strengthening to minimize his stiffness. we'll send him for a few sessions of

repair dangerous conditions existing on the property before possession is transferred to the
lessee, (5) if the lessor undertakes to repair the demised premises and negligently makes the
repairs or (6) if the lessor fails to make repairs aller having been given notice of and a reasonable
opportunity to remedy a dangerous condition existing on the leased premises," Hcnzc v Texaco,
J.nc., 352 Pa, Super, 538, 541-542, 508 A,2d 1200, 1203 {I 986),
In this case, a review of the facts demonstrates that Gertrude Bender was physically out
of possession of the premises at 213 Fourth Street. The evidence also indicates that Gertrude
Bender did not retain the right to control the sidewalk in fron1 of 213 Fourth Street where the
Plaintiff allegedly slipped and fell. To the contrary, the record demonstrates that Mrs, Bender's
sons were responsible for controlling and maintaining the sidewalk, Mrs, Bender's sons
controlled and possessed the buildings and slructures located at 213 Fourth Street and pursuant to
the tenns of an oral lease and understanding between the parties, Mrs, Bender's sons were
responsible for snow removal and maintenance of lhe sidewalks,
Additionally, none of the exceptions to the rule limiting the liability ofa landlord out of

such size and character as to unreasonably obslruct travel and constitute a danger
to pedestrians traveling thercon; (2) thaI the property owner had notice, either
actual or conslructive, oflhe exislence of such condition; (3) that it was the

IV. CONCI.(JSION
For the reasons set forth hereinabovc, and on Ihc basis of the authorily ciled herein it is

Plaintiff slipped. The awning was constructed and positioned in
such a fashion that it would direct runoff and melting ice and snow
directly onto the sidewalk, where it would freeze.
Generally icy conditions did not exist in the neighborhood at
the time of Plaintiff's accident. Weather records reflect that
there had been no precipitation for at least four days prior to
the date of Plaintiff's fall.
Although trace amounts of
precipitation did occur on the date of the accident, the weather
records reveal that such precipitation did not start until after
the time of Plaintiff's accident.
If the ice on which Plaintiff fell was the result of a natural
accumulation, Defendants had ample opportunity to correct the
dangerous condition, but failed to do so.
Defendants may posit that the ice was the result of a thawing
and refreezing process.
The weather records also reveal that,
prior to Plaintiff's accident, the only above-freezing temperatures
occurred on January 22, 1996.
Accordingly, even if the ice
resulted from thawing and refreezing, Defendants' failed to remove
it within a reasonable time period, and within the time frame
prescribed by the New Cumberland Borough ordinance provides:
The owner, occupant or tenant of every
property fronting upon or alongside of any of
the streets in the Borough of New Cumberland
is hereby required to remove or cause to be
remove from all of the sidewalk in front of or
alongside of such property all snow or ice

B. Does the Hills and Ridges Doctrine have any application
in the instant case, where the icy condition was created by an
artificial condition (an awning which directed runoff onto the
sidewalk), where there was no recent accumulation of any
precipitation, and where there were no generally icy conditions in
the area?
PROPOSED ANSWER: NO.
IV. DISCUSSION
A. Defendants breached their duty of care to Plaintift by
failing to remove ice from the sidewalk in front of their pr..ises
when the last accumulation of precipitation had occurred four days
prior to Plaintiff's accident, by violating a borough ordinance
requiring the removal of such ice within 10 hours after its
accumulation or formation, by maintaining an awning that directed
runoff onto the sidewalk where it would free.e and create a
dangerous condition.
Plaintiff's accident occurred on January 23, 1996. According
to witness Sue Welch, the accident took place after 10:00 a.m., but
before 11:30 a.m. According to climatological data from the U.S.
Department of Commerce, only trace amounts of precipitation fell on
January 23, 1996. That precipitation did not begin to fall until
12:50 p.m., after the time of Plaintiff's accident.
The same
records indicate that no DreciDitation had fallen since January 19,
1996, four days prior to the date of Plaintiff's accident. If, in
fact, the ice in front of Defendants' property was the result of a
natural accumulation, Defendants had at least four days to remove
same, but failed to do so. Not only is such a failure a violation
of the borough ordinance, which requires that any accumulation or

