6. The Defendants assert that they are possession of the
real property in that they have hunted game on the lands and
have prevented anyone else from intruding upon the property as
evidenced by their removal pins placed by the Plaintiffs'
surveyor.
7, The Defendants have taken the actions as set forth in
paragraph six based upon their purchase of thirty three acres,
more or less, from Wilbur T. Kelso, Sr. and Hary H. Kelso, his
wi fe as evidenced by thei r deed dated April 14, 1992 and
recorded in Cumberland County Deed Book P, Volume 35, page
920, a copy of which is attached hereto as Exhibit "A".
8. In permitting the Plaintiffs to proceed where they
have failed to show they are in possession of the real
property would improperly enlarge the Plaintiffs' substantive
rights in that they would be presumed to be the party in
lawful possession of the property.
WHERE~ORE, the Defendants respectfully request that this
Honorable Court dismiss the Plaintiffs Complaint for failing
to set forth a cause of action in quiet title or in the
alternative direct the Plaintiffs to amend their complaint to
change the action to one in ejectment,

HOT ION FOR A HORE SPECIFIC PLEADING
9. In paragraph seven of the Plaintiffs' Complaint they
allege that:
Plaintiffs are presently in possession in that they
have asserted ownership rights over the subject real
estate, and have paid the real estate taxes assessed
on the premises.
10, The Defendants submit that they are unable to
respond to Plaintiffs' claim that they have paid the real
estats taxes without an averment as to what taxes have been
paid and for what time periods,
WHEREFORE, the Defendants respectfully request that this
Honorable Court direct the Plaintiffs to amend their complaint
to specify time period and type of taxes paid upon the real
property.

DEFENDANTS' PRELIMINARY OBJECTIONS TO PLAINTIFFS' COMPLAINT
AND NOW comes the Defendants, by and through their
attorney, Shawn D. Meyers, who make the following objections
to the Plaintiffs' Complaint:
I.
IMPROPER SUBJECT MATTER JURISDICTION
1. The Plaintiffs have filed an action to quiet title
in the above captioned matter alleging ownership of a piece of
unimproved mountain land currently owned by the Defendants and
located in Hopewell Township, Cumberland County , Pennsylvania.
The Plaintiffs filed their complaint on March 3, 1997 in the
Court of Common Pleas for Cumberland County.
2. On May 5, 1997, the Defendants filed preliminary
Objections to Plaintiffs' complaint.
3, On June 13, 1997, the Plaintiffs filed an Amended
Complaint in response to Defendants' Preliminary Objections.
In their Amended Complaint Plaintiffs continue to assert a
right to proceed in an action to quiet title.
4. An action to quiet title may only be brought where
an action in ejectment will not lie. 42 Pa.C.S.A. 1602(a) (2).
5. The Plaintiffs in their Amended Complaint make
numerous averments which allegedly support their claim of
possession of the real property in question, including:
A. The payment of real estate taxes to the Cumberland
County Tax Assessment Office;
B. The fact that they have hunted upon the real
property;
C. That they have permitted family and friends to hunt
the real property;

D. That they had the real property surveyed by a
professional surveyor, Glen D. Watson on April 27, 1996, which
confirms their ownership of the property;
E. The Plaintiffs have entered into an oral contract
with Robert Forester to remove lumber from the real property;
F. That one of the Plaintiffs, Donald A. Linn informed
one of the Defendants, Aaron Esh, of the Plaintiffs' ownership
of the real property surveyed by Glen D. Watson and that the
Plaintiffs have posted "No Trespassing" signs along the
boundary lines of the real property in question.
6. The Defendants assert that they are in possession of
the real property in that they hunt game upon the lands.
7. The Defendants also assert that following placement
of "No Trespassing" signs on their property by the Plaintiffs,
the Defendants promptly removed the signs and challenged the
actions of the Plaintiffs in their claim of possession of the
real property.
8. The Defendants have taken the actions as set forth
in paragraphs six and seven based upon their purchase of
thirty three acres, more or less, from Wilbur T. Kelso, Sr.
and Mary M. Kelso, his wife as evidenced by their deed dated
April 14, 1992 and recorded in Cumberland County Deed Book P,
Volume 35, page 920, a copy of which is attached hereto as
Exhibit "A".
9. The Defendants assert that they have a present
possessory interest in the disputed real estate they purchased
from Wilbur T. Kelso and Mary M. Kelso. At the time the
Defendants purchased the real property from Mr. and Mrs.
Kelso, they told the Defendants that the 5.1416 acres were
declared the property of Wilbur T. Kelso, Sr. and Mary M.
Kelso in a prior action before the Honorable Edgar B. Bayley,
Judge of the Court of Common Pleas of Cumberland County,
docketed as Civil Action No. 2995-1989 (A copy of Judge
Bayley's verdict and opinion dated May 23, 1991 is attached
hereto and more fully incorporated herein as Exhibit "B").
10. In the decision issued by Judge Bayley, the Court
found that the five (5) acre, sixteen (16) perch tract
overlapped onto the tract of land south of the present
Plaintiffs existing tract of land. The Court found that the
five (5) acre sixteen (16) perch tract did not overlap north
onto the lands of Mr. and Mrs. Wilbur T. Kelso, Sr., the
predecessors in title to the present Defendants.

