any oncoming traffic. After approximately one-tenth of a mile, petitioner exited the
highway toward Trindle Road (Route 641). He twice drove his vehicle over a concrete
lane divider. He then turned onto Trindle Road without signaling. At that point,
Trooper Dissinger stopped petitioner. The trooper smelled a strong odor of alcoholic
beverage about his person. He had petitioner undertake a one-leg stand field
sobriety test which petitioner quit after his foot went down once. Petitioner also failed
a walk-and-turn test.
Trooper Dissinger arrested petitioner for driving under the influence.1 He read
petitioner his Miranda rights.2 He then read him the following:
Section 1547 of the Vehicle Code in part reads as follows: Any
person who drives, operates or is In actual physical control of the
movement of a motor vehicle in this Commonwealth shall be deemed to
have given consent to one or more chemical tests of breath, blood or
urine for the purpose of determining the alcoholic content of blood or
the presence of a controlled substance if a police officer has reasonable
grounds to believe the person has been driving, operating or in actual
physical control of the movement of a motor vehicle. Refusal to submit
to the chemical testing may result in a suspension of that person's
operating privileges for a period of 12 months.
Petitioner, who was verbally abusive, told the trooper that he would not take a
test. Petitioner was taken to Harrisburg Hospital. He continued to be verbally
abusive. At the hospital, the trooper read petitioner the following Section - 1547 -
Chemical Testing Warnings on form DL 26:
1. 75 Pa.C.S. ~ 3731 (a).
2. Miranda v. Arizona, 384 U.S. 436, 86 S.Ct. 1602, 16 L.Ed.2d 694 (1966).

1 Please be advised that you are now under arrest for driving under the
Influence of alcohol or a controlled substance pursuant to section 3731
of the Vehicle Code.
2 I am requesting that you submit to a chemical test of Blood (breath,
blood or urine Officer chooses the chemical test.)
3 It is my duty as a pollee officer to inform you that If you refuse to
submit to the chemical test your operating privilege will be suspended
for a period of one year.
4 a) The constitutional rights you have as a criminal defendant
commonly known as the Miranda Rights, Including the right to
speak with a lawyer and the right to remain silent apply only to
criminal prosecutions and do not apply to the chemical testing
procedure under Pennsylvania's Implied Consent Law which Is a
civil not a criminal proceeding.
b) You have no right to speak to a lawyer or anyone else before
taking the chemical test requested by the pollee officer nor do
you have a right to remain silent when asked by the pollee officer .
to submit to the chemical test. Unless you agree to submit to the
test requested by the pollee officer your conduct will be deemed
to be refusal and your operating privilege will be suspended for
one year.
c) Your refusal to submit to chemical testing under the Implied
Consent Law may be introduced into evidence in a criminal
prosecution for driving under the influence of alcohol or a
controlled substance.
Petitioner refused to take a blood test, telling the trooper that he would not
take the test without a lawyer. Trooper Dissinger told him that he did not have the
right to have a lawyer there. He also told him that it would be In his best interest to
take the test due to the fact that if he was not over .10, he would have nothing to
worry about - he would never see him again. The trooper gave petitioner several
more opportunities to take the test but petitioner continued to refuse. Petitioner also
refused to sign form DL 26. Trooper Dissinger then signed form DL 26 certifying that
he had read the wamlngs on the form to petitioner, and that petitioner had refused to

sign the form. Petitioner was then taken to a booking center.
DISCUSSION
Petitioner testified that Trooper Dissinger read Miranda rights to him at the
scene of the stop, and that he then read him the warning about a chemical test that
did not mention Miranda rights. Petitioner further testified that at the hospital,
Trooper Dissinger read him only the first three points in the chemical test wamlng.
He then testified that he was not told that if he refused to submit to a chemical test,
his operating privileges would be suspended for a period of one year. That,
Interestingly, was point number 3 on the written warning. Petitioner testified that if he
had been told that he would lose his license for one year, "I think I would have taken
the test." Petitioner acknowledged that he refused to take a blood test. We have no
doubt that Trooper Dissinger read all of the Section 1547 warnings on form DL 26 to
petitioner. Petitioner did not take the test because, as he testified, Trooper Dissinger
failed to wam him that his license would be suspended for one year for a refusal.
Rather, it was because he wanted to consult a lawyer before deciding whether to take
the test, despite the fact that he had been told that he did not have a right to speak to
a lawyer and that unless he agreed to submit to the test as requested, his operating
privilege would be suspended for one year.
In Commonwealth, Department of Transportation v. Scott, _ Pa. _, 684
A.2d 539 (1996), an operator was arrested for driving under the influence and taken to
a hospital for a blood test. At the hospital a police officer read to the operator the

vitiating the properly given O'Connell warnings." In O'Connell, the Supreme Court of
Pennsylvania had held that the police have an affirmative duty to Instruct the arrested
motorist that Miranda rights may not be exercised prior to submitting to a chemical
sobriety test. In Scott, the Supreme Court agreed with the trial court that Officer
Cartmell's statement that "because this Is a drunk driving case you are not entitled to
an attorney," was a misstatement; however, the Court concluded that the error was
not "[o]f such magnitude that it voided the preceding and subsequent, thorough and
legally correct O'Connell wamlngs." In reversing the trial court and the
Commonwealth Court, the Supreme Court held, "Accordingly, once a motorist has
been properly advised of his O'Connell warnings, a refusal to submit to chemical
testing under the terms of the Implied Consent Law will not be excused as unknowing
on the basis of the motorist's subjective belief's regarding the Interplay between the
Implied Consent Law and his Miranda rights."
In the case sub iudice, we have found these facts: (1) at the scene of the stop
petitioner was read his Miranda rights and a 1547 warning that did not Include
O'Connell warnings; (2) petitioner, without stating a reason, said he would not allow
a test of his blood; (3) petitioner was then taken to the HarriSburg Hospital where he
was read Section 1547 warnings that included O'Connell wamings; (4) petitioner
refused to take a test because he was without a lawyer; (5) Trooper Dissinger
reminded petitioner that he did not have a right to have a lawyer there; and (6)
petitioner continued to refuse to take the test. Using the same reasoning as set forth
