NOW COMES, the Plaintiff by its attorneys, Gates &
Seaman, and brings this action in Mortgage Foreclosure against
the named Defendants as follows:
1. The Plaintiff is CSB BANK, formerly known as
Curwensville State Bank, a state banking institution and
corporation organized and existing under the laws of the
Commonwealth of Pennsylvania and having its principal office and
place of business at State Street, P. O. Box 29, Curwensville,
Clearfield County, Pennsylvania, 16833.
2. Defendants, GREGORY S. HALL and DOROTHY E. HALL,
husband and wife, are individuals who presently reside in
Cumberland County, Pennsylvania, with a mailing address of 126
South West Street, Carlisle, Pennsylvania 17013.
3. The Plaintiff, CSB BANK, formerly known as
Curwensville State Bank, brings this action to foreclose a
Mortgage dated April 15, 1994 between Defendants, Gregory S. Hall
and Dorothy E. Hall, (husband and wife), Mortgagors, and
Curwensville State Bank, Mortgagee, which Mortgage covers
residential real estate situate in Carlisle Borough, Cumberland
County, Pennsylvania and which Mortgage is recorded in the Office
of the Recorder of Deeds of Cumberland County, Pennsylvania in
Mortgage Book 1208, Page 1104.

liE. Hall (formerly known as Dorothy E. Wright), hold title to the
aforementioned real estate by virtue of a deed from John W.

Defendant, Gregory S. Hall, and his wife, Dorothy
Norris, et ux, dated November 30, 1992 and recorded in the Office
of Recorder of Deeds of Cumberland County in Record Book A-36,
Page 123.
5. The land and improvements subject to the
aforementioned mortgage are situate in the Borough of Carlisle,
Cumberland County, Pennsylvania and are more fully described in
Exhibit "A" which is attached hereto and made a part hereof.
6. On November 19, 1996, Plaintiff properly prepared a
Notice of Intention to Foreclose Mortgage under Section 403 of
Act #6 of 1974 (41 P.S. S403) and on the sarne date mailed the
sarne to Defendant, Gregory S. Hall, by Certified Mail, return
receipt requested, Certified No. P 232 157 308 in the Postal
System of the United States of America but said mailing was
returned marked .Unclaimed". A true and correct copy of the
aforesaid Notice and U. S. Postal Service form 3800 showing said
item was mailed to Defendant, Gregory S. Hall, and the returned

envelope marked "unclaimed" are attached hereto and made a part
hereof, collectively, as Exhibit "B".
7. On November 19, 1996, Plaintiff properly prepared a
Notice of Intention to Foreclose Mortgage under Section 403 of
IAct .6 of 1974 (41 P.S. S403) and on the same date mailed the
same to Defendant, Dorothy E. Hall, by certified mail, return
Ireceipt requested, Certified No. P 232 157 309 in the Postal
System of the United States of America. A true and correct copy
of the aforesaid Notice and U. S. Postal Service From 3800 and U.
S. Postal Service From 3811 showing said Defendant's signed
receipt are attached hereto and made a part hereof, collectively,
as Exhibit .C..
8. The within cause of action in Mortgage Foreclosure
is being instituted more than thirty (30) days following service
of Plaintiff's Notice of Intention to Foreclose Mortgage under
Section 403 of Act .6 of 1974 (41 P.S. S403).
9. On November 19, 1996, Plaintiff properly prepared a
Notice under Section 403(c) of the Homeowner's Emergency Mortgage
Assistance Act of 1983 (35 P.S. S1680.401(c) et seq) and on the
same date mailed the same to Defendant, Gregory S. Hall, by first
class mail postage prepaid at the following address:

A true and correct copy of the aforesaid notice and Certificate
of Hailing form 3817 are attached hereto and made a part hereof,
collectively, as Exhibit "0".
10. On November 19, 1996, plaintiff properly prepared
a Notice under Section 403(c) of the Homeowner's Emergency
Mortgage Assistance Act of 1983 (35 P.S. 51680.401(c) et seq) and

collectively, as Exhibit "E".
11. The within cause of action in Mortgage Foreclosure
is being instituted more than thirty (30) days following receipt
by said Defendants of Plaintiff's aforomentioned Notice thereby
satisfying the Notice requirements of the Homeowner's Emergency

Mortgage Assistance Act of 1983 (35 P.S. 51680.401(c) et seq).
12. The Mortgage is in serious default because the
Defendants have failed to make monthly payments on the dates they
were due and at the present time are more than six (6) months in
arrears.
13. Despite Plaintiff making the payment demands as
set forth in Paragraphs 6, 7, 9 and 10 hereof, Defendants,

Gregory S. Hall and Dorothy E. Hall, have failed to bring the
payments current.
14. The following amounts are due on the

WHEREFORE, the Plaintiff demands judgment against the
Defendants in the sum of $73,410.40, plus costs of suit and per
diem interest of $14.7157 per day accruing on the loan from
January 30, 1997.

Cumberland, Commonwealth of Pennsylvania, bounded and described

BBGINNING on the east by South West Street; on the south by
property now or formerly of Samuel C. Hertzler and Mary E.
Hertzler, his wife, on the west by land now or formerly of Arthur
George and Lourene S. George, his wife, on the north by property
