going to sign affidavits of consent and waivers of notice of
intention to request entry of divorce decree so that the
divorce can be concluded under Section 3301 Ie) of the
Domestic Relations Code. The affidavits and waivers will
be signed today and the Master's office will file those
documents with the Prothonotary.
The Master has been advised that after
negotiations this morning, the parties and counsel have
reached an agreement with respect to the outstanding
economic issues. The agreement is going to be placed on
the record in the presence of the parties. The agreement
as stated on the record will be considered the substantive
agreement of the parties not subject to any changes or
modifications except for correction of typographical errors
which may be made during the transcription. After the
document has been reviewed for any typographical errors and
corrections made as required, the parties and counsel will
be asked to sign the agreement affirming the terms of
settlement which are being placed on the record today.
Upon receipt by the Master of the signed
agreement, the Master will prepare an order vacating his
appointment and then counsel will be able to file a praecipe
transmitting the record to the Court requesting a final
decree in divorce. Mr. Griffie.
MR. GRIFFIE: If the Master please. In full
and final satisfaction of all claims made by both parties in
these proceedings, the parties stipulate and agree as
follows:
1. The Defendant David fl. Jumper is a participant in
a 401 (1:) plan with his employer Lear Corporation. In order
to distribute the marital portion of that pension, counsel
for the Plaintiff will prepare a Qualified Domestic
Relations Order providing for the rollover on the sum of
$17,341.12 from the Defendant's 401(1:) account. Both
parties agree to prumptly execute the Qualified Domestic
Relations Order so that it can be submitted to the Court and
to the plan administrator. After the Qualified Domestic
Relations Order is accepted by the Plan Administrator, the
Plaintiff then waives any additional claims or demands of
any nature on that 401 (1:) plan.
2. In furtherance of the final settlement of personal
property matters, the parties agree to use the services of
Owen Meals to perform an appraisal on their mobile home
located at 27 Mountain View Terrace, Newville, Cumberland
County, Pennsylvania. The cost of that appraisal will be
shared equally by the parties and the appraisal will be
accepted as the true value of that mobile home.
Immediately Upon receipt of the appraisal, the
parties will secure a new payoff figure from Green Tree
Financial Corporation which holds a lien on the mobile home.
That payoff will include payments made on the loan up to
date. These figures will then be used to determine the
equity in the lr.obile home for distribution purposes.
3. Counsel for the Defendant will secure a current
statement from the Defendant's Prudential IRA fund providing
us with the current value of that account; current being
October 1, 1999.
In addition, counsel for the Defendant shall
secure a statement from Monumental Life Insurance Company
evidencing the cash value, if any, of the life insurance
policy held by the Defendant during the parties' marriage.
4. After the parties determine the mobile home equity
as set forth above and secure the figures for the Prudential
IRA current value and the 110numental Life Insurance cash
value, they will add these sums to the following assets and
valuations for the assets:
Conair camper, valued at $250.00;
F-150 Ford pickup truck, valued at $450.00;
Member's 1st Federal Credit Union account, valued
at $272.00.
When these amount5 are then added to the equity in
the mobile home, the Prudential IRA, and the life insurance
cash value, Defendant shall then be obligated to compensate
Plaintiff in the amount of 50~ or this total value. The
50~ value of these personal property items shall be paid by
the Defendant to the Plaintiff within 90 days of receipt of
the appraisal of the mobile home.
The amount payable from the Defendant to the
Plaintiff in cash shall not exceed $5,000.00. If 1/2 of
the value of the personal property items named in this
paragraph exceed $5,000.00, then any amounts over $5,000.00
shall be added to the sum being distributed to the Plaintiff
pursuant to the Qualified Domestic Relations Order set forth
in Paragraph 1 above. In other words, if 1/2 of the value
of the personal property items is $6,000.00, Defendant shall
pay to Plaintiff $5,000.00 and an additional $1,000.00 shall
be added to the sum under the Qualified Domestic Relations
Order.
5. The parties agree the Plaintiff will retain the
1994 Mazda Protege but shall likewise be responsible for the
loan due and owing to Member's 1st Federal Credit Union and
will indemnify Defendant and save him harmless from any and
all demands for payment or collection activity on account of
the Member's ["t: Credit: Union dutollll.:bile luClu. In tile
event it is necessary for either party to execute any
documents relative to transferring ownership of the Mazda,
they will do so within 15 days of being requested to do so.
6. The parties agree that the personal property
presently in their position, including household furnishings
and appliances, will be retained by the party presently in
possession and neither party will make any claim against the
other for any items of personal property. In addition, and
in further confirmation of the payment of the Defendant to
the Plaintiff for the above mentioned items of personal
property, Defendant shall retain sole and exclusive
ownership and possession of the mobile home located at 27
Mountain View Terrace, Newville, Cumberland County,
Pennsylvania; the Conair camper; the Prudential IRA fund;
the Member's 1st Federal Credit Union account, and the
Monumental Life Insurance policy. As part of retaining
the mobile home, husband shall assume sole and exclusive
responsibility for repayment of the loan due and owing to
Green Tree Financial Corporation and shall indemnify
Plaintiff and hold her harmless from and against any and all
demands for payment or collection activity of any nature
whatsoever on that loan.
7. Plaintiff shall be responsible for paying any and
all sums due and owing to Hershey Medical Center and Dr.
Pinkar for medical services provided to her. Plaintiff
shall indemnify Defendant and hold him harmless from and
against any and all demands for payment or collection
activity of any nature on account of those debts.
8. Husband shall pay the Sears credit card account
due and owing to Sears for a credit card maintained while
the parties were married and cohabiting. Defendant shall
indemnify Plaintiff and hold her harmless from and against
any and all demands for payment or collection activity of
any nature relative to the Sears account.
9. Both parties hereby withdraw any demands for
alimony, counsel fees, costs, and expenses and will make no
further claim relative to those benefits previously claimed.
10. The cemetery plots located at Rolling Green
Cemetery shall be retained by Plaintiff. In the event it
is necessary for Defendant to execute any documents to
transfer his interest in those cemetery plots to the
Plaintiff, he will do so within 15 days of being requested
to do so.

may dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or she
may now have or hereafter acquire under the present or
future laws of any jurisdiction to share in the property or
the estate of the other as a result of the marital
relationship including without limitation, statutory
allowance, widow's allowance, right of intestacy, right to
take against the will of the other, and right to act as
administrator or executor in the other's estate. Each will
at the request of the other execute, acknowledge, and
deliver any and all instruments which may be necessary or
advisable to carry into effect this mutual waiver and
relinquishment of all such interest, rights, and claims.
MR. GRIFFIE: Ms. Jumper, were you present
for the reading of the entire stipulation here today?
MS. JU}lPER: Yes.
MR. GRIFFIE: Did you understand what I said
and read?
MS. JUMPER: Yes.
MR. GRIFFIE: Is ~t your desire to have that
stipulation entered as a court order satisfying all of your
claims in these divorce proceedings?
MS. JUMPER: Yes.
THE MASTER: You understand that when you
leave here today you cannot make any substantive changes to
the agreement, that you are bound by what was stated on the
record today at this conference?
MS. JUMPER: Yes.
MR. DIEHL: Mr. Jumper, likewise, did you get
a chance to hear the agreement as dictated on the record by
Mr. Griffie?
MR. JUMPER: Yes.
MR. DIEHL: Did you get a chance to discuss
with your attorney prior to actually hearing it a moment
ago?
MR. JUMPER: Yes.

Dear Mr. Rundle and Mr. Grubb:
By order of Court of President JUdge George E. Hoffer
dated April 19, 1999, the fUll-time Master has been appointed in
the above referenced divorce proceedings.
On February 12, 1997, attorney Rundle filed a divorce
complaint raising grounds for divorce of irretrievable
breakdown of the marriage. On January 22, 1999, attorney Grubb
filed a claim for equitable distribution. Then attorney Griffie
jumps in on March 25, 1999, and files a claim on behalf of the
Plaintiff for counsel fees and costs. On April 16, 1999,
attorney Grubb filed an answer to Plaintiff's petition and
raised a claim for counsel fees on behalf of the Defendant.
I am sending a courtesy copy of this letter to attorney
Griffie. Apparently at this point the Plaintiff has co-counsel
and I need to be certain whether Mr. Rundle or Mr. Griffie is
representing the Plaintiff.
In any event, I am going to proceed on the assumption
that grounds for divorce are not an issue and that the parties
will either sign affidavits of consent or have been separated
for a period in excess of two years. Based on that assumption,
I am directing counsel for Plaintiff and counsel for Defendant
to each file a pre-trial statement in accordance with P.R.C.P.

substantive agreement regarding the equitable distribution issues of this divorce action.