formation of ice or snow be removed within ten (10) hour. (or
before 10 a.m. if it occurs during the evening hours), but i. also
a breach of any "reasonable person" standard that might be applied.
The weather data also reflects that temperatures did not go
above the freezing point on January 23, 1996, prior to the time of
Plaintiff's accident. The last above-freezing temperature. were
between 12:50 p.m. and 2:50 p.m. on January 22, 1996.
Consequently, if the formation of ice was the result of thawing and
refreezing, Defendant's also failed to remove it within a timely
fashion or within the time period prescribed by the borough
ordinance.
Plaintiff submits that the most reasonable explanation for the
presence of the ice is that runoff directed onto the sidewalk from
Defendants' awning froze, creating a hazardous condition. Again,
pursuant to the climatological data, the last above-freezing
temperatures had occurred between 12:50 p.m. and 2:30 p.m. on
January 22, 1996. Given that daily temperatures reached 36
degrees on January 22, 1996, 30 degrees on January 21, 1996, 27
degrees on January 20, 1996 and 56 degrees on January 19, 1996, it
is most likely that the ice formed on the latter date and was left
untreated until the time of Plaintiff's fall.

The accumulation must be shown to have been of sufficient
size to constitute an unreasonable obstruction to travel:
Gerber v. pittsburah, 343 Pa. 379, 381; Beebe v.
philadelDhia, 312 Pa. 214, 216. The municipality must
have had actual notice or the dangerous accumulation must
have existed a sufficient length of time to charge it
with constructive notice: Gerber v. pittsburah, sUDra,

The doctrine of hills and ridges appears to have
emerged as an exception to the general rule of liability
as stated in ~, although at times it is difficult to
distinguish the exception from the rule. However. the

involved general icy conditions due to recent or

liability. (emphasis added). since it is virtuallY
impossible for a property OW'lP.r to keep his sidewalk
completely free of ice or snoW when general slippery
conditions exist, and since under these conditions a

pedestrian is better prepared to exercise a greater
degree of caution when traversing the ice or snow, courts
have been reluctant to permit recovery without a showing
of hills and ridges.
However, where a specific, localized, isolated patch
of ice exists, it is comparatively easy for a property
owner to take the necessary steps to alleviate the
condition, while at the same time considerably more
difficult for the pedestrian to avoid it even exercising
the utmost care. We therefore conclude that under the
facts and circumstances of this case, it was error for
the court below to require proof of hills and ridges.
Williams v. Shultz, 429 Pa. at 431-433.
In the Williams case, the plaintiff had slipped on a patch of
ice formed under some leaves, while the general locale was not
snowy or icy. It cannot be too strongly emphasized that requiring
proof of hills and ridges is error in such cases. That doctrine is
applicable 2DlY where there is proof that the hazard causing harm
is part of aenerallY slippery conditions caused by verv recent or
onaoina DreciDitation.
Even assuming, arauendo, that the ice on which Plaintiff
slipped was the result of a natural accumulation, the weather
records reflect that there had been no precipitation for at least
~ days prior to the time of Plaintiff's accident.
Such an
accumulation cannot be considered "recent" for the purposes of the
Hills and Ridges Doctrine. Furthermore, given the passage of time
since the last precipitation, generally icy conditions could not
have been present in the neighborhood where Plaintiff fell.

Accordingly, the Hills and Ridges Doctrine has no relevance to the
matter at hand.
Most importantly, ice on which Plaintiff slipped was most
likely created by an artificial condition in the form of an awning
which directed runoff, melting snow and melting ice directly onto
the sidewalk, where it would freeze. When an artificially created
defect permits ice to accumulate and causes a dangerous condition,
the Hills and Ridges Doctrine is inapplicable. Clavtor v. Durham,
273 Pa. Super. 571, 417 A.2d 1196, 1198 (1980). As explained by
the superior Court in Clavtor:
In Reedv v. Pittsburah, 363 Pa. 365, 69 A.2d
93 (1949), the plaintiff was injured when she
fell on a patch of ice concealed by a fresh
snowfall. The ice had formed because a
defective rainspout had permitted water to
accumulate on the sidewalk. The court held
that where the defect had existed for several
years, and the owner had had notice and failed
to correct the defect, there was sufficient
evidence to submit the issue of the owner's
negligence t the jury. In such a case, it was
not necessary for the plaintiff to show how
long the particular patch of ice had existed.
This concept was further clarified in Casev
v. Sinaer, 372 I?a. 284, 93 A.2d 470 (1953).
In that case, a depression in the sidewalk in
front of defendant's property had filled with
water which froze to form a patch of ice.
Plaintiff slipped and fell on the ice at a
time when it was covered with a layer of dust.
The Court concluded that the Reedv principle
was applicable. The custodian of the property
had known that a defect existed and failed to
correct it; he knew that water tended to
collect in the defect and could expect that

