of the Conciliator's Report, it appearing that the parties have agreed to the terms
and provisions of this Order which was dictated in their presence and approved by
them and their counsel, it is hereby ordered and directed as follows:
1, All prior Orders in this case are vacated,
2. The parties shall share legal custody of their minor children,
Cecelia, d,o.b. August 25, 1989, and Marisa, d,o,b, October 2, 1990.
3, Mother shall have primary physical custody of the children
subject to periods of partial custody and visitation with Father as
follows:
A, On alternating weekends from Friday at 5:00 p,m,
until Sunday at 7:00 p,m, This alternating schedule shall
begin with the weekend of August 29, 1997, Father agrees
that he shall take the children to church on Sundays when they
are in his custody,
B, On Wednesdays from 4:30 p,m, until 7:00 p,m,
Father shall pick the children up from their after school
program unless he advises Mother in advance that he intends
to pick up the children directly from school.
4, The parties shall alternate the following holidays: labor Day,
New Year's Day, Easter, Memorial Day, and Fourth of July. This
alternating schedule shall commence with Father having labor Day in
1997, These periods of partial custody and visitation shall be from
9:00 a.m, until 7:00 p,m. The holiday schedule shall supersede the
other alternating weekend schedule,
5, The Thanksgiving holiday will be shared and will be broken
into two segments, Segment A shall be from 12:00 p,m, until 4:00
p,m,; Segment B shall be from 4:00 p,m. until 8:00 p,m. Father shall
have Segment A in 1997 and all odd years thereafter and Segment B
in 1998 and all even years thereafter, Mother shall have Segment A in
1998 and all even years thereafter and Segment B in 1997 and all odd
years thereafter,
6. The parties shall share the Christmas holiday, The
Christmas holiday shall be broken into two segments, Segment A
shall be from Christmas Eve at 12:00 noon until December 25th at
12:00 noon; Segment B shall be from December 25th at 12:00 until
December 26th at 12:00 noon, Mother shall have Segment A in 1997
and all odd years thereafter and Segment B in 1 998 and all even years
thereafter, Father shall have Segment A in 1998 and all even years
thereafter and Segment B in 1997 and all odd years thereafter,
7, Both parties shall be entitled to two (2) hours of time with
the children on their birthdays at the times to be agreed upon by the
parties.
8. Father shall have the children on Father's Day and Mother
shall have the children on Mother's Day, These periods of partial
custody and visitation shall be from 9:00 a,m, until 7:00 p,m,
9, Each party is entitled to two weeks of uninterrupted
vacation with the children, These may be taken consecutively, The
parties are to provide each other with thirty (30) days advance notice
as to when they intend to exercise these periods of vacation, The
parties shall also provide each other with a complete address and
phone number as to where they can be reached in the event of an
emergency when they are exercising their vacation period.
10, Father shall provide the transportation under this Order
unless otherwise agreed,
6, Defendant desires to protect the minor children from becoming involved in
these altercations,
WHEREFORE, Defendant prays this Honorable Court grant emergency relief
modifying the existing Custody Order to require supervised visitation, Supervision will be
by a party and at a location mutually agreed upon by the Defendant and the Plaintiff, This
emergcncy relief is requested until a conciliation can bc held to determine thc appropriate
custodial arrangemcnt for thc children,

7, During any pcriod of custody or visitation, thc parties shall not possess or use
any controlled substancc, ncither shall they consume alcoholic beveragcs to the point of
intoxication, The parties shalllikcwise assure, to the extent possible, that other household
members and/or guests comply with this prohibition,
8, The parties shall exert every reasonablc effort to maintain frec access and
unhampercd contact betwcen the children and each of the parties, and to foster a feeling of
affection between the children and thc other party. Neither party shall do anything that may
estrange the children from the other party, or injure the children's opinion of their Mother or
Fathcr, or that may hamper the free and natural development of the childrcn's love and
respect for the other party,
9, It is understood and stipulated hy thc parties that upon mutual agrcement, an
expanded or altcred schcdule may be agreed upon hctween the parcnts for and in thc best
interest of the children,
