5. A release was sent to Plaintiff's Counsel for his client to execute. The
release provided that it would be signed by the personal representative of the Estate of
Henry Hicks, (A copy of the release is attached as Exhibit "2").
6, On March 24, 2000, Plaintiff's Counsel returned the release. The release
had been signed by Brenda High and Bonnie ShulL Plaintiff's Counsel, however, did
not have Ms. Shult and/or Ms, High appointed as personal representative of the Estate
of Henry Hicks. On March 30, 2000, defense counsel brought this to the attention of
Attorney McKnight and requested that he take steps to have them appointed, (See
letter dated March 30, 2000, attached as Exhibit 3).
7. Approximately every six months defense counsel has sent Attorney
McKnight a letter, Defense counsel has repeated requested that plaintiff's counsel
have someone appointed as the personal representative of the Estate of Mr, Hicks,
Once that person is appointed then that person can sign the release, Despite these
letters, plaintiff's counsel has not taken any steps to have anyone appointed personal
representative of the estate. (See letters dated October 3, 2000; February 16, 2001;
September 20, 2001; April 19, 2002; July 25, 2002 attached as Exhibit "4".)
8. Despite these letters plaintiff's counsel has failed to take any steps to
have any individual appointed personal representative of the Estate of Henry Hicks,
9, In the Fall of 2001 the case appeared on the purge list for Cumberland
County, On October 30,2001, Attorney McKnight stated that the case was in the

process of settlement. As a result of this representation, Judge Oler granted Attorney

McKnight's request that the case be stricken from the purge list. (A copy of Judge
Oler's Order is attached as Exhibit 5),
10. Defendant now files this motion to dismiss.
11 . As an alternative Defendants request this Court to issue an order requiring
the plaintiff to have an individual appointed personal representative of the estate of
Henry Hicks,
12, Defendant has incurred costs associated with this motion. Defendant
respectfully requests this Honorable Court to enter an Order that Plaintiff's counsel
must pay it attorney's fees in the amount of $250.00.
WHEREFORE, Defendants respectfully request this Honorable Court to grant this
Motion together with the costs associated with it.

KNOW ALL MEN BY THESE PRESENTS THAT Henry Franklin Hicks and/or the
Estate of Henry Franklin Hicks for and in consideration of the sum of One Thousand Five
Hundred ($1 ,500.00l Dollars, receipt of which is hereby acknowledged, does hereby
remise, release and forever discharge Defendants Concetta Butto, Anthony M. Butto,
Clyde Schaffner and Lorena Schaffner, t/d/b/a Ye Olde Colonial House Resteurent end
their servants, agents, employees, and insurers end ell of their successors, essigns,
heirs, executors and administrators, of and from all, and all manner of, actions and
causes of action, suits, debts, dues, accounts, bonds, covenants, contracts,
egreements, judgments, claims and demands whatsoever in law or equity, which Henry
Franklin Hicks and/or the Estate of Henry Franklin Hicks ever had, now har., or which
his heirs, executors, administrators, successors or assigns, or any of them, hereafter
can, shall or may have, for, or by reason of any cause, matter or thing whatsoever, from
the beginning of the world to the date of these presents, especially all claims and
liability arising out the slip-and-fall incident which occurred on or about February' 16,
1995 at the Ye Olde Colonial House Restaurant, located at 40 East Louther Street,
Carlisle, Cumberland County, Pennsylvania, and which released claim was made the
subject of a lawsuit brought by Henry Franklin Hicks against Concetta Butta, Anthony
M. Butta, Clyde Schaffner and Lorena Schaffner, t/d/b/a Ye Olde Colonial House
Restaurant in the Court of Common Pleas of Cumberland County, Civil Action Number
97-783.
In further consideration of the premises, Henry Franklin Hicks and/or the Estate
of Henry Franklin Hicks hereby agrees and directs that the aforementioned lawsuit
commenced in the Court of Common Pleas of Cumberland County, Pannsylvania, Civil
Action Numbar 97-783, shall be marked dismissed with prejudice. Henry Franklin Hicks
and/or the Estate of Henry Franklin Hicks does further agree and understand that tha
settlement of the within matter is not to be considered or treated as an admission of
liability on the part of Concetta Butto, Anthony M. Butto, Clyde Schaffner and Lorena
Schaffner, t/d/b/a Ve Olde Colonial House Restaurant, and/or their servants, agents,
employees, and/or insurers, and that the law of the Commonwealth of Pennsylvania
shall govern the interpretation and legal effect of this General Release.

Please provide me with the necessary documentation. Once I receive the necessary
documentation, I will be able to provide you with a settlement check for this matter.