with them when he fell. All he remembers about the sidewalk in
front of 213 Fourth Street is taking a couple of steps and
falling. He testified that he "didn't pay attention" to whether
there was an accumulation of ice and snow on the sidewalk, After
he fell he says he took notice that the sidewalk "looked wet".
After he fell he says he noticed ice on the sidewalk which
appeared clear and smooth, not rough or lumpy.
Herweg was familiar with the area, living just a short
distance from the location of his fall. He will testify that he
frequently walked the same route to and from BrIdge Street and,
in fact, traversed over the same walkway just two days before,
without difficulty.
Sue Welch, who knew Herweg as a neighbor and was friendly
with him will testify that she was standing on the opposite side
of the street and witnessed the Plaintiff's fall. According to
her deposition testimony, she was speaking to Herweg from across
the street when he fell. She is also expected to testify that
she walked on the same sidewalk earlier in the day and there was
ice in spots, although she did not fall, nor did she see anyone
else fall or have difficulty walking on the sidewalk.
The Plaintiff sustained a chip fracture of his left wrist,
A short arm cast was applied for approximately two weeks. By
mid-February 1996 he had no tenderness and no pain with the

In order to recover for a fall on an ice or snow-covered
surface, therefore, a plaintiff is required to prove all of the
following:
(1) That snow and ice had accumulated on the sidewalk
in ridges or elevations of such size and character as to
unreasonably obstruct travel and constitute a danger to
pedestrians traveling thereon;
(2) That the property owner had notice, either actual
or constructive, of the existence of such condition;
(3) That it was the dangerous accumulation of snow and
ice which caused the plaintiff to fall.
Rinaldi v. Levine, 406 Pa. 74, 78, 176 A.2d 623, 625 (1962).
In the case at bar there is no dispute as to whether a
generallY slippery condition existed at the time of the
Plaintiff's fall. As previouSly indicated, there had been 38.9
inches of ice and snow precipitation accumulated. There was a
trace of freezing precipitation the date of the plaintiff's fall.
It is clear that generally slippery conditions existed over the
entire Harrisburg area at the time of the plaintiff's fall. The
Hills and Ridges doctrine has been held not to apply where there
is only a specific localized patch of ice. The Plaintiff will
not be able to prove the three elements of the Hills and Ridges

doctrine. There is no evidence of record that snow and ice had
accumulated on the sidewalk in question in ridges or elevations
of such size and character so as to unreasonably obstruct travel
and constitute a danger to pedestrians traveling thereon. The
Plaintiff himself is expected to offer testimony that he
frequently walked this sidewalk and, in fact, had traversed the
same sidewalk just two days previously without incident.
Moreover, Ms. Welch will testify that she traversed the sidewalk
in question without incident the very morning of the Plaintiff's
fall. Furthermore, Ms. Welch is expected to testify that at no
time had she seen any other pedestrians fall or have difficulty
walking along the sidewalk in question. Secondly, there is no
evidence that either of the Defendants had notice, either actual
or constructive to the existence of snow and ice accumulating in
ridges or elevations. The contrary, the Plaintiff himself has
testified that the ice and snow had not accumulated in ridges or
elevations but appeared to be wet and smooth. Thirdly, there is
no evidence that a dangerous accumulation of snow and ice
actually caused the Plaintiff to fall. To the contrary, it is
believed that the Arbitrators will hear evidence that the
Plaintiff was walking with a bag of donuts when he fell and not
paying attention to where he was walking.

