REPORT
SUBJECT: Site inspection of a storm drainage problem on the property of Mr.
Stirling 11011, 518 and 520 North Third Street, Worm1eysburg. Po.
DATE: January 17, 1987
EXISTING CONDITIONS:
Surface water currently drains to a low area at the rear of the
properties and to a low area on the north side of the dwelling at No.
518. The rear area of the properties contain a garage and a garage/
apartment conversion.
The Borough has installed an inlet and a 15" storm drain at the rear
of the property which draim, eastward to PennDOT's storm system on
Second Street. No provision for surface drainage adjacent to the
dwelling was provided and the problem appears to be aggrevated by
trench subsidence. Lifting of concrete slabs between the 2 garages
and over the storm drain pipe has occurred. The storm drain pipe is
a IS" diameter ADS corrugated plastic pipe apparently installed
without tie-down anchors. The bouyant force on the pipe can be as
high as 77 lbs. per ft. Froat heave can also cause movement of the
slabs.
RECOMMEtIDATIONS:
1. Install a new inlet near the northeast corner of the dwelling and
grade the surrounding area on both properties to drsin into it. A
24" x 24" grate and box would be adequate.
2. Confine the storr-water runoff at the reBr of the lots and direct it
toward the existing inlet. This should include curbing a10nL the
northwest garage apron and grading to direct the water past the curb
and apron.
3. The 15" storm tlrllin sn'>uHi De- ancnur"'; untler the slab to prevent
bouyant forces. One cubic foot of concrete per lineal foot of pipe
should be provided. Tie-downs should be a 03 reinforcement bar looped
over the pipe and inbedded in the concrete. The bars should fit
tightly into the pipe corrugations and be spaced at a minimum of 18"
c/c.

4. The replacement slab should contain additional joints and ahou1d have
a joint parallel to the pipe. All jointa should bo well sealed
against infiltrstion of aurface wster.
5. Placing freo draining gravel below the slab will minimize the
consequences of froat hesve. Ideally. placing gravel to the frost
depth (3') would be best. A minimum depth of 12" ia recommended.

Dear Mr. Moll:
This will serve as a response to your letters to me dated February 12, 1997 and
February 13, 1997, as well as a response to your letter to Gary Berresford, Borough Manager,
dated Februery 26, 1997. Let me say that I view this as a claim by you against the Borough
in that you have asked for tha Borough to take certain actions regarding your property
otherwise you have made it very clear there will be another lawsuit. Therefore, I will handle
this matter as if it is adversarial and that you hava a specific claim against the Borough.
Furthermore, any investigation by the Borough or its agents into that matter is privileged and
there is no legal duty for us to disclose that information to you under any laws of the
Commonwealth of Pennsylvania.
Frankly, I am not sure exactly what claim it is you now believe to have against the
Borough this time. Some of things that I read (and hear) are matters that you have brought
up many times in the past and to which we have responded. It appears the most recent claim
involves permitted construction in 1985 at your property. Since this claim is approximately
twelve years old, I have a strong belief that this is barred by the statute of limitations. In
addition, in 19B6 in exchange for a payment you signed a complete release of the Borough
of all known and unknown, past, present and future claims. Therefore, I have directed the
Borough to refer this claim to its liability carrier.
With regard to your written requast for documents hand delivered to the Borough on
February 26, 1997, please be advised that the keeper of records and the Borough Secretary,
is Gary Berresford. The Borough is not in possession of any engineering report and even if
it was, that is not a public documents as it is part of an investigation. As far as any
engineering reports that existed in 1985, the same response applies. With regard to the
original Deed of Easement and Right-of-Way, you have requested this document numerous
times in the last couple of years and the same response applies. The original is recorded at