Defendant on October 6, 1998.
II. The Defendant has agreed to the substantive terms of the Agreement as
drafted by counsel for the Plaintiff:
12. Plaintiff has refused to sign the lIbove mentioned Agreement.
13. Plaintiff, by and through her counsel, has on several occasions scheduled
times suitable to both parties whereby she would remove her personal property that
remained in the residence of the defendant.
14. Plaintiff has refused to remove her personal property from the residence of
the Defendant.
15, Plainlill' has negotiated in bad laith with the Delendant regarding the
resolution of the equitable distribution issues of the divorce action,
16. Plaintiff, by her continuing bad faith negotiating, inaction and refusal to
act, has caused the litigation to continue.

Defendant, David H. Jumper, by his attorney, William L. Grubb, Esquire, files
this New Matter To Divorce Complaint To Add Claim For Equitable Distribution of
property, and, in support thereof, avers as follows:
I. Plaintiff filed a Divorce Complaint in the above-captioned matter on
February 12, 1997 avering that the parties' marriage is irretrievably
broken and requesting that the Court enter a Decree of Divorce under
9330I(c) or 93301(d) of the Pennsylvania Divorce Code. A true and
correct copy of the Divorce Complaint is attached hereto as Exhibit A.
2. The allegations in paragraph I through 8 of the Divorce Complaint are
incorporated herein and made a part hereof.
3. Plaintiff and Defendant have acquired property and have incurred debts
during their marriage.
4. Plaintiff and Defendant have been unable to agree as to the equitable
division of the property and liabilities to the date of filing this petition.
WHEREFORE, Defendant requests that the Court equitably divide all marital
property and liabilities.

The relevant accounts are the Delcndant's Lear 4UI(k) and a Prudential IRA account.
The Lear 4U I (k) had a balance of 521.315,14 on March I, 1997, The Defendant can provide
monthly balances of the account from February I, 1997 through February I, 1999, Furthennore,
the Defendant receives a quarterly statement indicating the present value oftbe account. His last
statement, dated June 3U, 1999, indicated a balance 01'$42,025,81.
The I'rudentiallRA account was most recently valued on March 31, 1999 at $1,814.86.

PETITION OF COUNSEL FOR LEAVE TO WITHDRAW
William L. Grubb, Esquire, hereby respectfully petitions this Honorable Court for Leave
to Withdraw Appearance as Counsel for the Defendant, David H. Jumper, and in support, avers
as follows:
I. Petitioner is William L. Grubb, Esquire.
2. Rcspondent is David H. Jumper.
3. Petitioner was retained by Respondent on or about October I, 1998 to represent
him in the above referenced Divorce matter, and subscquently in the Custody, APL and Domestic
Relations matters.
4. Petitioner has undertaken such representation but is unable to continue for the
following reasons
a. Rcspondent has failed to pay Petitioner's fees and costs as billed in
accordance with their fee agrecment.
~
b. Respondent has disregarded an agreement or obligation to Pctitioncr as to
fees and costs and withdrawl is allowed pursuant to Rule 1.I6(b)(4) of the
Rules of Professional Conduct.
c. Petitioner's continued representation of Respondent has been rendered
unreasonably difficult by virtue of the client's conduct, and good cause
exists therefore under Rule 1.16(b)(5) of the Pennsylvania Rules of
Professional Conduct for petitioner's withdrawl of appearance in this case.
5. In letters to the Respondent dated May 5, 1999 and May 14, 1999, Petitioner
requested that respondcnt obtain new counsel. Pctitioner sent a lettcr to Respondent on June 16,
1999 advising of intent to file a pctition to withdraw. A true and correct copy of said letter is
attached hereto as Exhibit "A".
6. On June 17, 1999 Petitioner, through a telephone conference, advised Bradley
Griffie, Esquire, counsel for Marta I. Jumper, thc other party in the above captioned matters, of
Petitioner's intention to withdraw. Mr, Griffie did not oppose the Petition to Withdraw
Appearance.
WHEREFORE, Petitioner, William L. Grubb, Esquire, respectfully requests leave to
withdraw his appearance for Respondent.

