TAKE NOTICE TO THE FOLLOWING:
1, The premises which are subject to be sold at the
Sheriff's Sale in the above-captioned action is 116 Columbia Road,
Enola, Cumberland County, Pennsylvania 17025, A complete
description is in Exhibit "A" which is attached hereto and made a
part hereof.
2, The improvements situate on the premises consist of a two
story brick dwelling house with no garage known as 116 Columbia
Road.
3, The Judgment of the Court on which this sale is being
held is entered to No. 0634 Civil 1997.
4, The names of the owners are: Richard L. Bleyer, whose
last known address is 116 Columbia Road, Enola, PA 17025; and
Deborah L, Bleyer, 116 Columbia Road, Enola, PA 17025.
5. The time and place of the Sheriff's Sale is 10:00 A.M"
prevailing local time on the 3rd day of September, 1997, in the
Commissioner's Hearing Room, Second Floor, new Courthouse, corner
of Hanover and High Streets, Carlisle, Pennsylvania, 17013.

7, A Schedule of Distribution being a list of the persons,
governmental, corporate entities or agencies being entitled to
receive part of the proceeds of sale executed to be disbursed by
the Sheriff will be filed by the Sheriff on a date specified by the
Sheriff not later than thirty (30) days after the Sheriff's Sale,
and that distribution will be within ten (10) days thereafter.

Pleas of Cumberland County to open the judgment if you have a
meritorious defense against the person or company that has entered
judgment against you. You may also file a petition to Strike said
judgment with the same Court if you are aware of a legal defect in

a Petition to Stay or Delay the Execution and the Sheriff's Sale
if you can show a defect in the Writ of Execution or service or

COMPLAINT
1. The Plaintiff is FIRST FEDERAL SAVINGS AND LOAN
ASSOCIATION OF HARRISBURG now by merger, HARRIS SAVINGS BANK, a
corporation organized and existing under the laws of the State of
Pennsylvania and having its principal place of business at Second
and Pine Streets, Harrisburg, Pennsylvania, 17101.
2. The Defendants are Richard L. Bleyer and Deborah L.
Bleyer, husband and wife, adult individuals, residing at 116 E.
Columbia Road, Enola, Pennsylvania, 17025.
3. This is an attempt to collect a debt and any information
obtained will be used for that purpose.
4. Defendants, on June 15, 1977, entered into a mortgage
loan indenture with First Federal Savings and Loan Association, now
by merger, Harris Savings Bank, in the principal amount of Eighteen
Thousand Three Hundred and nO/100 Dollars ($18,300.00) the terms
of which loan are more specifically evidenced and set forth in the
mortgage indenture dated June 15, 1977, and recorded June 15, 1977,
in the Cumberland County Recorder's Office in Mortgage Book 623,
Page 489 is attached hereto, marked Exhibit "Au, and made a part
hereof by reference, which mortgage contains and is a lien upon the
property situate at 116 East Columbia Road, Enola, East Pennsboro
Township, Cumberland County, Pennsylvania, l702S, being improved
upon with a two and one-half story dwelling.
S. Said loan was further evidenced and secured by a note
which accompanied said Mortgage dated June lS, 1977, a copy of
which is attached hereto, marked Exhibit "B", and made a part
hereof by reference.
6. First Federal Savings and Loan Association of Harrisburg,
now Harris Savings Bank, in consideration of the said mortgage and
accompanying note, advanced to Richard L. Bleyer and Deborah L.
Bleyer the sum of Eighteen Thousand Three Hundred and NO/100
Dollars ($18,300.00).
7. The premises subj ect to
specifically set forth in Exhibit "A",
part hereof by reference.
8. Richard L. Bleyer and Deborah L. Bleyer are the sole
owners of the said premises contained in said mortgage.
9. Said mortgage and note have not been assigned in whole
or in part by the Plaintiff herein.
10. Richard L. Bleyer and Deborah L. Bleyer are the record
owners in fee simple of said premises by virtue of a Deed dated
June lS, 1977, and recorded in the Cumberland Count Recorder's
Office in Deed Book 21F ,Page 653
11. No judgment has previously been entered on said mortgage
said mortgage is more
attached hereto and made a
or note in any jurisdiction, and said instruments are less than
twenty (20) years old.
12. The said mortgage is in default because Defendants herein
have failed to pay the monthly payments of $173.39 that were due
and owing for the months of August, September, October, November
and December, 1996.
13. The Plaintiff has given to the Defendants written notice
of intention to foreclose on said mortgage as required by law under
Act 6, dated October 16, 1996, copies of which are marked Exhibits
"D"and "E" and attached hereto and made a part hereof by reference.
14. The Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 1983, dated
October 16, 1996, copies of which are marked Exhibit "F" and "G"
and attached hereto and made a part hereof by reference.
15. The entire principal amount of Eighteen Thousand Three
Hundred and nO/100 Dollars ($18,300.00) has become due and payable,
together with interest at the current rate of 8-3/4% per annum,
reasonable legal fees for collection of said sum in accordance with
the terms of said mortgage less such sums as have been paid on
account of principal of the said mortgage and costs.
16. The Plaintiff believes and therefore avers that
reasonable legal fees for collection is $1000.00.
17. The Defendants are liable to the Plaintiff for interest
at the current rate of 8-3/4% per annum until paid and expenses as
provided in and collectible under the mortgage documents that will
accrue until distribution by the Sheriff of Cumberland County,
Pennsylvania, to be computed at the time of judgment in these
proceedings in addition to the current loan balance.
18. The Defendants are liable to the Plaintiff for the
following on said mortgage loan:

19. The plaintiff believes and avers that neither of the
Defendants are members of the armed forces or are in the military
service of the united States of America.
WHEREFORE, the plaintiff prays the Court to enter Judgment
against the Defendants, Richard L. Bleyer and Deborah L. Bleyer,
of Mortgage Foreclosure and sale of the mortgaged property, with
damages in the amount of Three Thousand Eight Hundred Ten and
46/100 Dollars ($3,810.46), together with additional interest
thereon, costs and all other amounts advanced by plaintiff.

10. THE LEGAL RIGHTS YOU MAY HAVE ARE:
A. You may file a Petition with the Court of Common
Pleas of Cumberland County to open the judgment if you have a
meritorious defense against the person or company that has entered
judgment against you. You may also file a petition to Strike said
judgment with the same Court if you are aware of a legal defect in
the obligation or procedure used against you. You may also file
a petition to Stay or Delay the Execution and the Sheriff's Sale
if you can show a defect in the Writ of Execution or service or
demonstrate any other legal or equitable rights.
B. After the Sheriff's Sale, you may file a Petition
with the Court of Common pleas of Cumberland County to set aside
the sale for a grossly inadequate price or for other proper cause.
This Petition must be filed before the Sheriff's Deed is delivered.
C. A Petition or Petitions raising the legal issues or
rights mentioned in the preceding paragraphs must be presented to
the Court of Common pleas of Cumberland County at one of the
Court's regularly scheduled business Court sessions. The petition
should be served on the Attorney for the Creditor at least two (2)
business days before presentation to the Court., and a proposed
Order or Rule must be attached to the Petition. If a specific
return date is desired, such date must be obtained from the Court
Administrator's Office, 1 Courthou!le Square, Fourth Floor,
Carlisle, Pennsylvania 17013, before presentation of the Petition
to the Court.
