During and following the procedure, Plaintiff began to experience severe pain and swelling in the areas around the surgical site, 6. The results of the pathology specimens taken at the time of the aforementioned procedure were analyzed at Harrisburg Hospital, on or about February 20, 1995; the results were read as "blood vessels with some surrounding adipose tissues and small bundles of nerve tissue... right and left vas deferens not identified." 7. On or about March 1, 1995, the results were transmitted to Plaintiff, Roger Hockenberry, by Defendant, Anastasius O. Peter, M,D., who also told Plaintiff that the surgery would need to be repeated, 8. On or about April 7, 1995, Plaintiff underwent the repeat procedure at POlyclinic Medical Center by a different Susquehanna Surgeons, Ltd. physician, Michael Page, M.D. 9. The pain and discomfort referred to in paragraph 5 never went away. Count I: Neelieence Plaintiff Roeer Hockenberrv v, Anastasius O. Peter. M,D. 10. Paragraphs 1 through 9 are incorporated herein by reference as if fully set forth. 11. In caring for Plaintiff, Roger Hockenberry, the Defendant, Anastasius O. Peter, M.D., was required to exercise the reasonable and ordinary care, skill and ability exercised by other members of his profession in the same or similar circumstances. 12, Defendant, Anastasius 0, Peter, M,D" in caring for Plaintiff, failed to exercise the reasonable and ordinary care, skill and ability exercised by other members of his profession in the same or similar circumstances in that he failed to properly perfonn the procedures in , , connection with Plaintiffs vasectomy; 13. As a direct and proximate result of the negligent care of Plaintiff by Defendant, Anastasius O. Peter, M,D., as described in detail above, Plaintiff, Roger Hockenberry, was caused to undergo an additional surgical procedure. 14, As a further direct and proximate result of the negligent care of Plaintiff by Defendant, Anastasius O. Peter, M.D., as described in detail above, Plaintiff, Roger Hockenberry, suffered damage to nerves and tissues in the area of the surgical site. IS. As a further direct and proximate result of the negligent care of Plaintiff by Defendant, Anastasius O. Peter, M,D" as described in detail above, Plaintiff, Roger Hockenberry, has been obligated to receive and undergo additional medical attention and care and to incur additional expenses may be obligated to continue to incur such expenses for an indefinite time in the future. 16, As a further direct and proximate result of the negligent care of Plaintiff by Defendant, Anastasius O. Peter, M.D., as described in detail above, Plaintiff, Roger Hockenberry, suffered physical pain and suffering and mental anguish and humiliation. 17. As a further direct and proximate result of the negligent care of Plaintiff by Defendant, Anastasius O. Peter, M.D., as described in detail above, Plaintiff, Roger Hockenberry, has suffered a loss of life's pleasures and in the future will continue to suffer a loss of life's pleasures, WHEREFORE, Plaintiff, Roger Hockenberry, demands judgment against Defendant, Anastasius 0, Peter, M,D" in an amount in excess of the compulsory arbitration limits, plus costs and interest as provided by law, Count II 18. Paragraphs 1 through 17 are incorporated herein by reference as if fully set forth. 19. Defendant, Anastasius O. Peter, M.D., owed Plaintiff, Roger Hockenberry, the duty to infonn him of all material facts necessary for him to make an infonned and intelligent consent to undergoing surgery, including any and all risks involved in surgery. 20. Defendant, failed to disclose to or discuss with Plaintiff, Roger Hockenberry, all of the facts, risks, and alternatives attendant to the surgery. 21. Plaintiff, Roger Hockenberry, consented to undergo the surgery on the advice, recommendations and infonnation provided by Defendant. 22. Consequently, when defendant, Anastasius O. Peter, M.D., perfonned the surgery, an assault and battery was committed upon the person of the Plaintiff, Roger Hockenberry . 23. As a direct and proximate result of the lack of infonned consent on the part of Defendant, Plaintiff, Roger Hockenberry, has sustained the injuries and damages alleged above. Roger Hockenberry, relied upon Defendant, Anastasius 0, Peter, M.D., as a physician and surgeon and with respect to the vasectomy on February 16, 1995 and matters related thereto. 4. Admitted. 5. Denied. To the best of Defendant's knowledge, Plaintitl's pain and swelling during and following the vasectomy of February 16. 1995 was normal and expected during the time that Plaintiff was a patient of Defendant. 6.
