COMPLAINT
AND NOW comes the Plaintiff. R-Gee Contracting, Inc., by its attorney,
Michael L. Bangs, Esquire, and files the following Complaint:
1. Plaintiff, R-Gee Contracting, Inc" is a Pennsylvania corporation with its
principal place of business at 3 Richland Lane, Suite 101 A, Camp Hill, Cumberland
County, Pennsylvania,
2, Defendant, Keystone General Contractors, Inc., is a Pennsylvania
corporation with its principal place of business at 630 Lowther Road, Lewisberry,
York County, Pennsylvania (hereinafter referred to as "Keystone").
3. Defendant, Washington International Insurance Company, is an insurance
company with its principal place of business at 1930 Thoreau Drive, Suite 101,
Shaumburg, Illinois. 60173 (hereinafter referred to as "Washington International").
4. Plaintiff generally is in the business of commercial, industrial, and
residential construction,

11. The agreement entered into between Plaintiff and Defendant Keystone
provided that Plaintiff would do work on a time and materials basis at the rate of
$22.50 per mechanic hour, and $20.00 per helper hour, plus materials as stated to
be invoiced on a weekly basis,
12, Defendant Keystone agreed to pay for the work upon receipt of the
weekly invoices,
13. Plaintiff submitted to Defendant Keystone weekly invoices. copies of
which are attached hereto and marked as Exhibit 01-03,
14, Plaintiff submitted to Defendant Keystone invoices in the total amount
of $11,342.87,
15. All of the work performed by Plaintiff for Defendant Keystone on the
Maritza project was done in a good and workmanlike fashion and in accordance
with the order and specifications of Defendant Keystone.
16. Defendant Keystone has paid a total of $6,875.54 towards the
outstanding invoices, Despite repeated requests by Plaintiff, Defendant Keystone
has failed or refused to pay the remaining amount due of $6,655,10.
1 7, Defendant Keystone has breached the agreement with Plaintiff by its
failure or refusal to pay for the work performed by Plaintiff on the project as
evidenced by the invoices.

25. Despite repeated requests by Plaintiff, Defendant Keystone has failed or
refused to pay for any of the work performed by Plaintiff on the project,
26, Defendant Keystone has breached the agreement with Plaintiff by its
failure or refusal to pay for the work performed by Plaintiff on the project as
evidenced by the invoices.
27, Plaintiff has been damaged in the amount of $6,090,27 as a result of
the breach by Defendant Keystone.
WHEREFORE, Plaintiff demands judgment against Defendant Keystone in the
amount of $6,090,27, plus interest. plus costs of suit, This amount is within the
arbitration limits requiring compulsory arbitration on the matter,

29. Defendant Washington International, acted as a surety on a certain
payment bond it provided to Defendant Keystone to secure payment of all
materialmen and subcontractors on the Summit Terrace project,
30. In accordance with the terms and conditions of the bond, Defendant
Washington International is liable for payment of all sums due and owing by

in part from the Contractor, or not received

Bond and enclosing a copy of the previous
written notice furnished to the Contractor
