Statement of Facts Plaintiff, Earl Leroy Deputy, Jr., filed a Complaint on February 20, 1997 alleging that he owned a J & J Chassie Limited Sprint automobile with a Chevrolet 358 cubic inch engine, and entered the same in automobile races. Plaintiff also alleged that in February of 1996 Plaintiff entered into an oral contract for the repair and maintenance for said Chevrolet racing engine. It is further alleged that in return for said advertised sponsorship recognition on the automobile that the Defendant, Fred Ricupero, agreed to perform maintenance and repairs for the cost of parts, and that he would defer his labor expenses and that any labor would be billed and paid in December of 1996 as compensation for advertising provided by the Plaintiff. Plaintiff alleges that on Tuesday, July 23, 1996, he delivered the aforementioned engine to Defendant for routine maintenance. Plaintiff also alleges that when he sought to pick up the engine on Friday, July 26, 1996, Defendant refused to deliver possession of the automobile unless Plaintiff would pay a bill for approximately Five thousand ($5,000.00) Dollars and 00/100 for the cost and labor supplied to Plaintiff relative to said engine. II. Issues 1. Preliminary Objection as to Paraaraph 10(2) speculative damages Plaintiff in his request for damages, demands Two thousand eighty ($2,080.00) Dollars and 00/100 as a sum in which he indicates he lost as a result of not being able to race in two (2) events on Saturday, July 27, 1996 and Saturday, August 3, 1996. This portion of Plaintiff I s alleged damages Plaintiff is requesting that be stricken from the Complaint as they are wholly speculative in nature. Lost profits must be an proximate consequence of breach, rather than merely remote or possible, to be recoverable under Pennsylvania Law. 13 Pa.C.S.A., ~ 2714(c), 2715, 2715(b1). See National Controls Corooration v. National Semiconductor Co~oration 833 F.2d, 491, 3rd Circuit. 1987. In the case of Dax, Plaintiff requests damages for lost profits in an automobile race. Clearly said lost profits would be totally speculative. There is absolutely no guarantee to no measurable standard that the Plaintiff would prevail in an automobile race. Therefore, Defendant respectfully requests that Paragraph 10(2) be stricken from Plaintiff's Complaint. 2. Preliminary Objection as to Paraqraph 1121 Punitive Damages Plaintiff in Paragraph Twelve (12) requests that punitive damages and alleges that the actions of the Defendant were reckless and irresponsible and calculated to create maxirr.um harm by the Defendant to the Plaintiff. In Pennsylvania, Plaintiff must allege that Defendant's actions are in the nature of an action in which can be considered outrageous because Defendant's evil motion or reckless indifference to the rights of others. In order to properly make such allegation, Plaintiff must specifically and particularly plead facts that support allegations of outrageous conduct or reckless indifference. Non-specific allegations of conduct which contain conclusions are not sufficient to support a claim of punitive damages. The factual allegations in Plaintiff I s Complaint fail to specifically plead facts that constitute outrageous conduct or demonstrate reckless indifference to the interest of Plaintiff, or otherwise support of claim in punitive damages. Moreover, Plaintiff alleges no fraud in his Complaint and under Pennsylvania Law absent fraud punitive damages are not recoverable in Bredch of Contract cases. See Adjusters Inc. v. Comouter Science Co~oration, 8181 F.Supp. 120 (E>D. Pa. 1993) See also Thorsen v. Iron Glass Bank, 476 A2d 928 (Pa. Super 1984) and Rittenhouse Reaency Affiliates v. Passen 482, A2d 1042, 333 Pa, Super 613 (1984). (Compl. ~ 9.) During this time, Plaintiff was unable to race in two events on Saturday, July 27, 1996, and Saturday, August 3, 1996. Plaintiff was also not given credit for parts he supplied, and Defendant received advertising value that was never paid. (Compl. ~ 10.) Plaintiff filed his Complaint in attempt to recover these damages he suffered. On March 13, 1997, Defendant filed Preliminary Objections to the Plaintiffs' Complaint. Plaintiff now responds to those objections in further attempt to resolve this matter. II. QUESTIONS PRESENTED I. he Plaintift's claims for lost purse winnings in two races in which he was unable to compete recognizable damages recoverable under Pennsylvania law? Suggested Response: YES 2. Is Plaintiff permitted to claim punitive damages against Defendant? Suggested Response: YES IlL ARGUMENT A. Plaintill's claims for lost nurse winninl!s in two races in which he was unable to comnlete are recol!nizable damal!es recoverable under Pennsvlvania law. Defendant objects that damages alleged in paragraph 10(c) of Plaintiffs complaint are "purely speculative" and so Defendant has moved to strike said paragraph. Plaintiff was unable to race his vehicle in two events because Defendant refused to deliver up possession of the vehicle's engine in violation of the parties' oral contract, Loss of the purse winnings and income from these two races are foreseeable damages. "Recovery for loss of profits under Pennsylvania law is allowed where such loss was caused by a plaintiffs inability to use property damaged, destroyed, or withheld bv defendant's wrongful conduct." AMIPM Franchise v, Atlantic Richfield Co., 373 Pa, Super. 