Whether expert witnesses will be necessary in this case is yet to be determined.
The parties purchased the mobile home approximately two and one-half (2 II,) weeks prior
to their marriage, with the intention of using that mobile home as their marital residence,
That, in fact, is what occurred, Throughout the parties' marriage, then, payments were
made to the lien holder on the mobile home to pay down the lien on the mobile home, It is
submitted that the mobile home was also renovated extensively, which increased its value,
contrary to common cases where a mobile home decreases in value, Therefore, an
appraisal of the mobile home will be necessary in this case so that it can be detennined
what equity in the mobile home existed at the date of marriage and what equity existed in
the mobile home at the approximate date of separation, If an appraiser can be agreed
upon by the panies, an expert witness will not be necessary,
With respect to the other marital assets, it is not anticipated that an expert will be
necessary, but should issues arise where an expert witness may be necessary relative to
other assets, Plaintiff reserves the right to name those expert witnesses in time fashion,
Finally, expert witnesses may be necessary relative to the Plaintiffs medical
condition. Plaintiff has had severe intestinal disorders, has a documented hean condition,
and has had emotional and mental problems associated with her other medical conditions
and her severe pain, It may be necessary to take the deposition of her primary treating
physician, or at least present her medical records,
IV. FACT WITNESSES
Other than herself, Plaintiff does not intend to call additional factual witnesses at
this time, but Plaintiff reserves the right to name witnesses based upon information
presented at the pre-trial conference in this matter and subsequent thereto. Any witnesses
will be named in a timely fashion,
V. EXHmlTS
Plaintiff intends to present the following Exhibits:
I. Plaintiffs medical records as may be necessary to support the position of her
physician relative to her ongoing medical and psychological difficulties,
2, The mobile home evaluation once performed,
3, Copies of each and every statement from Defendant's 401(k) plan with his
employer from the date of separation to present in order to allow the Master to
determine the rate of growth of the marital portion of the 401(k) and add those
earnings to the marital portion accordingly,
4, A statement of cash value of life insurance policies once received.
5, A statement of the balance of the Members 1" Federal Credit Union account
once received,
6, A statement from Prudential Mutual Funds Services reflecting the value of the
IRA account for Defendant as of the date of separation (attached as El<hibit A-
three pages).
7. Domestic Relations Orders of Court dated May 7, 1999, dismissing
Defendant's request for alimony pendente lite (APL) due to the fact that his
income is twice that of the Plaintiff, the Order dismissing Plaintitl's request for
APL based upon an off-set for the child support she would owe to Defendant,
as well as the Summary of Trier of Facts where incomes were determined
(attached as El<hibit B-sil< pages),
8, Statements of balances of debts, if amounts cannot be agreed upon by the
parties,
VI. GROSS INCOME
The recent conference before the Domestic Relations Hearing Officer detennined
Defendant's ~ monthly income to be $1,655,00 based upon his 1998 federal income tax
return, Plaintitl's net earning capacity was set at $846,00 per month based upon her
current part-time employment and anticipated full-time employment. Plaintitl's actual net
income has been approl<imated at $513.00 per month
VII. EXPENSES
Plaintitl's routine monthly el<penses will be submitted at the time of the pre-trial
conference in this matter on an updated form provided for support and APL conferences,
VlII. PENSION
The only two pensions or retirement accounts of any nature that exist are
Defendant's 401(k) through his employment with Lear and the Prudential account.
Documents for the Lear 401(k) account indicate that the marital portion of the 401(k)
account was approximately $22,153,86 as of the date of separation, Approximately three
years of interest or earnings will need to be contributed to that based upon the growth of
the fund, which will need to be determined by having Defendant present copies of all
statements received since the date of separation,
In addition, as disclosed by Plaintiff. Husband had, at the time of the panies'
separation, the IRA account with Prudential Mutual Funds Services with a balance of
51,422,24, as of the end of 1996, Therefore, an additional two and one-half (2 Y2) years
of growth will have to be added to that amount to determine its present value,
IX. COUNSEL FEES
Due to Plaintiff's severely limited earning capacities and her medical condition, as
well as Defendant's failure and refusal to provide information relative to marital assets,
including, but not limited to, the Members I U Federal Credit Union account, Mutual Life
Insurance policies, and the Prudential Mutual Services Funds Services IRA, Plaintiff has
had to go to great lengths to secure information to approximate the value of those various
assets,
It is acknowledged that a proposed settlement agreement was prepared by prior
counsel for Plaintiff, which would have allowed the parties to avoid itemizing and valuing
all assets, but rather would have been a general comprehensive settlement. It is submitted,
and the Plaintiff will testilY, that there was a misunderstanding between her and prior
counsel relative to how that comprehensive settlement would have been implemented,
Due to that, upon the involvement of present counsel, Plaintiff requested and secured a
thorough explanation of the exact implementation of the proposed agreement and, now
that she understands the proposal, disagrees with that agreement as it would have created
a situation where she would be receiving far less in marital assets than that to which she is
entitled,
For the first two years of the parties' separation and the divorce proceedings,
Plaintiff did not request alimony pendente lite. although she would have been financially
entitled, She did not even request APL when circumstances changed in 1998 where her
child went into the Defendant's primary custody and she was ordered to pay child support,
Only when it became evident that the matter was not going to be resolved due to the
Defendant's refusal to consider a fair resolution of the case did the Plaintiff then file for
APL, which has caused an off-set of the child support obligation, as described in the
attached documents from the Domestic Relations Office,
Defendant has total control of ninety (90%) percent of the parties' marital assets
and all of the parties' liquid marital assets and, therefore, is in a position to fi"ustrate the
Plaintiff's attempts to resolve this case amicably, necessitating her use of legal counsel to
pursue this matter through a Master,
Under all of these circumstances, it is suggested that the Plaintiff is entitled to have
her attorney's fees paid by the Defendant for these proceedings, Plaintiff has retained her
legal counsel at an hourly rate of S125,OO per hour and a detailed itemization of charges
for all services rendered through these proceedings will be presented at the time of triaL