11. Based upon the prior decision of this Honorable
Court, representation made by Mr. and Mrs. Wilbur T. Kelso and
the actions of the Defendants in hunting upon the property and
challenging the Plaintiffs' claim of possession, the
Defendants assert they are in present possession of the
property.
12. The Defendants assert that the Plaintiffs should not
be allowed to proceed with an action to quiet title where they
have failed to show they are in possession of the real
property.
13. In permitting the Plaintiffs to proceed where they
have failed to show they are in possession of the real
property would improperly enlarge the Plaintiffs' substantive
rights in that they would be presumed to be the party in
lawful possession of the property.
WHEREFORE, the Defendants respectfully request that this
Honorable Court dismiss the Plaintiffs Complaint for failing
to set forth a cause of action in quiet title or in the
alternative direct the Plaintiffs to amend their complaint to
change the action to one in ejectment.

BAYLEY, J., May 23, 1991:--
Plaintiff, John J. McDonald, as trustee for Carolyn Borkman,
filed a complaint against defendant, pierre Reasner. Plaintiff
averred that he is entitled to treble damages from defendant who,
without permission, cut and removed timber from what he describes
as his 5.059 acre tract of mountain land in Hopewell Township,
Cumberland County. Defendant joined Wilbur T. Kelso, as
additional defendant. Defendant had a written contract dated
July I, 1989, with additional defendant, that allowed him to
remove the merchantable timber from the property Kelso owned.
Therefore, defendant claims, if in fact, the trees he removed
were from the property of plaintiff rather than the property of
additional defendant, the additional defendant is liable to
plaintiff or liable over to him for any judgment that may be
entered in favor of plaintiff. The case was bench tried on May
16, 1991. The evidence at trial revealed the following.

By deed dated December 23, 1971, plaintiff purchased sixteen
tracts of land from Garnet L. and Dorothy V. Rosenberry.l The
tract on which plaintiff claims defendant cut his trees was
designated Tract No.2, and described as follows:
BEGINNING at a corner of stones thence by land now or
formerly of William Shoap, Sr., North 29~ degrees, West l~.l
perches to stonesl thence by land now or formerly of Philil
Miller, North 62 degrees East 52.9 perches to stones; thence
by land now or formerly of John Fogelsanger, South 38~
degrees, East l5.3 perches to stonesl thence by land now or
formerly of P. G. Shuman, South 62 degrees West 55.2 perches
to stones at place of beginning, CONTAINING 5 acres and 16
perches, more or less. .
Tract No.4 in the Rosenberry deed was described as follows:
BEGINNING at a post; thence by lands now or formerly of
Bruce Fyler, John Rebok and A. S. Shuman, north thirty (30)
degrees west one hundred twenty eight (128) perches to a
post and stones I thence by land now or formerly of John S.
Heberlig, north sixty one and one half (6l~) degrees east
thirty two and five tenths (32.5) perches to a post; thence
by lands now or formerly of Lloyd Coleman and property of
Oscar and Ernest Myers, south thirty eight and one half
(38~) degrees east one hundred twenty nine and three tenths
(129.3) perches to a post; thence by lands now or formerly
of Ebert Davis, south sixty-one and one half (6l~) degrees
west fifty two and five tenths (52.5) perches to the place
of BEGINNING.
CONTAINING 33 acres and 8l perches neat measure.
Plaintiff sold Tract No. 4 to additional defendant, by deed
dated March 28, 1989.2 Additional defendant and defendant claim
this was the tract on which defendant cut trees. Plaintiff has
since sold Tract No. 2 to John Weirether by deed dated March 4,

Plaintiff sold Tract No. 4 to additional defendant, by deed
dated March 28, 1989.2 Additional defendant and defendant claim
this was the tract on which defendant cut trees. Plaintiff has
since sold Tract No. 2 to John Weirether by deed dated March 4,

1989, and recorded January 26, 1990.3 However, in an agreement
with Weirether, dated March 4, 1989, plaintiff reserved the right
to harvest the timber on the property for a period of two years.
Accordingly, if defendant harvested the trees on Tract No. 2 on
which plaintiff reserved the right to the timber, rather than on
the property of additional defendant, plaintiff is entitled to
recover damages from defendant. In that case, additional
defendant, whose written contract with defendant warranted his
title to the timber he authorized defendant to cut, would be
liable to plaintiff and liable over to defendant.
Plaintiff's evidence as to ownership of the disputed Tract
No. 2 rests solely on the title conveyed to him by deed recorded
in Cumberland County Recorder of Deeds Book "K", Volume 24, Page
800. Plaintiff also admitted into evidence the deeds into his
predecessors in title to that tract, and Tract No.4 he sold to
additional defendant.
Edwin Breckbill, a professional land surveyor, testified for
the defense. He conducted the field work and prepared a survey
of Tract No. 4 that additional defendant purchased from plaintiff
on March 28, 1989. He also reviewed the deeds in the chain of
title to additional defendant's tract, plaintiff's Tract No.2
described as 5 acres and l6 perches, more or less, and a tract
deeded into Fred F. and Patsy L. Franklin, by their parents dated