6, The facts and occurrences hereinafter related took place
on or about January 23, 1996, on the sidewalk in front of Defendant
A & A Furniture and Liquidators's warehouse located at 213 Fourth
Street, New Cumberland,
7. At all relevant times, Defendants Charles J. Bender and
Gertrude Bender owned, controlled and possessed the buildings and
structures located at 213 Fourth Street, New Cumberland,
8. At all relevant times, Defendants Charles J. Bender,
Gertrude Bender, and A & A Furniture and Liquidators were
responsible for managing and maintaining the grounds and premises,
including but not limited to sidewalks and walkways located at 213
Fourth Street, New Cumberland, Cumberland County, Pennsylvania.
9. At that time and place, Plaintiff Randy Herweg was
walking on the sidewalk, heading toward his home when he slipped
and fell on ice that had formed and/or accumulated on the sidewalk
of Defendants's property.
10. Although no significant snow-fall or icy precipitation
had occurred in at least a week prior to I?laintiff's accident, the
sidewalk of the premises owned by Defendants Charles J. Bender,
Gertrude Bender and A & A Furniture and Liquidators had not been
adequately cleared of ice hazards, nor had it been adequately
maintained to prevent foreseeable ice hazards.

17. Defendants had sufficient time prior to I?laintiff's
accident to have taken measures to protect against the dangerous
condition that existed on the walkway of the Defendants' premises
as aforesaid, and prevent the injuries suffered by Plaintiff
herein, but Defendants failed to do so in any fashion or provide
any warnings as to the hazardous and icy conditions, which were
invisible to pedestrians and other lawful users of Defendant's
premise, such as was Plaintiff at the time of her accident.
18. As a direct and proximate result of the accident and
aforesaid injuries, I?laintiff Randy Herweg was forced to incur
medical expenses in an effort to restore himself to health, and
because of the nature of his injuries, may be forced to incur
similar expenses in the future, and a claim is made therefor.
19. As a direct and proximate result of the accident and
aforesaid injuries, plaintiff Randy Herweg has undergone and in the
future will undergo great physical and mental pain, suffering,
great inconvenience in carrying out his daily activities, loss of
life's pleasures and enjoyment, and claim is made therefor.
20. As a direct and proximate result of the accident and
aforesaid injuries, Plaintiff Randy Herweg has been, and in the
future will be, subject to great humiliation, embarrassment, and
disfigurement, and claim is made therefor.

COMPLAINT
1. I?laintiff Randy Herweg is an adult individual, citizen of
the Commonwealth of Pennsylvania, who resides at 405 Market Street,
New Cumberland, Cumberland County, I?ennsylvania.
2. Defendants Charles J, Bender and Gertrude Bender are
adult individuals, citizens of the Commonwealth of Pennsylvania,
who reside at 299 Allendale Way, Camp Hill, Cumberland County,
Pennsylvania,
3. Defendant A & A Furniture and Liquidators is a
Pennsylvania corporation with a corporate address of 213 Fourth
Street, New Cumberland, Cumberland County, Pennsylvania.
4. Defendant A & A Furniture and Liquidators currently
maintains an address of 314 Bridge Street, New Cumberland,
Cumberland County, I?ennsylvania.
5, At the time of accident mentioned hereinafter, Defendant
A & A Furniture and Liquidators maintained a business address and
were actively conducting business at 213 Fourth Street, New
Cumberland, Cumberland County, I?ennsylvania.

6. The facts and Occurrences hereinafter related took place
on or about January 23, 1996, on the sidewalk in front of Defendant
A & A Furniture and Liquidators's warehouse located at 213 Fourth
Street, New Cumberland,
7. At all relevant times, Defendants Charles J. Bender and
Gertrude Bender owned, controlled and possessed the bUildings and
structures located at 213 Fourth Street, New Cumberland.
8. At all relevant times, Defendants Charles J, Bender,
Gertrude Bender, and A & A Furniture and Liquidat~rs were
responsible for managing and maintaining the grounds and premises,
including but not limited to sidewalks and walkways located at 213
Fourth Street, New Cumberland, Cumberland County, Pennsylvania.
9. At that time and place, Plaintiff Randy Herweg was
walking on the sidewalk, heading toward his home when he slipped
and fell on ice that had formed and/or accumulated on the sidewalk
of Defendants's property.
10. Although no significant snow-fall or icy precipitation
had occurred in at least a week prior to I?laintiff's accident, the
sidewalk of the premises owned by Defendants Charles J. Bender,
Gertrude Bender and A & A Furniture and Liquidators had not been
adequately cleared of ice hazards, nor had it been adequately
maintained to prevent foreseeable ice hazards,

