Pa,C,S, ~1374(a) (2), A true and correct copy of that Order is
attached hereto as Exhibit "A",
4, The Department did not afford Spankeys a hearing in
making its determination.
5, On February 5, 1997, District Justice Roger Estep
entered two Orders finding Spankeys "not guilty" of the
aforementioned charges,
6, The determination by the Department has no basis in law
or fact and constitutes an abuse of discretion,
7, The actions of the Department violate Spankey's
constitutional protections of due process and against double
jeopardy.
8, The action is res judicata,
9. Spankey's appeals the Order to the Court of Common
Pleas pursuant to 75 Pa.C,S. 1377 and prays that this Honorable
Court schedule this matter for a hearing de ~.
