AND NOW. this ~ day of February, 1997, come the plaintiffs, Kirk D. Nielsen and
Suzanne Nielsen, his wife, by their attorneys, Irwin, McKnight & Hughes, and make the following
complaint against the defendants, William C, Fromm and Linda Fromm, his wife, as follows:

The plaintiffs are Kirk D. Nielsen and Suzanne Nielsen, his wife, who are adult individuals
residing at 16 Teaberry Drive, Carlisle, Cumberland County. Pennsylvania 17013,

The defendants are William C. Fromm and Linda Fromm, his wife, adult individuals who
reside at 100 Lebo Road, Carlisle, Cumberland County, Pennsylvania 17013.

The defendants, William C. Fromm and Linda Fromm, constructed a single family dwelling
located at 16 Teaberry Drive, Carlisle, Pennsylvania 17013.

project for the sum of $ 6.756.00.
This repolntlng projec~ Is due to gaps In the mortar In the
exlstln~ raked joints. Caulking is needed between the masonry and
the siding to stop the water penetration.
The brick work will then have a sealant coat applied. This

On September 29, 1994, the defendant sold the single family dwelling and the real estate
to the plaintiffs, Kirk D. Nielsen and Suzanne Nielsen.

At the time of the sale, the defendant provided an express warranty to correct all
construction problems and defects which were discovered within a period of one (1) year from the
sale of the property to the plaintiffs.

On or about March of 1995, the plaintiffs notified the defendant that water was coming
into the front portion of their basement.

Following extensive investigation, the plaintiffs and the defendant discovered that the
brick masonry located on the front of the dwelling was seriously defective and was penniuing
water through the front of the house which was then entering the basement.

The defendant agreed on numerous occasions to repair the masonry but he has not yet
done so.
9.
The failure of the defendant to repair the brick masonry on the front of the plaintift's home
constitutes a breach of the contract entered into by the parties in which the defendants agreed to
repair all defects discovered within the first year of purchase of the home,

In addition, the defendant represented that the new dwelling purchased by the plaintiffs
was constructed in a good workmanlike manner. The poor construction of the masonry on the
front portion of the house is a breach of that representation.

The plaintiffs have received an engineering report from Russell A. Cook which describes
the nature of the defective masonry. A copy of said report is marked as Exhibit "A" and made a
part of this Complaint.

The plaintiffs have obtained an estimate for the repair of the masonry from Dauphin
Masonry, Inc, A copy of which is marked as Exhibit"B" and a part of this Complaint. The cost
to repair the defective masonry is the sum of Six Thousand Seven Hundred Fifty Six and nollOO
($6,756.00) Dollars, In addition, the plaintiffs incurred the following additional expenses:

Kirk D. Nielsen, is employed by Lehigh Portland Cement Company
and any opinion offered by a co-worker is subject to thorough
examination of his credibility, motivation and veracity.

NEW MATTER
(15) Defendant built the single family dwelling purchased
by the Plaintiffs as a "spec" house which was substantially

complete at the time the parties entered into the Agreement of
Sale.
(16) Prior to the settlement, Defendant, William C. Fromm,
Contractor, provided Plaintiffs with a Limited Builder's
Warranty, a copy of which is attached hereto, made a part hereof
and marked Exhibit "A".
(17) The spec house purchased by the Plaintiffs had raked
masonry joints.
(18) Exhibit "A", Limited Builders Warranty, provides in
part as follows:
Exclusions from coveraqe -- I do not assume responsibility
for any of the following, all of which are excluded from
the coverage of this Limited Coverage Warranty:
O. Absence of dampness or water in the basement,. .
Repairs - Upon receipt of your written report of a defect,
if the defective item is covered by this Limited Warranty,
I will repair or replace it at no charge to you, within 30
days (longer if weather conditions, labor problems, or
materials shortages caused the delays). The work will be
done by me or subcontractors chosen by me. The choice
between repair or replacement is mine.
(19) The matters complained of by the Plaintiffs are not
covered by the Limited Builders Warranty for the following
reasons:
(A) They were raised more than one (l) year after Closing;
(B) They are specifically excluded by the Limited
Builder's Warranty;
(C) Plaintiffs prevented Defendant from performing the
work; or
(D) The Plaintiffs insisted on replacement rather than
repair which choice was reserved to the Defendant by