15. Denied. It is denied that Plaintiff's injuries were caused by the negligence
of the Defendants and that their negligence consisted of:
A. Failing to provide adequate lighting in the exit area to provide the
Plaintiff with an opportunity to safely exit the property;
B. failing to provide adequate handrails for the support of the Plaintiff
who had great difficulty walking; and,
C. failing to provide any exit which the Plaintiff could safely use his
wheelchair.
On the contrary, at all times relevant, Defendants acted in a lawful, careful, safe
and prudent manner and with due care as required by the circumstances,

NEW MATTER
24. Plaintiffs injuries and damages, which are specifically denied, were not
caused by any acts, omissions, or breaches of duty of Defendant Schaffner, but were
caused in whole or in part or were contributed to by the negligence, fault, or want of
care of Plaintiff or persons other than Defendant Schaffner.
25. Plaintiffs claims are barred in whole or in part by Plaintiffs comparative
negligence.
26. Defendant Schaffner's conduct was not a substantial factor in causing
Plaintiffs injuries or damages, if any.
27. Defendant Schaffner's acted reasonably at all times material hereto and
the premises was reasonably safe for its intended use.
28, No act, omission, no any condition of the premises caused Plaintiffs
injuries or damages, if any.
29, Plaintiff fails to state a claim against Defendant Schaffner under the
Americans with Disabilities Act upon which can be granted,
30, Plaintiff assumed the risk of his injuries as a result of his intentional
conduct.
31. No dangerous or unsafe condition existed at said time,

September 12, 1998.
5. A release was sent to Plaintiff's Counsel for his client to execute. The
release provided that it would be signed by the personal representative of the Estate of
Henry Hicks. lA copy of the release is attached as Exhibit "2").
6. On March 24, 2000, Plaintiff's Counsel returned the release. The release
had been signed by Brenda High and Bonnie Shull. Plaintiff's Counsel, however, did
not have Ms. Shult and/or Ms. High appointed as personal representative of the Estate
of Henry Hicks. On March 30, 2000, defense counsel brought this to the attention of
Attorney McKnight and requested that he take steps to have them appointed. lSee
letter dated March 30, 2000, attached as Exhibit 3).
7. Approximately every six months defense counsel has sent Attorney
McKnight a letter. Defense counsel has repeated requested that plaintiff's counsel
have someone appointed as the personal representative of the Estate of Mr. Hicks.
Once that person is appointed then that person can sign the release. Despite these
letters, plaintiff's counsel has not taken any steps to have anyone appointed personal
representative of the estate, (See letters dated October 3, 2000; February 16, 2001 ;
September 20, 2001; April 19, 2002; July 25, 2002 attached as Exhibit "4".)
8. Despite these letters plaintiff's counsel has failed to take any steps to
have any individual appointed personal representative of the Estate of Henry Hicks.
9. In the Fall of 2001 the case appeared on the purge list for Cumberland
County. On October 30, 2001, Attorney McKnight stated that the case was in the

KNOW ALL MEN BY THESE PRESENTS THAT Henry Franklin Hicks andlor the
Estate of Henry Franklin Hicks for and in consideration of the sum of One Thousand Five
Hundred ($1,500.00) Dollars, receipt of which is hereby acknowledged, does hareby
remise, release and forever discharge Defendants Concetta Butto, Anthony M. Butto,
Clyde Schaffner and Lorena Schaffner, tldlbla Ye Olde Colonial House Restaurant and
their servants, agents, employees, and insurers and all of their successors, assigns,
heirs, executors and administrators, of and from all, and all manner of, actions and
causes of action, suits, debts, dues, accounts, bonds, covenants, contracts,
agreements, judgments, claims and demands whatsoever in law or equity, which Henry
Franklin Hicks and lor the Estate of Henry Franklin Hicks ever had, now has, or which
his heirs, executors, administrators, successors or assigns, or any of them, hereafter
can, shall or may have, for, or by reason of any cause, matter or thing whatsoever, from
the beginning of the world to the date of these presents, especially all claims and
liability arising out the slip-and-fall incident which occurred on or about February 1 6,
1995 at the Ye Olde Colonial House Restaurant, located at 40 East Louther Street,
Carlisle, Cumberland County, Pennsylvania, and which released claim was made the
subject of a lawsuit brought by Henry Franklin Hicks against Concetta Butto, Anthony
M. Butto, Clyde Schaffner and Lorena Schaffner, t/d/b/a Ye Olde Colonial House
Restaurant in the Court of Common Pleas of Cumberland County, Civil Action Number
97-783,
In further consideration of the premises, Henry Franklin Hicks and/or the Estate
of Henry Franklin Hicks hereby agrees and directs that the aforementioned lawsuit
commenced In the Court of Common Pleas of Cumbarland County, Pannsylvania, Civil
Action Number 97-783, shall be marked dismissed with prejudice. Henry Franklin Hicks
and/or the Estata of Henry Franklin Hicks does further agree and understand that the
settlement of the within matter is not to be considered or treated as an admission of
liability on the part of Concetta Butto, Anthony M. Butto, Clyde Schaffner and Lorena
Schaffner, t/d/b/a Ye Olde Colonial House Restaurant, and/or their servants, agents,
employees, and/or insurers, and that the law of the Commonwealth of Pennsylvania
shall govern the interpretation and legal effect of this General Release.
