5. Pursuant to the teoos of the Lease, Joseph Cumano was obligated to pay, on a monthly
basis, base rent in the wnount ofTwo Thousand Dollars ($2,000.00) through October 31, 1995 and
Two Thousand Five Hundred Dollars ($2,500.00) thereafter, common area maintenance rent in the
wnount of One Hundred Fifty-eight and 40/100 Dollars ($158.40), tax rent not to be less than One
Hundred Twenty-Three and 11/100 Dollars ($123.11) and insumnce rent in the wnount of Twenty-
Two and 00/100 Dollars ($22.00). All sums were to be paid on the first day of each cnlendnr month
during the Lease teoo, which was to expire without prior notice on the last day of the month next
following the tenth anniversary of the commencement date.
6. On or about February 6,1991, Defendants Helen Klinger and Amedeo Cumano entered
into an Assumption Agreement, whereby Defendants agreed, inter alia, to assume "the perfoooance
ofnll of the teoos, covenants and conditions of the Lease." A copy of the Assumption Agreement
is attached hereto, incorporated herein and marked Exhibit "C."
COUNT I
EJECTMENT
7. Paragmphs I through 6 are incorpomted herein by reference.
8. Defendants' current monthly rental obligations to Plaintiff under the Lease include base
rent in the wnount of Two Thousand Dollars ($2,000.00) through October 31,1995 and Two

12. Although Defendants have waived all rights to notice under the Lease, on February 3,
1997 Defendants were sent a notice of their rental arrearages and of their violation of the Lease. A
copy of the notice is attached hereto, incorporated herein and marked Exhibit "D." Defendants have
failed to pay the outstanding rental obligation.
13. Defendants arc presently in possession of the property.
WHEREFORE, Plaintiff requests that this Court enter judgment in favor of Plaintiff and
against Defendants, Helen Klinger and Amedeo Cumano, for possession of the premises owned by
Plaintiff and located in Upper Allen, Cumberland County, more fully described in Exhibit "A."
COUNT 11
BREACH OF CONTRACT
14. Paragraphs I through 13 are incorporated herein by reference.
IS. Pursuant to the Lease, Defendants' rental obligation for December of 1996 and January
and February of 1997, including base rent. common area maintenance rent, tax rent and insurance
rent, due and owing Plaintiff, is Seven Thousand Nine Hundred Sixty-Two and 01/100 Dollars
($7,962.01).
16. Pursuant to Paragraph 5(F) of the Lease, any rent not paid by TenantslDefendants when
due is subject to both interest at 1-1/2% per month and a Twenty-live Dollar ($25.00) late charge

for each overdue payment.
17. In the event of default. Defendants further agreed to be liable to Plaintiff for, inter alia,
"legal fees related to obtaining possession and making any new lease with another tenant; brokemge
commission in obtaining another tenant; expenses incurred in pUlling the leased premises in good
order and preparing for re-rental; [and] . . . all rents and other charges required to be paid up to the
time of such re-entry." Defendants further agreed to pay any "deficiency between the monthly
installment of [rents] and all other [expenses] that would have been payable for the month in
question, less the net amount, if any, of the rents actually collected by Landlord from a new tenant."
18. The total amount currently due and owing Plaintiff by Defendants is Seven Thousand
Nine Hundred Sixty-Two and 01/100 Dollar" ($7,962.01) for rent, One hundred Twenty-Six and
15/100 Dollars ($126.15) for interest and Seventy-five Dollars ($75.00) for late charges, all of
which Defendants, despite Plaintiffs demands. refuse to pay.
WHEREFORE, Plaintiff requests that this Court enter judgment in its favor and against
Defendants, jointly and sevemlly, in the amount of Eight Thousand One Hundred Sixty-Three and
16/100 Dollars ($8,163.16), together with additional late charges, interest ar..! h:lll3 that have accrued
as of the time of trial, as well as legal fees, brokemge commissions and other interest and costs
required to be paid by Defendants pursuant to the Lease and as allowed by law.

35. The parties hereto are also Landlord and Tenant under a
certain lease dated september 1, 1984. for certain other premises in
the Shopping Center (hereinafter called the "First Lease"), By
executing this Lease, the parties hereto agree that the First Lease
shall be cancelled and terminated and each of the parties hereto
hereby release one another from any liability arising out of the
First Lease.
36. In addition to the items referred to in Subsection (C) of
Article 10 of the Lease. Tenant agrees to make all repairs,
replacements and alterations necessary to maintain in good condition
all conduits. fixtures, meters and equipment relating to utilities
(including. but not limited to. water, gas, electricity and
sewerage) to the extent they serve the Leased premises exclusively,
whether located inside or outside the Leased Premises.
37. The occupancy of the leased premises by Tenant prior to the
commencement of the Lease Term shall be subject to all of the terms,
covenants. and conditions contained in the Lease. including Article
10(A), other than ,the obligation to pay rent; and the rent and Lpase
Term shall begin as provided in Articles 2 and 3.
38. Tenant's sign design drawings shall be submitted to the
Landlord for Landlord's approval prior to the erection of Tenant' s
sign. The sign shall not exceed 30" in height. nor shall the length
exceed 2/3 of the Tenant's storefront. Flashing, neon or moving
lights on signs are prohibited. All the provisions of this Lease
shall apply to said sign, insofar as said provisions are applicable,
including but not limited to Tenant's duty to repair (Article 10)
and insure (Article 11) said sign, and said sign shall comply with
all laws. The sign shall not, be placed in such a manner that it
extend~ above the parapet or facade.
39. It is understood and agreed that Tenant has inspected and
examined the premises being leased and the parking lot and common
areas of the Shopping Center and is familiar with the physical
condition thereof; the Landlord has not made and does not make any
representations as to the physical condition of either the Leased
premises and the Shopping Center and the Tenant agrees to take them