reason of the Warranty.
(20) From the date of the initial complaint in March of
1996, plaintiffs have always insisted that they desired to
replace the rake joint with a grapevine or concave joints.
(21) Plaintiff, Kirk D. Nielsen, is a salesman for Lehigh
Portland Cement Company, which among other products sells
masonry mortar.
(22) Defendant advised the Plaintiffs that this was not
acceptable by reason of a letter from Defendant's attorney to
the Plaintiff, Kirk Neilsen, dated June 28, 1996, a copy of
which is attached hereto, made a part hereof and marked Exhibit
I1BI1.
(23) In response to Defendant's letter of June 28, 1996,
Plaintiffs and Defendant continued to discuss the alleged
problem.
(24) Defendant, although under no legal obligation, sent
the mason to the plaintiffs' house on October 25, 1996 with the
instructions to perform what work was necessary to correct the
alleged problem.
(25) The mason, William Rhoads, determined that the problem
was a crack between the siding and the brick which, if caulked
and sealed, would resolve the water leak.
(26) Prior to starting the work, the mason reported his
finding to Mr. Neilsen who advised the mason that if he was not
going to replace the rake joint with grapevine joints he should
immediately leave the Plaintiffs' residence.
(27) The mason left the Plaintiffs' residence as instructed

without repairing the alleged problem.
(28) On October 29, 1996, the Defendant advised the
Plaintiffs that they had an additional fifteen (15) days to
allow the Defendant to resolve the problem.
(29) Plaintiffs refused to allow the Defendant to reaolve
the problem.
WHEREFORE, Defendant requests judgment be entered in favor
of the Defendant and against the Plaintiffs.
COUNTERCLAIM
(30) On or about July, 1995, Plaintiffs advised the
Defendant that the brick stoop to the home was cracked and in
need of repair.
(31) The mason inspected the stoop and discovered a couple
of joints that were in need of repair.
(32) The mason, a subcontractor for the Defendant, upon
instructions from Mr. Neilsen replaced the brick and used new
high tech mortar provided by Plaintiffs.
(33) The Plaintiffs supplied the high tech mortar.
(34) After the work was completed, the mason approached Mr.
Neilsen concerning payment and was advised by Mr. Neilsen to
contact the contractor.
(35) The contractor never agreed to replace the brick stoop
when a repair would have been sufficient.
(36) Plaintiffs have refused to pay for this work.
(37) The cost to replace and relay the brick, with the high
tech mortar, was $650.00.

I!Im _ The term of the various coverage of this Warranty begin on the date on
which your home is deeded to you. That date is referred to in this Limited
Warranty as the 'Closing."
Coveraoe - I warrant that:
For a period of 1 year after Closing, the floors, ceilings, walls, and
other internal structural components of the home that are not covered by other,
portions of this Limited Warranty will be fr~e of substantial defects in
materials or workmanship.
Excluaiona From Covoraqo - I do not aGsume responsibility for any of the
following, all of which are excluded from the coverage of this Limited Warranty:
A. An~' appliances, component equipment of like ("Equipment") for which the
manufacturer thereof issues a separate warranty, except as to Builder's
workmanship with respect to the installation of the Equipment (and Builder shall
assign to Owner all guarantees or warranties extended by the Manufacturer of any
Equipment), end
B. Damage caused by ordinary wear tear, abusive use, or lack of proper
maintenance of your home.
c. Nailpops, seam ridges and shrinkages in dry wall, lumber, trim, doors,
millwork, and wood floors. However, the Builder will make an inspection of dry
wall before occupancy, to make necessary touch-ups, with owner to be responsible
for clean-up and any necessary painting. Settling of the house (unless such
settling shall cause structural damage), earth in and around the foundation
utility trenches, or any other excavated and filled areas on the premises.
D. Cracking, falling, away, dripping, or discoloration of or imperfections
in grout, plaster, or stucco, provided Builder will regrout cracks exceeding 3/8"
in foundation or basement walls. cracks in the concrete work shall be repaired
by filling or patching.
E. Shrinking or warping of doors leas than 1/2" provided Builder will on
written request return one time during the first heating season following the
date of occupancy to make any necessary adjustment for sticking doors, with Owner
to be responsible for clean-up and any necessary paint or other touch-up.
F. Defects in items installed by you or anyone else except by me or (if
contracted by me) our subcontractors.
o. Work done by you or anyone else except me or (if contracted by me) our
subcontractors.
H. Loss or injury due to the elements.
I. Paint applied over newly plastered interior walls.
J. Consequential or incidental damages.