(f) failure to properly maintain the sidewalk/walkway
by failing to shovel, clear, salt, cinder or
otherwise remove the hazardous patches of ice which
had been allowed to accumulate prior to and on
January 23, 1996;
(g) failure to properly salt, cinder, or use other
similar products or otherwise adequat';!ly remove
ice, or preventing accumulations of ~ce and/or
refreezing water run-off creating ice hazards;
(h) failure to take proper measures for the elimination
of ice that was known or should have been known to
exist on the sidewalk/walkway prior to and on
January 23, 1996, and
(i) failing to exercise the care that a land owner owes
to business invitees utilizing the premises for
their intended purposes.
15. The slippery, icy, and hazardous condition of the
sidewalk in front of Defendant A & A Furniture and Liquidators
represented a condition that existed for an adequate and sufficient
time prior to Plaintiff's accident which could have and should have
given the Defendants adequate time to correct the condition and
warn lawful users of the sidewalk, such as was Plaintiff at the
time of his accident, of the hazardous condition.
16. The icy and hazardous condition of the sidewalk on
Defendants' premises presented a dangerous condition known to the
Defendants, or which should have or could have been reasonably
known to the Defendants, which created a reasonably foreseeable
risk of harm which was, in fact, suffered by Plaintiff,

17, Defendants had sufficient time prior to Plaintiff's
accident to have taken measures to protect against the dangerous
condition that existed on the walkway of the Defendants' premises
as aforesaid, and prevent the injuries suffered by I?laintiff
herein, but Defendants failed to do so in any fashion or provide
any warnings as to the hazardous and icy conditions, which were
invisible to pedestrians and other lawful users of Defendant' s
premise, such as was Plaintiff at the time of her accident.
18. As a direct and proximate result of the accident and
aforesaid injuries, Plaintiff Randy Herweg was forced to incur
medical expenses in an effort to restore himself to health, and
because of the nature of his injuries, may be forced to incur
similar expenses in the future, and a claim is made therefor.
19. As a direct and proximate result of the accident and
aforesaid injuries, I?laintiff Randy Herweg has undergone and in the
future will undergo great physical and mental pain, sUffering,
great inconvenience in carrying out his daily activities, loss of
life's pleasures and enjoyment, and claim is made therefor.
20. As a direct and proximate result of the accident and
aforesaid injuries, Plaintiff Randy Herweg has been, and in the
future will be, subject to great humiliation, embarrassment, and
disfigurement, and claim is made therefor,

arbitrators in this matter, despite the outstanding discovery requests and anticipated deposition.

reminded PlaintilT's counsel that he intends to take the deposition of Plaintiff and. therefore,
requested that she withdraw her Petition lor the Appointment of Arbitrators, A true and correct

8, On or about August 29. 1997. following the filing of a Motion to Compel and
Brief in support thereof, and the entry of a Rule to Show Cause. PlaintilT provided responses to

I received your letter of September 11, 1997. I believe there is a bit
of confusion with regard to your attempts to discuss this matter with me. I
called your office several tImes and left messa~es with your office staff for
you to contact me. I again contacted your office on September 15, 1997, to
discuss this matter with you, again leaving a message. While I agree we have
been playing phone tag, I do not appreciate the implication that I have not
attempted to reach you. I am certainly willing to discuss the Herweg matter
with you, and, in particular, our reasoning behind the change to the
arbitration list.
As I have stated earlier, I believe this claim falls ~'i thin the
arbitration limits and, therefore, would be more appropriately tried before
an arbitration panel than a jury trial. As such, I filed the Petition for
Arbitration. I do not intend to inhibit your right to perform discovery and,
in fact, the deposition of my client was scheduled for November 3, 1997.
Furthermore, as we have provided responses to your discovery requests,
I now believe that the Motion to Compel is moot. I would appreciate it if
you would inform the Court.
If you have any questions, I would be more than willing to discuss them