August 4, 1977.4 The description of the land in the Franklin's
deed, is as follows:
BEGINNING at a stone; thence North sixty-two (62) degrees
East, fifty-five and two tenths (55.2) perches to a point in
line now or formerly of John Fogelsonger; thence South
thirty-eight and one-fourth (38-l/4) degrees East, twenty-
six and seven tenths (26.7) perches to a stone; thence by
land now or formerly of E. M. Harn, South sixty-one and
three-fourths (61-3/4) degrees West, sixty and one tenth
(60.1) perches to stones; thence by land now or formerly of
Z. Bashore, North twenty-seven (27) degrees West, thirteen
and one-fourth (l3-l/4) perches to a Dead Hickory; thence
North twenty-nine and one-fourth (29-l/4) degrees West,
thirteen (l3) perches to stones, the place of beginning;
containing nine (9) acres and seventy-two (72) perches,
strict measure.
The surveyor also examined deeds to other properties
bordering additional defendant's tract, which include another
large property of additional defendant adjoining to the
northeast.5 He traced the title in these deeds back to early
warrants recorded in Cumberland County.
With respect to the land additional defendant bought from
plaintiff, described as Tract No.4 in the Rosenberry deed into
plaintiff, the surveyor located the northeast and northwest
corners of the tract where it borders the land of John J.
McDonald. He set artificial monuments on those corners. At the
southwest corner, the surveyor found an existing iron pin and
stones, and witness marks on a tree. The pin and the marks were

very old. At the southeast corner, the surveyor found a very old
stone pile painted white, and three very old, grown over cut
marks on trees facing the actual corner. He found two other
marks, not as old as the ones at the southwest and southeast
corners, at points along the middle of the western boundary line
of the tract where it adjoins the eastern corners of a property
of Lee A. Burkholder. The surveyor found no monuments, marks or
other forms of designation, to delineate the northern line and
corners of the land designated as Tract No. 2 in the deed from'
Rosenberry into plaintiff, that plaintiff claims borders the
Franklin property to the south and the tract he sold to Kelso to
the north.
Utilizing the courses and distances in the deed of plaintiff
to Kelso, and running those lines between the artificial
monuments and the marks found in the field in accordance with the
courses and distances set forth in the deeds to the other
properties adjoining the tract, the surveyor produced a survey of
the lines and the ground of additional defendants tract, that
closed at 34.0l acres. The surveyor testified his survey is
accurate, and the tract of additional defendant (Tract No. 4 from
Rosenberry to plaintiff, then to additional defendant) borders on
the Franklin land to the south, (formerly the Shuman Tract), even
though the deed from Rosenberry of Tract No. 2 into plaintiff has
a course and distance to the south designated as being along the
land of Shuman. The surveyor further produced an overlay of the
various deeds, showing how he concluded that plaintiff's tract,
described as 5 acres and 16 perches, more or less, actually

overlaps with the Franklin Tract to the south, not with the tract
plaintiff conveyed to Kelso on which defendant harvested the
trees.6
In determining boundaries, evidence is considered in the
following order: natural monuments, artificial monuments,
adjacent boundaries, courses and distances, and quantity of
acreage. Howarth v. Miller, 382 Pa. 419 (l955). In Roth v.
Halberstadt, 258 Pa. Superior Ct. 40l (1978), the Superior Court
stated:
As a general rule, where there is a conflict between courses
and distances or quality of land and natural or artificial
monuments, the monuments prevail. Moreover, natural
monuments normally take preference over artificial marks or
monuments. These rules, however, are not imperative but are
merely aids in construction that must yield to a contrary
showing. (Citations omitted.)
Based on the evidence submitted by the surveyor, which is
the only evidence in the record as to where the tracts of
additional defendant and plaintiff lie on the ground, which
evidence we find credible, and all of the other evidence, we
conclude that additional defendant owns the land upon which
defendant cut the trees. The evidence from the field and an
examination of deeds admitted into evidence, satisfies us that
the survey using the artificial monuments and the marks at the
southeast and southwest corners, accurately represents the
southern boundary of the tract plaintiff deeded to Kelso. There
is no credible evidence to the contrary; in fact, there are no
monuments or marks to delineate the northern line of a separate

three (33) acres, more of less, from Wilbur T. Kelso, Sr. and Mary M, Kelso, his wife, as
evidenced by their deed April 14, 1992 and recorded in Cumberland County Deed Book P,
Volume 35, at Page 920. It is however denied, after reasonable investigation Plaintiffs' are
without knowledge and information sufficient to form a belief as to truth of the remaining
averments of Paragraph 8 and strict proof thereof is demanded at trial.
