MOTION TO COMPEL
AND NOW, comes the Defendant, Joyce A. Long, by and through her
attorney, John C. Swartz, Jr., hereby moves this Court to enter an Order pursuant to Pa.
R.C.P. 4019(a)(l)(i) directing Plaintiff to answer Defendant's Interrogatories and Request for
Production of Documents.
1. Plaintiff filed a Complaint against Defendant, Joyce A. Long, on or
about October 24, 1996. In addition, Claimant also filed a Writ of Summons against
Carolyn C. Slane on or about February 21, 1997.
2. Plaintiff's Complaint against Carolyn C. Slane is listed under Docket
Number 97-859 and has been consolidated with the Plaintiff's Complaint against Joyce A.
Long, Docket Number 96-4749 by Court Order dated June 3, 1997.

3. Prior thereto, Defendant, Joyce A. Long, served Interrogatories and
Request for Production of Documents upon the Plaintiff, Muriel Smith, on or about
November 18, 1996, A true and correct copy of said Interrogatories and Request for
Production of Documents are marked as Exhibit A and attached hereto and incorporated
herein.
4. Defendant Long, through counsel, has sent several requests to Plaintiff's
attorney, reminding Plaintiff's attorney that discovery was past due and that the Defendant
had not yet received answers to their Interrogatories and Request for Production of
Documents. Attached hereto and incorporated herein and marked as Exhibit B is a letter
dated February 12, 1997 from defense counsel to Plaintiff's counsel regarding discovery.
Also, attached hereto and incorporated herein and marked as Exhibit C is a second letter
dated March 24, 1997 addressed to Plaintiff's counsel, again indicating that discovery was
past due.
5. As of this date, the Defendant, Joyce A. Long, has not received any
answers to her discovery requests.
6. In addition, the Plaintiff has now scheduled the Defendant, Joyce A.
Long, for a deposition without providing Defendant discovery documentation.
7. Defendant, Joyce A. Long, served Plaintiff with answers to Plaintiff's
Request for Production of Documents and Interrogatories on or about January 6, 1997.
8. Defendant Long moves this Court to compel Plaintiff to answer said
Interrogatories and Request for Production of Documents or suffer sanctions.

4749 CIVIL TERM, an action by Plaintiff against Defendant, Joyce A. Long, to recover for damages
arising from the same automobile accident on November 9, 1995.
3. In both cases, the negligence of the parties arising out of the same occurrence is the basic'
issue and its determination will resolve the right to recover for damages and requested relief.

Rule to Show Cause.
4. On May 5, 1997, this Court granted issued the Rule to Show Cause directing all parties
to file an answer in response to the Rule within ten (10) days after service.