CONSENT TO PILE AMENDED COMPLAINT PURSUANT TO Pa.R.C.P. 1033
1. This is an action arising out of Plaintiff's alleged fall
on a sidewalk located in front of Defendants' premises.
2. Plaintiff filed a Complaint in this matter on February 5,
1997.
3. During the course of discovery, Plaintiff learned of
additional circumstances which may have caused or contributed to
the allegedly unsafe condition of the sidewalk, namely the presence
of a sloped awning which could direct ice, snow, water or runoff
onto the portion of sidewalk where Plaintiff fell.
4. Plaintiff desires to file an Amended Complaint in order
to include allegations regarding the presence of the awning, the
dangerous condition created thereby, Defendants' knowledge thereof,
and Defendants' failure to take insufficient measures to correct
same.
5. The incident giving rise to this litigation took place on
January 23, 1996.
6. The statute of limitations for Plaintiff's cause of
action against the Defendants has not yet expired.
7. Pursuant to Pa.R.C.P. 1033, Defendants hereby grant their
consent to the Plaintiff's filing of an Amended Complaint.

and fell on ice that had formed and/or accumulated on the sidewalk

11. Rising and falling temperatures throughout the week prior
to Plaintiff's accident, and on the day of Plaintiff's accident,

were ideal for the creation of hazardous ice patches as a result of
run-off from snow piled along the edges of the sidewalk which had
melted and re-froze, and Defendants were, or should have been,
aware of same.
12. The presence of ice on the sidewalk in front of
Defendants' premises created a dangerous condition of which the
Defendants were, or should have been, aware prior to the time of
Plaintiff's accident.
13. At all times relevant to this Complaint, an awning
covered the porch and/or steps of the Defendants' property located
at or about 213 Fourth street, New Cumberland, Pennsylvania.
14. The aforesaid awning was sloped and positioned in such a
fashion that it could, and routinely did, direct rain, snow, ice,
runoff and/or melting ice onto the sidewalk in front of the 213
Fourth street premises, creating a dangerous condition of which the
Defendants were, or should have been, aware.
15. Nonetheless, Defendants failed to take any measures to
prevent the awning from directing rain, snow, ice, runoff and/or
melting ice onto the sidewalk, or to remove any ice created
thereby.
16. The presence and nature of the aforesaid awning caused,
or contributed to, the icy, dangerous condition of the sidewalk
that caused Plaintiff's fall.

17. As a result of the accident, Plaintiff sustained multiple
injuries, including but not limited to a triquetra 1 fracture of the
left wrist.
18. The said fall and the resulting injuries to the Plaintiff
were a direct and proximate result of the negligence of Defendants
in failing to properly maintain and inspect the 213 Fourth street
premises as follows:
(a) Defendants failed to keep the walkways clear of ice
hazards;
(b) Defendants failed to properly salt, cinder, or
otherwise take measures ensuring that ice
accumulating on the walkway would melt;
(c) Defendants failed to have proper and adequate
warnings posted for pedestrians and business
invitees, warning of the hazard posed by ice and
snow accumulations;
(d) Defendants failed to provide a safe path of travel
on the sidewalks/walkways;
(e) Defendants failed to inspect the sidewalk/walkway
for accumulations of ice prior to and as of January
23, 1996;
(f) Defendants failed to properly maintain the
sidewalk/walkway by failing to shovel, clear, salt,
cinder or otherwise remove the hazardous patches of
ice which had been allowed to accumulate prior to
and on January 23, 1996;
(g) Defendants failed to properly salt, cinder, or use
other similar products or otherwise adequately
remove ice, or preventing accumulations of ice
and/or refreezing water run-off creating ice
hazards;

