I, WILMA MIlCDONALD, of the Borough of Camp lIill,
Cumberland County, Pennsylvania, make, publish and declare
this to be my Last Will and Testament, hereby revoking and
making void any and all wills previously made by me.
1.
I direct the payment of all my just debts as soon after
my death as may be ~onvenient for my Executor hereinafter
named.
II.
I direct that my body be cremated and that the expense
thereof be reimbursed out of my estate.
III .
I devise and bequeath all the rest, residue and
remainder of my estate of every nature and wherever situate
unto my children, Kenneth R. MacDonald, Jr. and Mrs. Cristine
Leggiero, to be equally divided.

Jr., Executor of the Eetate of Wilma MacDonald, post a bond in the
amount of $90,000.00 as security for the full and complete disCharge
of his fiduciary duties according to law as said Executor.

Christine Leggiero, being named successor executor in the event that
Kenneth R. MacDonald, Jr., was unable to serve as executor.
5. The decedent, in her will, did not specifically waive the
requirement of a bond.
6. Kenneth R. MacDonald,Jr., and Christine Leggiero are the sole
heirs and residuary legatees of the decedent.
7. As the executor in this matter is a resident of the State of
West Virginia and none of the exceptions for requirement of the
posting of a fiduciary bond under Section 3174 of the Probate, Estates
and Fiduciaries Code are met in this case, the Register of Wills has
requested that Kenneth R. MacDonald, Jr., as executor, post a fiducia-
ry bond with the Register of Wills.
8. The decedent died holding real estate having an approximate
fair market value of $150,000.00 situate at 205 North 25th Street,
Camp Hill, Cumberland County, Pennsylvania, and approximately
$600,000.00 in personal property.
9. Based upon the approximate values of the real and personal
property added together, the estimated total state inheritance tax due
to the Department of Revenue in this matter would be 6% of $750,000.00
or $45,000.00.
10. Your petitioner believes that a bond posted in the amount of
$90,000.00, being twice the potential Pennsylvania Inheritance Tax due
in this matter, is adequate, sufficient and appropriate.

JOINDER AND CONSENT
I, Christine Leggiero, hereby join in the Petition Under Section
3175 of Probate, Estates and Fiduciaries Code to Set Amount of Bond
filed in the estate of my mother, Wilma MacDonald, and consent to the
posting of a fiduciary bond in the amount of $90,000.00 by my brother,
Kenneth R. MacDonald, Jr., as Executor of the estate as security for
the performance of his fiduciary obligations in the administration of
said estate.

by and between the ESTATE OF WILMA MacDONALD, party of the first part,
hereinafter called "Seller", and JOHN DUNKLE and NANCY M. HALL,
parties of the second part, hereinafter called "Buyer",

The parties hereto, intending to be legally bound, hereby
promise, declare and agree as follows I
1. Seller agrees to sell and convey to Buyer and Buyer
agrees to purchase all of the real estate and improvements thereon
known as 205 North 25th Street, Camp Hill, Cumberland County, Penn-
sylvania, for the purchase price of One Hundred Thousand and NO/100
($100,000.00) Dollars to be paid as follows I
a. Five Thousand and NO/100 ($5,000.00) Dollars, the
receipt of which is hereby acknowledged at or before the signing of
this agreement.
b. The balance of Ninety-five Thousand and NO/100
($95,000.00) Dollars shall be due and payable at settlement by
cashier's check, certified check or such other form of immediate
available funds as is acceptable to Buyer.

7. Seller represents and warrants that no municipal or
other governmental improvements affecting the premises are, as of the
date hereof, in the course of construction or installation and to the
best of Seller's knowledge no such improvements have been ordered to
be made.
B. Seller represents and warrants that all street paving,
curbing and other municipal or other governmental improvements which
have been constructed or installed have been paid for and will not
hereafter be assessed and all assessments heretofore made have been
paid in full.
9. This agreement contains the whole agreement between the
parties and there are no other terms, obligations, covenants, repre-
sentations, statements or conditions, oral or otherwise, of any kind
whatsoever and it may not be altered, amended or modified other than
in writing executed by the parties hereto.
10. Failure of Seller to insist on strict performance by
Buyer of the terms of this agreement, shall not be construed as a
waiver, release or relinquishment thereof.
11. In the event that any defects exist that would not make
the title to the premises good and marketable as herein provided,
Seller shall have a reasonable time to correct same after being
apprised thereof by the Buyer.

12. All payments, notices and do~uments required by this
agreement shall be sufficiently delivered, if mailed by certified
mail, postage prepaid, return receipt requested or personally deliv-
ered to one of the parties to this agreement as follows:

or at such other addresses at which the other party desires to receive
written notice as directed in writing.
13. Buyer agrees that he has inspected the premises herein
involved and no representations have been made by the Seller as the
condition of the premises. The premises are purchased in the present
condition.
14. Buyer warrants that no broker was instrumental or
involved in any way in negotiating this transaction.
15. Seller warrants that no broker was instrumental or
involved in any way in negotiating this transaction.
16. Formal tender of an executed deed and of the purchase
money is hereby waived.

