5. On February 18, 1993, Petitioner, Linda A. Mitchell, was an insured on
an automobile insurance policy issued by Erie Insurance Group, Policy Number Q08-
2205491 H.
6. Said policy was in full force and effect on February 18, 1993 and
provided for $100,000.00 in Policy Limits per person, with stacking for Underinsured
Motorist Coverage
7. The Petitioner, Linda A. Mitchell was operating a vehicle when she was
struck from the rear by a vehicle being operated by Deatra Elayne Harbaugh and
owned by Donna E. Mong. Petitioner believes and therefore asserts that the
Harbaugh/Mong vehicle was being driven in a reckless, careless and inattentive
manner. Suit has been filed and is pending against Deatra Elayne Harbaugh and
Donna E. Mong. The litigation is still in discovery and has not been resolved by
settlement or verdict. Plaintiffs' counsel has placed Erie Insurance Group on notice
of a potential Underinsured Motorist claim and has been periodically apprising Erie
Insurance Group of the status of the discovery process and negotiations with the tort
feasor. The four (4) year anniversary of the date of the accident is approaching, and
hence, this Petition for Arbitration is being filed to confirm Petitioner's intent and right
to pursue a claim from Underinsured Motorist Coverage within and under the terms
of the Erie Policy.
8. Petitioners select Timothy A. Shollenberger, Esquire as her Arbitrator.
WHEREFORE, Petitioners, Linda A. Mitchell and Bryan J. Mitchell, respectfully
requests this Honorable Court to issue a Rule upon Respondent to Show Cause Why