XU. PROPOSED RESOLUTION OF ECONOMIC ISSUES
[t is proposed that once all of the proper values are secured in the various marital
assets listed in L above, the assets should be totaled, From that total, then, based upon the
economic factors in this case, as well as the Plaintiffs medical condition, sixty-live (65%)
percent of the marital assets should be distributed to the Plaintiff. This will necessitate a
transfer of funds from Defendant's 401(k) and/or [RA accounts, through a QDRO, as well
as some cash disbursements which Defendant should be able to secure independently
either by securing a loan or otherwise securing a disbursement from his 401 (k) plan with

Enclosed herein please find my delayed filing of the Pre-trial Statement. Please
note that my client has gone to great lengths in an attempt to itemize all of the marital
assets, which were not heretofore disclosed by your client. If your client would be
forthcoming and disclose information regarding the Prudential Mutual Funds Services
IRA, his life insurance policies with Monumental Life, and the balance in the Members I"
Federal Credit Union account, all from the date of separation forward, we should be able
to put present values on those assets,
In addition, please advise if your client is willing to agree to have one individual
perform an appraisal of the mobile home so that we can determine the marital portion of
the value of the mobile home, Meanwhile, 1 believe it is incumbent upon your client to
secure a statement reflecting the balance due on the mobile home loan as of the date of
marriage and as of the date of separation so a determination can be made as to the pay
down of that account during the parties' marriage,
With respect to the cemetery plots, my client's understanding is that your client's
intention had always been to be cremated and that the two cemetery plots would actually
be used by Ms, Jumper and the parties' son, I am sure you are aware that it is next to
impossible to resell cemetery plots, or sell them back to the Memorial Gardens, or in any
other way to secure any financial consideration for them, Therefore, unless your client
wants to take the cemetery plots at a stated value that he will agree to and then take the
burden of trying to sell those cemetery plots, we are suggesting that we simply designate
them as having a $0 value and confirm ownership in my client and the parties' child,

1. The Defendant Cavid H. J~~per is a participant in
a 401(k) plan with his employer Lear Corporation. In order
to distribute the ~arltal portion of that pension, counsel

