I, A Complaint to Quiet Title was Iiled in the above captioned action on February
11.1997 and reinstated March 4.1997.
2. On January 2. 1998 Defendant Iiled a Motion requesting service of said
Complaint upon Defendant, General Home Financial Serviccs. Inc.. by publication pursuant to
Rule 430 of Pennsylvania Rules of Civil Procedure,
3. An Order of Court was cntered January 8, 198 authorizing service of the
Complaint upon Defendant General Home Financial Scrvices. Inc,. by publication.
4, Pursuant to said Order, the Complaint was served on Defcndant. General Home
Financial Services, Inc.. by publication oncc in the Cumberland Law Journal on January 23,
1998, and once in the Carlisle Sentinel on January 20. 1998. all as more specifically set forth in
PlaintilT's Motion for Entry of Final Judgment Iiled herein,

5. Attached hereto is the Atlidavilof Plaintiffs counsel attesting to the publication
of the aforesaid notices regarding Dcfcndant and the tililure of Detendant to tile an answer or
otherwise contact PlaintitTs counsel, said atlidavit bcing attachcd hereto, made a part hereof, and
marked Exhibit C,
WHEREFORE. PlaintilT requcsts this Honorable Court to enter an order granting the
following relief:
A. Entering an order that Defendant Gcncral Home Financial Services, Inc. shall be
forever barred from asserting any right, lien. title or interest in premises owned by Plaintiff
known as 91 Old State Road. Gardners, Cumberland County, Pennsylvania 17324. and more
particularly described in the Complaint to Quiet Title tiled in this action inconsistent with the
interest or claim of the Plaintiff. his hcirs and assigns, set forth in the Complaint unless the
Defendant. General Home Financial Services, Inc., commences a mortgage foreclosure action to
enforce the lien of the mortgage described in the Complaint tiled in this action within 30 days
from the date of publication by PlaintifT of notice of the entry of this Order,
B. Entering an order that if Defendant. Generall-Iome Financial Services. Inc., does
not take such action within said 30 day period. the Prothonotary on praecipe of the Plaintiff shall
enter linal judgment directing the Recorder of Deeds of Cumberland County to enter satisfaction
of the mortgage from Gabriel R. Shughart and Bonnie L Shughart to Mardi Gras Pools, Inc.
recorded in the Oflice of Recorder of Deeds in and ti.lr Cumberland County in Mortgage Book