572t 57St 2 542 A.2d 90, 92, (1988), all'd in relevant pan. rev'd in pan, 526 Pa. 110, 584 A.2d 915 (1989) (emphasis added). Withholding Plaintill's engine was wrongful conduct that prevented Plaintiff from being able to use his propeny. Plaintiff is therefore allowed to recover lost profits. The general rule oflaw applicable for loss of profits allows such damages when: "I) there is evidence to establish them with reasonable cenainty, 2) there is evidence to show that they were proximately caused by the wrongful act, and 3) in contract actions, they were reasonably foreseeable." Bolus v. United Penn Bank, 363 Pa, Super, 247,_,525 A,2d 1215, 1225 (1987). Little speculation is required to determine what profits could have been recovered were Plaintiff able to compete in both races. Purse winnings from the two events can be clearly established. And even so, "the law does not demand that the estimation of damages be completely free ofa11 elements of speculation." Delahantv V. First Pennsvlvania Bank. N.A" 318 Pa, Super. 90,_, 464 A.2d 1243, 1257 (1983). While the trier off act may not use sheer conjecture as a basis for arriving at a verdict, it may use a measure of speculation in aiming at a verdict or an award of damages, and an even greater degree of flexibility is granted in regard to testimony concerning prospective or future damages, which are at best, not always easy or cenain of ascenainment and are to large extent based on probabilities and uncenainties. . .. So then, mere uncenainty as to the mount of damages will not bar recovery where it is clear that the damages were the cenain result of the defendant's conduct. III at 1257. The reason for this rule is that the party in breach should not be a110wed to shift the loss to the injured party even though damages, while somewhat uncenair., were clearly the responsibility of the breaching party. Smith v, Penbridl!e Associates. Inc., 440 Pa, Super. 410,_,655 A.2d 1015, 1022 (1995). "Damages do not have to be determined with mathematical precision, but only a reasonable degree of cenainty." III at 1022. 3 By withholding the engine Defendant prevented Plaintiff from competing in both races. Damages to Plaintiff are therefore clearly the responsibility of Defendant, the party in breach. But for the Defendant's actions, Plaintiff would not have suffered damages. Defendant's reliance upon National Controls Com. v. National Semiconductor Corp" 833 F.2d 491 (3rd Cir, 1987), is misplaced. In that case, the plaintiff had not established that lost profits were proximately caused by the defendant's breach regardless of whether lost profits could be shown. IlL. at 499. Defendant's actions here were the proximate cause of Plaint ill's damages. Defendant also knew that the engine was used to race an automobile because advertising on the car was the very reason the Defendant entered into the oral contract. By withholding the engine Defendant knew Plaintiff would be unable to race. so lost profits from those two races are also reasonably foreseeable as they were within the contemplation of the parties. Knowing that without the engine Plaintiff would be unable to compete in races, Defendant was able to bill Plaintiff for labor costs in violation of the parties' oral contract. B, Plaintiff is permitted to claim punitive damages against Defendant, Plaintiff recognizes that generally punitive damages cannot be recovered in Pennsylvania for a breach of contract. Adiusten Inc. v, Computer Sciepce Corporation, 818 F.Supp. 120, 122 (E.D. Pa, 1993). The exception, however, is where a person's actions are of such an outrageous nature as to demonstrate intentional, willful, wanton or reckless conduct. SHV Coal. Inc. v, Continental Grain Co., 526 Pa, 489,_, 587 A.2d 702,704 (1991), Here, Defendant has exhibited at least a reckless indifference to the rights of Plaintiff. Plaintiff has specifically averred that Defendant refused to deliver possession of Plaint ill's property in breach of contract and beyond all reasonable discussion. Defendant's decision to retain possession of Plaintift's property was also accomplished suddenly and without warning. Defendant also knew that Plaintiff would be unable