5. On or about January 4, 1991, the Officc of Thrill Supcrvision appointed the
Resolution Trust Corporation, ("RTC"), as receivcr for First Fcderal Savings and Loan Association,
successor to First United, ("First Federal").
6. As a result of its appointment, the RTC, by operation of law, succceded to all rights,
powers, privileges of First Federal to, among other things, the Note and Mortgagc.
7. On April 23, 1993, RTC assigned the aforesaid Mortgage and Note to Plaintiff
pursuant to the terms of a certain Assignment of Mortgage, recorded in the office of the Recorder
of Deeds of Cumberland County at Mortgage Book Volume 442, Page 295.
8. Defendants are the record and real owncrs of the aforesaid mortgagcd premiscs.
9. Dcfendants are in default under the tcrms of the aforesaid Mortgage and Note for,
inter alia, failure to pay the monthly installments of principal and interest when due. Defendants are
due for the October I, 1996 payment.
10. On or about December 9, 1996, Defendants were mailed Notices of Homeowner's
Emergency Mortgage Assistance Act of 1983, in compliance with the Homeowner's Emergency
Mortgage Assistance Act, Act 91 of 1983. True and correct copies of said Notices are marked
Exhibit "C", attached hereto and made a part hereof.
II. On or about December 10, 1996, Defendants were mailed Notices of Intention to
Foreclose Mortgage in compliance with Act 6 of 1974,41 P.S. ~ 101, et scq. True and correct copies
of said Notices are marked Exhibit "D", attached hereto and made a part hereof.