Uncertainly also existed relative to the existence of cash value in any insurance policies
held hy the Respondent. Respondent did not helieve there was any cash value in any insurancc
policy held hy him, whereas the Petitioner helieved that that was not the case, Following the
conference it was eventually determined that the Respondent's mother opened an insurance
policy in 1972 to ensure the life of her then minor son, The policy's cash value of the $230,13
had accrued prior to the parties' marriage, The relevanllanguage in the Stipulation rcgarding the

premarital down payment of the Respondent is not expressly addressed, The Respondent argues
that the burden should be placed upon the Pelitioner to expressly include the down payment in
the equation, and therefiJre the question of who has such burden must be further scrutinized.

needed to address the insurance policy's cash value in general terms, as its existence at the time
the Stipulation was executed was an uncertainty, By placing the burden upon the Respondent to
exclude items of premarital property as desired by the Petitioner, unreasonably results in having
the cash value paid for by the Respondent's mother prior to the marriage being drawn in to the

negotiations this morning, the parties and counsel have
reached an agreement with respect to the outstanding
economic issues. The agreement is going to be placed on
the record in the presence of the parties. The agreement
as stated on the record will be considered the substantive
agreement of the parties not subject to any changes or
modifications except for correction of typographical errors
which may be made during the transcription. After the
document has been reviewed for any typographical errors and
corrections made as required, the parties and counsel will
be asked to sign the agreement affirming the terms of
settlement which are being placed on the record today.

1, The Dofendant David H. Jumper is a participant in:
a 401(kl plan with his employer Lear Corporation. In orde'
to distribute the marital portion of that pension, counsel!
for the Plaintiff will prepare a Qualified Domestic I
Relations Order providing for the rollover on the sum of
S17,341,12 from the Defendant's 401(k) account. Both
parties agree to promptly execute the Qualified Domestic
Relations Order 50 that it can be submitted to the Court and
to the plan administrator. After the Qualified Domestic
Relations Order is accepted by the Plan Administrator, the
Plaintiff then waives any additional claims or demands of
any nature on that 401(k) plan.

Owen Meals to perform an appraisal on their mobile home

accepted as the true value of that mobile home,

When these amounts are then added to the equity in
the mobile home, the Prudential IRA, and the life insurance
cash value, Defendant shall then be obligated to compensate
Plaintiff in the amount of 50% of this total value. The
50% value of these personal property items shall be paid by
the Defendant to the Plaintiff within 90 days of receipt of
the appraisal of the mobile home.
The amount payable from the Defendant to the
Plaintiff in cash shall not exceed $5,000.00. If 1/2 of
the value of the personal property items named in this
paragraph exceed $5,000.00, then any amounts over $5,000.00
shall be added to the sum being distributed to the Plaintiff
pursuant to the Qualified Domestic Relations Order set forth
in Paragraph 1 above. In other words, if 1/2 of the value
of the personal property items is $6,000.00, Defendant shall
pay to Plaintiff $5,000,00 and an additional $1,000.00 shall
be added to the sum under the Qualified Domestic Relations
Order.

1994 Mazda Protege but shall likewise be responsible for the
loan due and owing to Member's 1st rederal Credit Union and
will indemnify Defendant and save him harmless from any and

