STIPULATION AGAINST LIENS
THIS AGREEMENT made the eX {, -ft, day of February,
1997, by and between W. Lee Roland, Builder, of 337 West
Meadow Drive, Mechanicsburg, Pennsylvania, hereinafter
referred to as Contractor, and Erwin H. Pepmeier, Jr. and
Margaret Simons Pepmeier, Co-trustees of the Pepmeier Family
Trust, of 3610 Kings Point Road, Randallstown, Maryland,
hereinafter referred to as Owner, whereby the former
undertook and agreed to erect and construct a residential
dwelling on that certain lot of ground stiuate in Silver
Spring Township,Cumber1and County, Pennsylvania, being Lot
No. 119 on the Major-Final Subdivision Plan for The
Peninsula (Phase II as recorded in the Cumberland County
Recorder of Deeds Office in Plan Book 65, Page 28. Being
part of t.he same premises which Silver Spring, Inc., a
Pennsylvania corporation, by its Deed dated January 24, 1994
and recorded in the Cumberland County Recorder of Deeds
Office in Deed Book 101, Page 462, granted and conveyed unto
Sample Bridge Associates. Also being the same premises
which Sample Bridge Associates by Deed dated February ~,
1997, and about to be recorded herewith, granted and
conveyed unto Erwin H. Pepmeier, Jr. and Margaret Simons
Pepmeier Co-trustees of the Pepmeier Family Trust.
NOW TBBUI'OU, THIS AGREEMENT 1fITNBSSZTH:
said Contractor, for and in consideration of the
($1.00) Dollar to him in hand paid by Owner, the
whereof is hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, nor by any of the
materialmen and workmen, and all parties acting through or
under them, covenant and agree that no mechanic's liens or
claims shall be filed or maintained by them or any of them
against the said buildings and the lot of ground appurtenant
thereto for or on account of any work done or materials
furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above
described, and the said Contractor, for themselves, their
subcontractors, nor by any of the materialmen and workmen,
and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens
or claims against the said buildings or any of them and
agree that this instrument, waiving the right of lien, shall
be an independent covenant.
