COMPLAINT
AND NOW, comes Financial Trust Company, through its attorney, William A. Duncan,
Esquire, and files this Complaint, of which the following is a statement:
1. Plaintiff is Financial Trust Company, a corporation organized and existing under the laws
of the Commonwealth of Pennsylvania with its main office and principal place of business located
at I West High Street, Carlisle, Cumberland County, Pennsylvania 17013,
2, Defendant, RONALD L, KEPNER, an adult individual, and Defendant, SHARON E,
KEPNER, an adult individual, are husband and wife, and reside at 1472 Zimmennan Road,
Carlisle, Cumberland County, Pennsylvania,
3, On or about FebrullI)' 23, 1995, Defendants made, executed and delivered to Plaintiff a
note financing Six Thousand and 00/100 Dollars ($6,000,00), a copy of said note being attached
hereto as Exhibit" A" and is incorporated herein by reference as though fully set forth,
4, On or about September 5, 1995, Defendants made, executed and delivered to Plaintiff
an Agreement To Modify Note in the amount of Six Thousand and 00/100 Dollars ($6,000,00), a
copy of said modification being attached hereto as Exhibit "B" and is incorporated herein by
reference as though fully set forth,
5. Said note has not been assigned,
6, Judgement has not been entered on the aforesaid note in any jurisdiction,
7, Said note is in default because Defendants herein have failed to pay the amount owing
under the note which is now mature,
8, By reason of the aforesaid default, the entire principal balance of Six Thousand and
00/100 ($6,000,00) Dollars, with interest thereon at the rate of 9.75 % per annum computed
from November 7, 1996 and attorney's fees in the amount of Nine Hundred and 00/100 Dollars
($900,00) are now due and payable,
9, The Defendants are liable to the Plaintiff for the following
A. Principal amount and interest
due to date $ 6,206.38
B, Attorney's Collection fee:
900,00
TOTAL $7,106,38
WHEREFORE, Plaintiff prays the Court to enter judgment in favor of Plaintiff for the
amount of Seven Thousand One Hundred Six and 38/100 ($7, I 06,38) Dollars together with
interest thereon, costs and all other amounts advanced by Plaintiff.
