PETITION FOR STAY OF EXECUTION PURSUANT TO Pa.R.C.P. 31211b1121
AND NOW, come the Defendants, Defense Activities Federal
Credit Union and Cumis Insurance society, Inc., by and through their
attorneys, Edward D. Klym, Esquire and KLYM, OLSZEWSKI & NEDLIK, and
file the following Petition for stay of Execution Pursuant to
Pa.R.C.P. 3121 (b) (2):
1. On February 19, 1997/ Plaintiff filed a Praecipe for
writ of Execution against Defendants in the amount of $144,441.27,
which represents allegedly unpaid medical expenses due pursuant to
the Order of Workers' compensation Judge James D. Deeley circulated
on November 14, 1996.
2. Defendants .appealed the Order of the Workers'
compensation Judge and requested a supersedeas from the Workers'
Compensation Appeal Board. The Board denied said request on
December 20, 1996.
3. On February 7/ 1997/ Defendants issued payment to
plaintiff and her counsel in the amount of $107,144.71 and
$26,786.18, respectively, representing the total amount of deferred
compensation and interest allegedly due. Bi-weekly payments were
then resumed as of February 18, 1997/ to Plaintiff and her counsel
in the amounts of $628.43 and $157.11/ respectively.
4. On February 18, 1997/ Defendants issued payment to
Plaintiff in the amount of $48,052.28, representing the unpaid
medical expenses and interest allegedly due from November 21, 1991
through July 21, 1996. Defendants aver that the amount claimed by
Plaintiff in the Praecipe for writ of Execution must be reduced for
reasons hereinafter stated.
5. Defendants have properly reprlced the bills
representing treatment incurred after August 31, 1993, pursuant to
77 P.S. Section 531(3) (i), which provides that no provider may
charge in excess of one hundred thirteen (113) percent of the
prevailing charge at the seventy-five (75) percent applicable fee
schedule, DRG payment, or the Medicare reimbursement mechanism.
Furthermore, the Workers' Compensation Bureau regulations require
the employer/carrier to assume responsibility for the repricing of
submitted bills. (See 34 Pa. Code Section 127.1 et seq.)
6. Additionally, as the underlying Workers' Compensation
action arose out of a motor vehicle accident allegedly sustained in
the course of employment, certain medical bills now claimed by
plaintiff have, in fact, been paid by automobile insurance carriers.
7. Defendants aver that a stay of execution as to all or
any part of the property of Defendants is warranted based upon the
equitable grounds heretofore stated.

AND NOW, comes the Plaintiff, Nancy Toribio, by her attorneys,
Angino & Rovner, and responds to Defendant's Petition for Stay of
Execution Pursuant to Pa.R.C.p. 3121(b) (2), in the following
fashion:

Admitted that
Defendant paid back wage benefits in the amount set forth in its
Petition. Denied that biweekly payments have been resumed as of
February 18, 1997.
4. Denied as stated. Defendant's check for unpaid medical
expenses and interest in the sum of $48,052.28 was received on
February 24, 1997. It is denied that such amount satisfies or is
equal to the medical expenses and interest due to Plaintiff. To
the contrary, the Defendant still owes a balance of $96,388.99.

Plaintiff explicitly denies that Defendant has the right to reduce
the Judgment already entered upon it.
5. Denied. Defendant claims the right to reduce medical
treatment bills after August 31, 1993. However, Defendant has
provided no basis for the calculation by which it reduces a
Judgment in excess of $144,000 to $48,052.28 on the basis of the
claimed calculation. Further, such reduction was not asserted by
the Defendant before the Workers' Compensation Referee prior to the
Referee entering the Order upon which the judgement is based.
Defendants cannot now collaterally attack the size of the Judgement
using matters that should have been raised before the adjudicative
body who determined the amount of Judgment.
6. Admitted that some medical bills were paid by Plaintiff's
motor vehicle carrier. Denied that Defendant is entitled to an
offset on the basis of the automobile coverage as Worker's
Compensation payments, not automobile payments, were primary at the
time of Plaintiff's accident.
7. The allegation herein states a conclusion of law. By way
of further response, Defendant had notice of the Judgment and its
amount. Defendant at no time asserted any of the defenses alleged
herein prior to the execution being ordered. staying the execution
will substantially delay Plaintiff from receiving money ordered by
a competent authority under a statute requiring payment within 30
