Box D, Q'l7 , 1997, by Pine Road, and Mt. Holly springs, Pennsylvania, hereinafter referred to as Contractor, AND HOPE UNITED METHODIST CHURCH, of 6260 Carlisle Pike, Mechanicsburg, Pennsylvania, hereinafter referred to as Owner, whereby the former undertook and agreed to perform certain General Construction Work for the Additions and Alterations to the Hope united Methodist Church on those three tracts of ground situate in Hampden Township, Cumberland County, Pennsylvania, being more fully described in Exhibit "A" which is attached hereto and incorporated herein. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of One ($1.00) Dollar to it in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right Legal Description tor Hope United Methodist Church , ,~ ALL those certain three (3) tracts of land situate in Hampden Township, Cumberland County, being bounded and described as follows, to wit: TRACT NO, 1 BEGINNING at a post on the line of Jacob Bricker's land; thence along the Harrisburg Carlisle and Chambers burg Turnpike, South sixty seven and one half degrees East nine and three tenth perches to a stone; thence by land of said Abraham stayman whereof this is a part, South seven and three fourth degrees West seventeen perches to a stone, North eighty two and one fourth degrees West nine perches to a stone; thence by land of the said Jacob Bricker, North seven and three fourth degrees East nineteen and three tenth perches to the place of BEGINNING. CONTAINING one (1) acre and two (2) perches neat measure. BEING the same tract which Abraham Stayman and Eliza L. stayman, husband and wife, by deed dated october 27, 1828 and recorded August 5, 1881 in the Cumberland County Recorder of Deeds Office in Deed Book "5", Volume 3, Page 402, granted and conveyed unto John M. Heagy, Christian Stayman and Benjamin Eberly, trustees of the Salem Church, now known as the Hope United Methodist Church the mortgagor herein. TRACT NO. 2 BEGINNING at a post at corner of lands of the grantors herein and lands of the grantees herein: thence by land of said grantors South 7 degrees 24 minutes East one hundred twelve and five-tenth (112.5) feet to a post at land of Richard F. Hill and Helen F. Hill, husband and wife, trading as Hill's Mobile Homes; thence by lands of the said Hill, North 66 degrees 36 minutes West one hundred fifty-eight and 88/100 (158.88) feet to a stake; thence by the same, North 7 degrees 14 minutes East fifty and nine- tenths (50.9) feet to a stake at corner of land of the grantee herein; thence by said land of the grantee, South 89 degrees 45 minutes East one hundred fifty-four and 05/100 (154,05) feet to a post, the place of BEGINNING, BEING the premises which Deemer A, Marquart and Vesta H. Marquart, husband and wife, by deed dated March 12, 1955 and recorded May 16, 1955 in the Cumberland County Recorder of Deeds Office in Deed Book "K", Volume 16, Page 572, granted and conveyed unto the Trustees of the Salem Methodist Church, now know as the Hope United Methodist Church, the mortgagor herein.