accidents or acts of God including, but not limited to: fire, explooion, smoke,
water escape, changes which are not reaoonable foreseeable in the level of the
under ground vater table, glass breakage, wind storm, hail, lightning, falling
trees, aircraft, vehicles, floor and earthquake.
N. Insect damage.
o. Absence of dampness or water in the basement, except that during the
period or one year from the date of occupancy the basement of the house shall be
flooded by reason of freerunning water from outside the house, builder undertakes
to make such repairs to the Premises aa shall be reasonably necessary to prevent
a reoccurance of such flooding during that period from that cause, provided that
this paragraph shall not apply in the foundation plantings on the Premises not
caused by Builder, flood conditions, cloudbursts, flash floods, unusually long
freezing spello with snow and subsequent quick thawing or any similar water
condition, or any cause that io not due to faulty or defective construction.
(1) As a condition of Builder's obligation hereunder, Owner agrees
to maintain the grade of Lot finished by Builder, agrees not to build a stone,
concrete, or any garden edging; a brick, atone, or concrete terrace or retaining
wall, which will pocket water, or to erect any other structures on the Premises
that will change Builder's grading or block the natural flow of water in any
particular way.
(2) Owner agrees that Builder shall not be responsible or liable for
damages to mechanical equipment or material stored in the basement.
NO OTHER WARRANTIES _ THE FOREGOING WARRANTIES ARE EXPRESSLY IN LIEU OF ANY OTHER
WARRANTIES, EXPRESS OR IMPLIED. SELLER NEITHER ASSUMES NOR AUTHORIZES ANY PERSON
TO ASSUME FOR IT ANY OTHER LIABILITY IN CONNECTION WITH THE SALE OR USE OF THE
PREMISES SOLD HEREUNDER, AND THERE ARE NOT AGREEMENTS OR WARRANTIES, EITHER ORAL

Dear Mr. Nielsen:
Please be advised that this office represents William c. Fromm, the
builder of your home which was completed on or about August 30,
1994.
Mr. Fromm has consulted this office with regard to the basement
water problem. Although it is my opinion that this problem is
excluded by the limited builder's warranty and occurred more than
one (l) year after the closing, Mr. Fromm has indicated a
willingness to attempt to repair the problem.
On Mr. Fro~n's behalf, we are requesting that you demonstrate to
him the exact nature of the wacer problem and the location of the
leaks in the basement. After reviewing the problem, Mr. Fromm
would like an opportunity to repair the mortar and waterproof the
front brick. Although we cannot be certain at this time, Mr. Fromm
believes that these actions will be sufficient to alleviate the
problem.
I have advised my client that under no circumstances would you be
entitled to change the type of joint in the brick. The house that
you purchased was a spec house that contained a rake joint and not
a grapevine joint.
Although this defect is, in my op~n~on, not covered by the limited
warranty, Mr. Fromm's willingness to attempt repair must be in
accordance with the warranty. The warranty provides that work
would be done by Mr. Fromm or subcontractors chosen by him. Under
no circumstances is Mr. Fromm willing to permit repairs, which
would be covered under the warranty, by another mason.
It is my understanding that all the parties have handled this in an
amicable fashion. It further appears that providing Mr. Fromm with
an opportunity to inspect the nature of the defect and an
opportunity to repair it is in everybody's best interest.
