SIIPULATlQN AGAINST LIENS
WHEREAS, Kenneth E. Wertz and Carolyn W. Wertz, of Hampden
Township, Pennsylvania, is about to execute contemporaneously herewith, a contract
with Perkins Construction, Inc. of 1031 Mountain Road, Dauphin, Pennsylvania, for
the erection of a 3 bedroom ranch house upon a lot of land situate as follows:
ALL THAT CERTAIN parcel of land situate in Hampden Township,
Cumberland County, Commonwealth of Pennsylvania, more particularly bounded and
described to wit:
BEGINNING at a concrete monument on the eastern right-of-way line
of Valleybrook Drive, said point being located at the northernmost corner of Lot No,
50 of the Final Subdivision Plan of Hampden Hearth - Phase II recorded in the
Cumberland County Courthouse in Plan Book 66, Page 31; thence along the eastern
right-of-way line of Valleybrook Drive North 33 degrees 32 minutes 35 seconds East
a distance of 105.00 feet to a point on the eastern right-of-way line of Valleybrook
Drive at the westernmost corner of Lot No, 35 of the Final Subdivision Plan of
Hampden Hearth - Phase V recorded in the Cumberland County Courthouse in Plan
Book 59, Page 111; thence along said Lot No. 35 South 56 degrees 29 minutes 34
seconds East a distance of 112,86 feet to a point on the western line of Lot No, 104
of the Final Subdivision Plan of Hampden Hearth - Phase IV recorded in the
Cumberland County Courthouse in Plan Book 68, Page 66; thence along said Lot No.
104 and continuing along Lot No, 105 of said Hampden Hearth - Phase IV Plan
South 21 degrees 28 minutes 05 seconds West a distance of 107.45 feet to a point
at the easternmost corner of the above referenced Lot No, 50; thence along said Lot
No, 50 North 56 degrees 27 minutes 25 seconds West a distance of 135.34 feet to
a point on the eastern right-of-way line of Valleybrook Drive at the northernmost
corner of said Lot No. 50, the POINT OF BEGINNING.
THE ABOVE-DESCRIBED TRACT BEING KNOWN AS Lot No. 36 of the
Final Subdivision Plan of Hampden Hearth - Phase V recorded in the Cumberland
County Courthouse in Plan Book 59, Page 111, The above described tract containing
13,034.90 square feet, more or less,
THE ABOVE DESCRIBED-TRACT BEING SUBJECTTO various easements
of record as indicated on the above-referenced Subdivision Plan.
UNDER AND SUBJECT TO a utility easement sanitary and storm sewer
which run along the northern portion of said lot, said utility easement extended
across sanitary sewer easement for drainage purposes only, AND FURTHER UNDER
AND SUBJECT to an unnamed stream, a 60-foot drainage easement centered on
existing unnamed stream, a 30-foot existing sanitary sewer easement (typ.), and a 100-
year flood limit, all of which run along the eastern portion of said lot.
NOW, the Jb* day of~\\ \ Q rl ~ ' 1997, at the
time of and immediately before the execution of the rincipal contract, and before
any authority has been given by the said Kenneth E. Wertz and Carolyn W. Wertz,
to the said Perkins Construction, Inc. to commence work on the said building, or
purchase materials for the same in consideration of the making of the said contract
with Perkins Construction, Inc, and the further consideration of One Dollar, to
Perkins Construction, Inc, paid by Kenneth E, Wertz and Carolyn W. Wertz, it is
agreed that no lien shall be filed against the building by the contractor, or any sub-
contractor, nor by any of the material men or workmen or any other person for any
labor, or materials purchased, or extra labor or materials purchased for the erection
of said building, the right to file such liens being expressly waived.