(h) Defendants failed to take proper measures for the
elimination of ice that waknown or should have been
known to exist on the sidewalk/walkway prior to and
on January 23, 1996;
(i) Defendants failed to exercise the care that a land
owner owes to business invitees utilizing the
premises for their intended purposes;
(j) Defendants failed to correct the dangerous
condition created by the presence of a sloped
awning that directed snow, ice, runoff and/or
melting snow and ice onto the sidewalk of Fourth
street;
(k) Defendants failed to take measures to remove any
ice, snow, slush and/or icicles from the roof of
the awning so as to prevent runoff onto the
sidewalk of Fourth street;
(1) Defendants failed to clean the sidewalk premises of
ice that had formed and/or accumulated as a result
of melting snow, ice and/or runoff from the
aforesaid awning; and
(m) Defendants failed to remove, fix, alter and/or
redesign the awning in such a fashion to prevent it
from directing snow, ice, runoff, melting snow
and/or melting ice onto the sidewalk.
19. The slippery, icy, and hazardous condition of the
sidewalk in front of Defendant A & A Furniture and Liquidators
represented a dangerous condition that had existed for an adequate
and sufficient time prior to Plaintiff's accident such that
Defendant had adequate time to either correct the condition and/or
to warn lawful users of the sidewalk thereof, prior to the time of
Plaintiff's accident.
20. The icy and hazardous condition of the sidewalk on

Defendants' premises presented a dangerous condition known to the
Defendants, or which should have or could have been reasonably
known to the Defendants, that which created a reasonably
foreseeable risk of harm which was, in fact, suffered by Plaintiff.
21. Defendants had sufficient time prior to Plaintiff's
accident to have taken measures to protect against the dangerous
condition that existed on the walkway of the Defendants' premises
as aforesaid, and to prevent the injuries suffered by Plaintiff
herein, but Defendants failed to do so in any fashion or provide
any warnings as to the hazardous and icy conditions, which were
invisible to pedestrians and other lawful users of Defendant's
premise, such as was Plaintiff at the time of his accident.
22. As a direct and proximate result of the accident and
aforesaid injuries, Plaintiff Randy Herweg was forced to incur
medical expenses in an effort to restore himself to health, and
because of the nature of his injuries, may be forced to incur
similar expenses in the future, and a claim is made therefor.
23. As a direct and proximate result of the accident and
aforesaid injuries, Plaintiff Randy Herweg has undergone and in the
future will undergo great physical and mental pain, suffering,
great inconvenience in carrying out his daily activities, loss of
life's pleasures and enjoyment, and claim is made therefor.

25. Answering Defendants' averment is a conclusion of law to
which no responsive pleading is required, To the extent the
averment may be deemed factual, it is hereby specifically denied.
By way of amplification, Plaintiff was not negligent in any way.
Therefore, the I?ennsylvania Comparative and Contributory Negligence
Act does not apply to the instant action. Further, all of
Plaintiff's injuries and damages are recoverable in the instant
action and are in no way reduced,
26. Answering Defendants' averment is a conclusion of law to
which no responsive pleading is required. To the extent the
averment may be deemed factual, it is hereby specifically denied.
By way of amplification, Plaintiff did not assume the risk of his
injuries. Further, as previously stated herein, Plaintiff was not

sidewalks/walkway;

A failed to inspect the sidewalk/walkway for accumulations
of ice prior to and as of January 23. 1996;
(fl It is specifically denied that Defendant A & A
failed to properly maintain the sidewalk/walkway by failing

to shovel clear, salt, cinder, or otherwise remove the
allegedly hazardous patches of ice which had been allowed to
accumulate prior to and on January 23, 1996;

failed to properly salt and cinder or use other similar
products or otherwise adequately remove ice or preventing
accumulations of ice and/or refreezing water run-off
creating ice hazards;

that was known, or should have been known to exist on the
sidewalk/walkway prior to and on January 23. 1996; and

business invitees utilizing the premises for their intended

III. ARGUMENT
On July 2, 1997, A & A served Interrogatories and a request for production of documents
upon Plaintiff. The Pennsylvania Rules of Civil Procedure require that a party answer
Interrogatorics and produce documcnts within 30 days of service of the request. See Pa. R,C,P,
4006(a)(2) and 4009,11. Plaintiff has failed to rcspond to the discovery requests within the
required period of time, Pa, R,C,P, 4019(a)(I)(viii) states, "The court may, on motion, make an
a!>propriate order if a party or person otherwise fails to make discovery to obey an order of court
respecting discovery," Furthermore, Pa,R,C,P, 4019(c)(5) states, "The court, when acting under
subdivision (a) of this rule, may make such order with regard to failure to make discovcry as is

DEFINITIONS AND INSTRUCTIONS