to race his vehicle. The damage to Plaintiff was therefore beyond just 4 mere monetary loss. Plaintiff lost important driving points toward the season's championship. (Compl. ~ 11.) Plaintiff has plead these facts in support of his allegations with sufficient specificity to infonn Defendant of the issues to be presented at trial. Defendant's extreme actions served no purpose but to reveal evil motives in preventing Plaintiff from racing his automobile. For these reasons, Plaintiff should have the opportunity to plead a claim of punitive damages. IV. CONCLUSION Although it is Plaintift's position that the facts as pleaded were sufficiently specific for purposes of providing an answer to Plain tift's Complaint, the Plaintiff is willing to amend said Complaint in order to provide further infonnation and details to Defendant. For the reasons set forth above, the Complaint of EARL LEROY DEPUTY should not be stricken for lack of confonnity to law and the Complaint should be upheld as stating a cause of action upon which relief may be granted. ORDER OF COURT AND NOW, this Z ~l~day of June, 1997, upon consideration of Defendant's preliminary objections to Plaintiff's complaint in the form of (I) a motion to strike a claim for lost profits arising out of an alleged breach of an automobile repair contract, on the ground that such damages would be too speculative and unforeseeable and (2) a motion to strike a claim for punitive damages arising out of such alleged breach, on the ground that punitive damages are not recoverable in such an action, it is ORDERED and DIRECTED as follows: ( I) Defendant's motion to strike the claim for lost profits is DENIED, the court being unable to hold at this preliminary stage of the case that no reasonable arbitrator or other trier of fact could award such damages under the lawl and (2) Defendant's motion to strike the claim for punitive damages is GRANTED. See Rittenhouse Regency Affiliates v. passen, 333 Pa, Super. 613, 482 A.2d I042 the parts, and he would defer his labor expenses. It is further denied that any labor would be billed and paid in December of 1996 as compensation for the advertising provided by the Plaintiff, Proof of Plaintiff's claim is demanded at the time of trial. 6, Denied in part and admitted in part. Defendant is without sufficient information to form an Answer as to whether on or about July 1996, the Plaintiff was racing his automobile at Silver Springs Race Track in Cumberland County, Pennsylvania. All information relative to this allegation being in the sole possession of Plaintiff. Therefore, Defendant denies this allegation. Admitted. It is admitted that Plaintiff delivered the engine to the Defendant on Tuesday, July 23, 1996 for routine maintenance. 7. Admitted in part and denied in part. It is admitted that while the engine was in the shop, the Defendant prepared a bill to date for the cost of various parts and labor supplied to Plaintiff and that the bill was for approximately five thousand and 00/100 ($5,000.00) Dollars. Denied. It is denied that this bill violated a contract between the parties. By way of further Answer, any implication with respect to paragraph seven (7) of Plaintiff's Complaint that a contract, as set forth in paragraphs four (4) and five (5) of Plaintiff's Complaint, existed is specifically denied. It is specifically denied that Plaintiff was unable to race in two (2) events on Saturday, July 27, 1996 and Saturday, August 3, 1996. It is also further denied that Plaintiff lost the sum of Two thousand eighty ($2,080,00) Dollars in purse winnings and income from the events. 3. Denied. It is specifically denied that Defendant received the value of Five hundred ($500.00) Dollars of advertising for which he never paid. It is further denied that the total owed by Defendant to Plaintiff is the sum of Two thousand eight hundred fifty-six ($2,856.13) Dollars and 13/100. Proof of Plaintiff's claim is demanded at the time of trial. 11. Denied. It is specifically denied that Plaintiff sustained the above damages by the actions taken by Defendant without any warning. It is further denied that Defendant knew that his actions would cause harm to the Plaintiff. It is further denied that Plaintiff lost important driving points towards the season championship, Proof of Plaintiff's claim is demanded at the time of trial, 12, Denied. The averment as set forth in Paragraph (12) of Plaintiff's Complaint is denied pursuant to the Order dated June 27, 1997 by the Honorable Judge J. Wesley Ohler, Jr" striking Plaintiff's claim for punitive damages in this matter. However, by way of complete Answer, Defendant specifically denies that the actions of Defendant were reckless and irresponsible and calculated to create the maximum harm by the Defendant to the Plaintiff.