17. Whenever used herein the singular number shall include
the plural and the plural shall include the singular and the use of
any gender shall include all genders and the words Seller and Buyer
wherever used shall include their heirs, executors, administrators,
successors and assigns, except where otherwise herein provided. The
obligations, responsibilities and liabilities of the Buyer shall be
both joint and several.
lB. No delay or omission of either party thereto to
exercise any right or power accruing upon any non-compliance or
default by the other party with respect to any of the terms, covenants
or conditions of this agreement shall impair any such right or power
or be construed to be a waiver thereof.
19. Settlement herein shall occur on or before December 23,
1994, at the offices of Stone LaFaver & stone, 414 Bridge Street, New
cumberland, Pennsylvania, or such other location as agreed to by the
Seller and the Buyer.
20. Property taxes, fees for trash service and all other
items involving the premises that are capable of becoming a lien on
the premises on failure to make payment thereof or are customarily
pro-rated shall be pro-rated as of the day of settlement. Township
and county taxes shall be pro-rated on a calendar year basis and
school taxes shall be pro-rated on the basis of fiscal year July 1 and
June 30 of the following year. Any fuel oil remaining in the fuel oil
tank at settlement shall become the property of the Buyer and is
included in the purchase price.

21. Buyer shall have the right, at Buyer's expense, to have
the premises inspected for termites and similar infestations before
settlement so long as same is done in ample time so as not to prevent
settlement and in the event there is any active infestation at the tie
thereof then the Seller shall have the option to correct the same or
terminate agreement and return to Buyer all monies paid on account of
the purchase price.
22. Buyer shall have the right at Buyer's expense to have
tests made of the property for the detection of Radon gas and in the
event Radon gas is present on the said premises to a degree that meets
or exceeds the present day DER standards of four picocuries making the
said premises dangerous for human habitation then Buyer shall have the
option to terminate this agreement and have all monies paid on account
of this agreement refunded, unless Seller, at Seller's expense, elects
to take such measures to reduce the overall Radon level to four
picocuries or less.
23. Time is of the essence in this agreement.
24. Risk of loss or damage to the premises from fire, storm
or other causes shall be liability of Seller up to settlement; in the
event such loss does occur which cannot be reasonably corrected within
thirty (30) days from the date thereof then this agreement shall be
null and void and down payment refunded to Buyer unless Buyer is
willing at option of Buyer to accept the premises as damaged and have
subrogated to Buyer all Seller'S interest in existing insurance

policies, all insurance information on premises to be delivered by
Seller to Buyer on demand.
25. To the best of Seller's knowledge, all plumbing,
heating, mechanical and electrical systems and equipment are and will
be in proper working order at time of settlement.
26. This agreement shall be contingent upon the Buyer's
obtaining mortgage financing in the amount of Seventy Thousand and
NO/lOa ($70,000.00) Dollars for a term not to exceed thirty (30) years
at an annual interest rate not in excess of nine and a half (9 ~%)
percentum per annum. Buyer acknowledges that settlement is set for on
or before December 23, 1994, and should Buyer be unable to obtain
financing as provided above within said period due to the mortgage
lender's failure to properly or promptly process Buyer's loan applica-
tion promptly, in that event Seller shall have the right to declare
this agreement null and void and retrain all deposit money paid by
Buyer as liquidated damages for such breach. The Buyer shall submit a
completed application for such financing to a reputable and responsi-

PETITION TO EXCUSE EXECUTOR FROM ENTERING
ADDITIONAL SECURITY UNDER SECTION 3351 OF
PROBATE, ESTATES AND FIDUCIARIES CODE
TO THE HONORABLE JUDGES OF THE SAID COURT:
The petition of Kenneth R. MacDonald, Jr., Executor of the Estate
of Wilma MacDonald, deceased, respectfully requests this Court to
excuse him from entering additional security and in support thereof
avers as follows:
1. On or about August 23, 1994, your Petitioner filed with this
Court a petition under Section 3175 of the Probate, Estates and
Fiduciaries Code to set amount of bond.
2. On August 26, 1994, this Court entered an order requiring the
Petitioner to post a bond in the amount of $90,000.00 as security for
the full and complete discharge of his fiduciary duties according to
law as Executor. Petitioner has posted a bond in the amount of
$90,000.00 as ordered by the Court.
3. Your Petitioner incorporates by reference herein all aver-
ments set forth in the petition of August 26, 1994.
4. The Petitioner has entered into a written sales agreement to
sell the real property of the decedent situate at 205 North 25th
Street, Camp Hill, cumberland County, Pennsylvania, for $100,000.00.

A true and correct copy of the agreement of sale is attached hereto as
Exhibit "A" and incorporated by reference herein.
6. The Order of the Court of August 26, 1994, and the bond
amount of $90,000.00 were based upon the approximate values of the
real and personal propertv of the decedent added toqether.
7. As the sales price for the real estate is less than the
approximate fair market value of $150,000.00 averred in paragraph 8 of
the Petitioner's petition of August 23, 1994, your Petitioner respect-
fully requests this Honorable Court to excuse him from entering
additional security.
8. Petitioner also requests this Honorable Court to authorize
the payment of all proceeds from the sale of such real estate to him
as Executor for the Estate of Wilma MacDonald as required under
Section 3351 of the Probate, Estates and Fiduciaries Code.
WHEREFORE, your petitioner, Kenneth R. MacDonald, Jr., respect-
fully requests this Court to enter an order excusing him from entering
additional security and authorizing the payment of the proceeds of the
sale of such real estate to him as Executor for the Estate of Wilma
MacDonald.

erected thereon, situate in the Borough of Camp
Bill, County of Cumberland and state of Pennsylvania,
being known as 205 North 25th street, Camp Hill, which
Arthur C. Hursh and Eleanor T. Hursh, his wife, by
their deed dated August 29, 1950, and recorded August
29, 1950, in the Office of the Recorder of Deeds