40. Landlord agrees that during the term of the Lease and so
long as Tenant is in possession and is not in default hereof,
Landlord will not hereafter luase any portion of the Shopping Center
to one. whose principal permittE!d use shall be the sale of pizza and

42. Not....ithstanding anything provided herein, any discrepancy
between the pdnted form and this rider, the rider shall prevail.
43. (A) At its expense, ....ith~n thirty (30) days after the date
of this Lease. Tenant shall submit for Landlord's ....ri tten approval
detailed plans and specifications (hereinafter collectively referred
to as "Plans") for all the ....ork to be done by Tenant to the Leased
Premises. failing ....hich Landlord :Ias the right to terminate this
Lease and entitling Landlord to retain the Tenant's entire security
deposit as liquidated damages.
(B) Landlord shall inform Tenant of any objections to said
Plans ....i thin thirty (30) days after receipt; then Tenant wi thin
fifteen (15) days shall deliver to Landlord corrected Plans, which
Landlord shall accept or reject ....ithin the next fifteen (15) days.
Failure to inform Tenant of objections ....ithin said time periods
shall be deemed Landlord's ....aiver of objections.
(C) If Tenant's Plans are approved, it shall not be deemed
Landlord's undertaking that they conform to la.... or impose any
liability on Landlord Tenant shall immediately apply for all
governmental permits necessary for Tenant's ....ork. After such
permits are issued and Landlord has completed the work, if any,
Landlord has agreed in this Lease to do. Tenant agrees to promptly
commence and complete Tenant's ....ork in conformity with said Plans
and with all legal requirements and ....ith the requirements of the
Building Department having jurisdiction, and before commencing
Tenant's ....ork, Tenant ....ill deliver to Landlord all of the
follo....ing: (1) A Contractor's completion bond to Landlord as
obligee in form approved by Landlord issued by a surety company,
guaranteeing completion of Tenant' s ....ork in accordance with said
Plans free of liens and ,security agreements, and (2) Comprehensive
general liability insurance insuring Landlord for at least
$1,000,000 combined single limit for bodily injury and property
damage and (3) a statement from Contractor that Contractor agrees to
indemnify, save and hold harmless Landlord, its agents, employees
and assigns from all liabilities, claims, losses, liens, damages and
sui ts of ....hatsoever nature for personal injury, death or property
damage alleged to arise out of the ....ork performed under the
contract, ....hether by the contractor or by any subcontractor, and
....hether asserted against Landlord or the Contractor, and (4)
Contractor's Workers' compensation and Occupational Disease
insurance ....ith statutory limits and employer's liability ....ith a
limit of at least $100,000 for all damage from one or more claims.
(D) Tenant shall comply with all legal requirements during
its work; and ....hen completed, Tenant's work shall comply with all
laws, ordinances, regulations or orders of public authority, and
....ith all Fire Insurance Rating organization (or similar body)
requirements and the liability insurance company's requirements
....hich insure against accidents conne:=ted with the Leased Premises,
and Tenant shall obtain and deliver to Landlord the certificate of
occupancy (or its local equivalent if the same are not issued in the
jurisdiction) for the Leased Pre~ises.
(E) If Landlord or its representatives inspects the Leased
premises and determines that Tenant's work is not being done in
accordance with the approved Plans, Tenant shall correct any
deficiencies or omissions immediately.

Center or Tenant's leasehold intnrest by reason of work. labor,
services or materials supplied to Tenant or anyone holding the
Leased premises through Tenant, If any lien in filed, Tenant shall

discharged of record. failing which Landlord, in addition to any
other right or remedy, may (but shall not be obligated to) discharge

final acceptance of the ....ork the Contactor is notified in ....riting by
either Landlord or Tenant that an item of equipment, material or

ASSUMPTIO~ AGREEMENT
THIS ASSUMPTION AGREEMENT dated as of the 6th day of february, 1991 by and
between KIHCO DEVELOPMENT OF GIANTS. INC. (hereinafter referred to as
"Landlord") and AMEOEO ClJ4ANO and HELEN KLINGER (hereinafter referred to as
"Assignee"); which tenns "Landlord" and "Assignee" shall include the successors
and assigns of the respective parties.
WITNESSETH:
WHEREAS, by Lease Agreement dated July 2, 1986, Landlord did lease and
demise unto Joseph Cumano d/b/a Two Guys Pizza certain premises therein more
particularly described in a Shopping Center located at Upper Allen, Pennsylvnia
(said Lease Agreement is hereinater referred to as the "Lease"); and
WHEREAS, the parties hereto desire to amend the Lease.
NOW, THEREFORE, in consideratiun of Landlord consenting to the assignment
and the sum of Ten and no/100 (SlO.OO) Oollars and other good and valuable
consideration, in hand, paid by Assignee to Landlord, the receipt and
sufficiency of which is hereby acknowledged, it is mutually agreed as follows:

representation that no broker was instrumental in consummating the assl~nment.
The Assignee hereby agrees to hold the Landlord hannless against any clalms for
brokerage commissions arising out of the assignment.
