During the past five (5) years, the children have resided with the following persons and at the following addresses: a. January, 1992 - January, 1993 - with Plaintiff and Defendant at 81 Newport Road, Duncannon, Pennsylvania. b, January, 1993 - July, 1993 - with Plaintiff and Defendant at R.D, #4, Box 91, Landisburg, Pennsylvania. c. November, 1996 - Present - with Defendant and her now husband Michael Higgins at 112 High Street, Enola, Pennsylvania 17025. 7, The mother of the children is Stacey M. Higgins, currently residing at 112 High Street, Enola, Pennsylvania 17025. She is currently re-married. 8. The father of the children is Kenneth L. Beers, currently residing at 647 Herrin Lane, Enola, Pennsylvania 17025. He is currently single/divorced. 9. The relationship of Plaintiff to the children is father. The Plaintiff currently resides with no other persons. 10, The relationship of Defendant to the children is mother. The Defendant currently resides with Michael Higgins, her husband. -2- 11. plaintiff has not participated as a party or witness, or in another capacity, in other litigation concerning the custody of the children in this or another court, 12. plaintiff has no information of a custody proceeding concerning the children pending in a court of this Commonwealth. 13, Plaintiff does not know of a person not a party to the proceedings who has physical custody of the children or claims to have custody or visitation rights with respect to the children. 14. Each parent whose parental rights to the children have not been terminated and the person who has physical custody of the children have been named as parties to this action. 15. The best interest and permanent welfare of the children will be served by granting the relief requested because the mother continuously refuses to provide a means or schedule of regular partial custody for father and children, Father has been attempting to seek amicable reg~lar partial custody for the emotional well-being of him and his children, Father also pays regular support for the children. Mother has continuously refused a regular schedule for partial custody and will not conform to any amicable agreement nor enter into a written agreement or stipulation of partial custody. Father cannot further tolerate mother I s use of the children I s custody as a tool to aggravate, punish and/or control him and requests the court intervene. -3- 3. Father shall have the following holidays: Memorial Day weekend, and Christmas Eve day from 9:00 a.m. until 7:00 p.m. 4. Mother shall have the following holidays: Easter Sunday, Labor Day, and Christmas Day. 5. The parties will alternate Thanksgiving with Mother having Thanksgiving in 1997 and all odd.numbered years thereafter and Father shall have Thanksgiving in 1998 and all even.numbered years thereafter. This period of partial custody and visitation shall be from 9:00 a.m. until 7:00 p.m. 6. Mother shall have the children on Mother's Day and Father shall have the children on Father's Day. These periods of partial custody and visitation shall be from 9:00 a.m. until 7:00 p.m. 7. Each party will be entitled to three (3) weeks of summer vacation with the children. Father's weeks of summer vacation shall occur such that he has one week in June, and two weeks in August. These two weeks in August may be consecutive and uninterrupted. Present for the conference were the Father, Kenneth Lee Beers, and his counsel, Arthur K, Oils, Esquire; the Mother, Stacey Marie Higgins, and her counsel, Michael 0, Rentschler, Esquire, 3, The children are presently in the custody of Mother, Father petitioned to modify custody during the school year to grant him primary physical custody because of the following concerns and allegations: The Mother drinks to excess and works at a bar nearby her home, Mother is giving the child too much Ritalin which Is causing him to be sedated and lethargic, Mother's estranged husband is coming around late at night and making so much noise outside that it is disturbing the oldest child, Mother uses offensive language around the children, the children are upset about Mother's boyfriend is staying overnight at the home frequently, Mother has left the children unsupervised, and because of the combination of the lack of supervision and proximity to the bar he fears for the children's safety. He believes Mother does not provide adequate assistance with homework resulting in poor school performance, 4, Mother's position on custody is that custody should remain as It Is presently structured, She works inside the home as a medical transcriptionist and believes she Is better suited to care for the children who have been in her primary custody for approximately nine (9) years. Mother states that she quit working at the bar approximately NO, 97-890 CIVIL TERM two (2) weeks ago. She denies that she has been drinking to excess and says she makes a point of not drinking when the children are in her care. She has acknowledged that she left the children by themselves for brief periods of lime but points out that the oldest child Is 12 years old, She states that the parties oldest child has failed four (4) major subjects three (3) out of four (4) marking periods last school year, She attributes this to the child's refusal to take the Ritalin which has been prescribed for him. Father and paternal grandfather object to the use of stimulant medications. Mother would like to retain primary custody during the school year and would like to eliminate the overnights during the school week. 5. Issues upon which the parties agreed: That the parties should share custody during the summer on a week-on week-off basis, 6.
