FAGAN Defendants CIVIL ACTION - LAW JURY TRIAL DEMANDED COMPLAINT AND NOW comes the Plaintiff, ROSEMARIE MOODY and CHARLES MOODY, III, her husband, by and through their attorneys, the LAW OFFICES OF TIMOTHY A, SHOLLENBERGER, and does respectfully represent the following: 1, The Plaintiffs, ROSEMARIE MOODY and CHARLES MOODY III, husband and wife, are adult individuals who currently reside at 108 Schoolhouse Road, Duncannon, Perry County, Pennsylvania 17020, 2, The Defendant, LEMOYNE SLEEPER COMPANY INC, is a Pennsylvania Corporation with its corporate office located at Third and Bosler Streets, Lemoyne, Cumberland County, Pennsylvania 17043. 3. The Defendant, JOSEPH D, FAGAN, is an adult individual whose last known address is 209 Louise Court, Enola, Cumberland County, Pennsylvania 17025, 4. L"'X 171il !H 1'I11! 6, At the aforesaid time and place, the Plaintiff, ROSEMARIE MOODY, was the operator of a 1988 Dodge Caravan owned by her husband, CHARLES MOODY III, 7. At the aforesaid time and place, the Defendant, JOSEPH D. FAGAN, was acting as the agent, servant and/or employee of the Defendant, LEMOYNE SLEEPER COMPANY INC" and was operating a 1989 Mitsubishi Truck within the course and scope of the agency and/or employment relationship with the Defendant, LEMOYNE SLEEPER COMPANY INC. 8, At the aforesaid time and place, the Plaintiff, ROSEMARIE MOODY, was travelling north on State Route 11 and was nearly stopped as she attempted to make a left-hand turn into the Decoven Diner located on State Route 11, Perry County, Pennsylvania, 9, At the aforesaid time and place, Defendant, JOSEPH D. FAGAN, was travelling north on State Route 11, directly behind the Plaintiff, when he failed to stop and collided with the rear of Plaintiff's vehicle, pushing her vehicle into the southbound lane of State Route 11 whereupon her vehicle impacted the first drive axle of a tractor driven by ROBERT R, KOCHER. The Plaintiff's vehicle was then struck a third time by the first set of duals on the trailer attached to the tractor being operated by Mr, Kocher. injuries, As a result of the aforesaid collision, Plaintiff, MOODY, has suffered serious and permanent including by not limited to the following: a. Severe strain and sprain of the muscles, tendon, ligaments and other soft tissues at or about the cervical spine; 10. ROSEMARIE b. FAX (i17l 214-11111 COMPANY INC" acting through its agent, servant and/or employee, JOSEPH 0, FAGAN, and the direct and proximate result of a negligence of Defendant, JOSEPH 0, FAGAN individually in operating the 1989 Mitsubishi, in a careless, reckless and negligent manner as follows: a, In failing to have his vehicle under proper and adequate control; b. In failing to apply his brakes in time to avoid a collision; c. In failing to observe Plaintiff's vehicle on State Route 11; d, In permitting or allowing the vehicle to strike and collide with the rear of the vehicle operated by the plaintiff; e, In failing to drive at a speed and in the manner that would allow defendant to stop within the assured clear distance ahead, in violation of 75 Pa, C,S.A. 93361; f, In driving in a careless disregard for the safety or property of the Plaintiff, in violation of 75 Pa,C,S,A. 93714; g.