Based upon the Stipulation that has been entered in this case which was ntlaehed as
Exhibit A on the Complaint for Contempt and which is ntlnehed herelo and incorporated herein
by reference as Exhibit "A," nil issues wcre setlled. All actions necessary in order to comply
with the tcrnlS of the Agreement have been met with the exception of the Respondent's failure
and refusal to pay the sum due to the Petitioner pursuant to the parties' Stipulation. All claims
made by both parties were resolved by the Stipulation and Agreement. The parties specifically
noted their counsclto the Stipulation on the record and this consent is part of the Stipulation.
Subsequent to the entry of the Stipulation and following his failure to comply with the
terms of the Stipulation and, in fact, after the filing of a Complaint for Contempt, Respondent
has raised substantive claims previously made in the parties' negotiations. These claims arc that
certain items arc premarital or non-marital and should not be included in the calculations
pursuant to the Stipulation. Respondent claims $3,000.00 of funds used to purchase the mobile
home at 27 Mountain View Terrace were non-marital. Petitioner acknowledges this claim is
now being made by the Respondent, but der.ies it is accurate. Respondent also claims that a
certain Monumental Life Insurance Company policy with a cash value of $230,13 was, likewise,
non-marital. Petitioner acknowledges Respondent makes this claim, but denies that it is
accurate. More importantly, Petitioner responds that the claims being made now are the same
claims that were made in the past and which were resolved through compromise leading to the
Stipulation entered before the Master.
II, STATEMENT OF OUESTION RAISED BY RESPONDENT
Should the Court be pernlitled to modify or overturn a Stipulation entered into between
the parties following comprehensive negotiations?
Respondent's brief suggests that the Court should look beyond the parameters of the
parties' Agreement to detemline whether certain property is marital or non-marital. There is no
basis in the law for this and that is why none is citcd by Respondent. Similarly, the Respondent
tries to suggest that there is a question over the interpretation of the Stipulation between the
parties by referencing contract caselaw. His argumcnts, again, are misplaccd,
There is no misunderstanding. The parties know exactly what they need to do and, in
fact, the suggestion in the stipulated position jlresented by Respondent in Court is that the parties
not only know what their responsibilities are under the Stipulation but they have complied with
all of the terms of the Stipulation in securing appraisals, securing payoff figures, and securing
necessary information to apply the equation in the Stipulation,
Thus, at this point it is not up to the Court to try to interpret why the parties stipulated or
agreed as they did before thc Master, but rather it is incumbent upon the Court simply to enforce
the Agreement. The Agreement requires Respondent to pay the sums due. Therefore, the
additional $1,500.00 due from Respondent from the $3,000.00 amount alleged by the
Respondent to be non-marital on the purchase of the mobile home and $115.06 which is one-half
of the amount elaimed to be non-marital by the Respondent relative to his life insuranee policy,
must be paid,
The sum of $1,615.06 is due pursuant to the terms of the parties Stipulation, The
maximum amount of cash to be paid by Respondent under the Stipulation is $5,000,00,
Therefore, the $5,000,00 in cash remains due and an additional $273,50 should be added to the
Qualified Domestic Relations Ordcr previously prepared by counsel and Petitioner. Onee that is
accomplished, then the parties will have complied with the terms of their Stipulation.

acceptance of this Qualified Domestic Relations Order, the sum of SEVENTEEN

8. Nothing in this Order shall be construed to required the Plan to provide any type or
form of benefit, or any option, not otherwise provided under the Plan or to provide
benefits to the Alternate Payee in an amount that exceeds the amount of benefits
that the Plan would be required to pay with respect to the Participant if the Order
did not apply. Except for the interest awarded herein to the Alternate Payee as an
Alternate Payee, this Qualified Domestic Relations Order shall have no effect on
the Participant's remaining interest in the account under the Plan or on hislher
future interests in an account under the Plan, The Alternate Payee shall not be
entitled to Participant's interests in the Plan that are already required to be paid to
another Alternate Payee under another domestic relations order previously
determined to be a Qualified Domestic Relations Order; however, the Participant
has represented that no such previously Domestic Relation Order exists. Any
provisions of this Order that are construed to be in conflict with the previsions of
this paragraph should be null and void and have no effect.

10, It is the intention of the Alternate Payee and the Participant that this Order shall
qualify as a Qualified Domestic Relations Order within the meaning of Section
414(p) of the Codc and Scction 206(d)(3)(B) of the Employee Retirement Income
Security Act of 1974, as amcnded (hereinaftcr "ERISA"), and that whenever the
provisions hereof arc inconsistent with the definition of a Qualified Domestic
Relations Order as may be contained from tirne to time in the Code or ERISA, this
Order shall be amended, from time to time as rnay be necessary, to comply with
the requirements for Qualified Domestic Relations Order under the Code and
ERISA or regulations promulgated thereunder and to cause this Order to be
accepted as a Qualified Domestic Relations Order by the Plan Administrator of the
Plan. The Court retains jurisdiction to amend this Order to so comply,

to the Participant .
12. Any reasonable cost incurred by the Plan Administrator to effectuate the terms or
provisions of this Order rnay be assessed against the party requiring the servitudes
of the Plan Administrator. In the event both parties require services of the Plan
Administrator, such expenses shall be divided equally between them.

served upon the Plan Administrator and the trustee of the Plan and that the
Qualified Domestic Relations Order shall be binding on the Plan Adrninistrator
and the trustee according to the laws of the Cornmonwealth of Pennsylvania, the
