COMPLAINT
1. Plaintiff is a Pennsylvania corporation having a
business address located at 1539 Bobali Drive, Harrisburg,
Pennsylvania 17104.
2. Plaintiff is in the business of providing pest
control and lawn services.
3. Defendant is an adult individual having a mailing
address of P.O. Box 548, Shippensburg, Pennsylvania and owning
property located at 123 Log Cabin Road, Shippensburg, Pennsylvania
(the "Property").
4. On or about May 8, 1996, Plaintiff received from
Defendant signed contracts requesting lawn services for the
Property.
Attached hereto as Exhibit "A" are copies of said
contracts (the "Contracts").
5. Pursuant to the Contracts, Plaintiff provided to
Defendant lawn care services for the property on or about Hay 10,
1996, Hay 22, 1996, June 20, 1996 and August 14, 1996, (the
"Services").
6. The Services provided by Plaintiff to Defendant had
a value of Eight Hundred Thirty-Eight Dollars and Seventy Cents
($838.70) including finance charges. Attached hereto as Exhibit
"B" is a copy of the invoice for the Services showing the costs of
the services performed.
7. Despi te numerous requests by Plaintiff, the
Defendant refused and continues to refuse to pay the amount due to
the Plaintiff pursuant to the Contract.
8. On or about January 6, 1997, a default judgment was
entered by District Justice Shulenberger against Defendant and in
favor of the Plaintiff in the amount of Nine Hundred Thirty-Nine
Dollars and Thirty cents ($939.30).
9. On or about February 5, 1997, Defendant filed an
Appeal of the default judgment and filed a Rule for Plaintiff to
file this Complaint.

AND NOW, comes the Defendant, Cheri Stauffer, by her allorney, BRUCE A.
GROVE, JR., and files the following Preliminary Objections to the Complaint of Plaintiff:
MOTION TO STRIKE
1. Pa. R.C.P, No. J021(c) requires that "in counties having rules governing
compulsory arbitration the Plaintiff shall state whether the amount claimed does or does not
exceed the jurisdictional amount requiring arbitration referral by local rule."
2. The amount of relief requested by the Plaintiff is $939.30 which is within the limit
requiring compulsory arbitration; the "WHEREFORE" clause to the contrary should,
therefore, be stricken as per the requirement of Pa. R.C,P. No. J021(c).
MOTION FOR MORE SPECIFIC COMPLAINT
3. The averments of Paragraphs 1 and 2 are incorporated by reference as if fully set
forth.
4. Pa. R.C.P. No. 1019(a) and (h) requires that the material facts on which a cause of
