map. Within two years of purchasing their tract, defendant Heisey
hired attorney Robert Radebach to inquire about the ownership and
possibility of purchasing the parcel adjacent to them. Attorney
conducted a title search and a review of the tax records. The
title search was inconclusive. The last recorded deed encompassing
the tract at issue was from 1853, under the name of George
Livingston. The tax map designated the area as tract 29 owned by
the plaintiffs.
Defendant Heisey, through attorney Radebach, filed an Action
to Quiet Title, docketed at No. 194 S Civil 1981 for the parcel
presently numbered as Tract No.09-11-3007-BB. No actual notice of
defendant's Quiet Title action was given to plaintiffs. On
September 22, 1981 an order was issued granting defendant Heisey
title to the designated tract. Defendant has been paying taxes on
tract BB. No improvements have been made to the mountain ground.
In 1985 defendant Heisey entered into an agreement with
defendant Hower granting Hower a portion of the disputed tract.
2. FACT DAMAGES:
If plaintiffs are not declared to be the rightful owners of
the tract of land, they have lost their ownership of their tract of
land. In addition they have been paying taxes on a parcel of land
owned by defendants.
3. LIABILITY and DAMAGES:
Plaintiffs allege that through the actions of defendants they
have been deprived of their ownership of their tract of land. They
alleged that defendants failed to give adequate legal notice to
plaintiffs of their attempt to acquire the tract by prescription.
The loss of title to the tract of land was due to the actions of
defendants.
4. ADMISSIBILITY
Plaintiff knows of no issues as to admissibility of testimony,
exhibits or any other matter.
5. WITNESSES
Plaintiffs intend to call, in addition to plaintiffs, the
custodian of Cumberland County tax records to authenticate the
documents obtained regarding the tracts of land. Plaintiff will
also call defendants as of cross and Robert Radebach unless a
stipulation is reached prior to trial.

1. STATEMENT OF FACTS AS TO LIABILITY
Plaintiffs claim ownership of a tract of land alleged to exist in East
Pennsboro Township, CWl1berland County, under and by virlue of a Tax Claim
Bureau sale conducled by the Cwuberland COWlty Tax Claim Bureau, with a deed
daled February 26, 1969. Tile descriplion for the premises was six aercs, morc or
less, of mounlain land listed in lhe name of B. Frank Shwl1al1. The deed
descriplion indicatcs that the properly is bOWlded on the north by the
CwuberlandtPerry COWIty J,owIdary line. Apparently the tax assessment for the
Shwuan property originatcd from a deed dated November 8, 1904, and recorded
on September 8, 1954, in CWl1berland County Deed Book Z15, Page 81, wherein
Zacharias Quigg anJ (\l1ll1ie, his wifo convoyed au owuorsllil' iutorest iu a tracl
containing six lIeres 1110re or le~8 to B. Frank Shwuan. Thal deed further recites a
lellse from Rudolph Swah on January 6, 1886. The Defendants, onlhe contrary,
aver lhatlho lands claimed hy the Plainliffs are a Jifferenttracllhan lhe lands
\/hich fonn the pwperty which was the subjecl o[ lhe aclion to quile litle.
De[endanls have had lhe land surveyed and althe lime of tile survey in 1l}81lhere
was no indicalion of any cncroachmentor issue regarding ownership. It is the
position of the Defendants that the lanJs of the Plainliffs are Jifferentthan those
owned by lhe Defendants. In this particlJar aclion, Kenneth Heisey died in
NOVl.lmber of 1999. His deposilion was taken in Novemher of 1997, and
Defendanls wish to have his deposilion made part of the rccord in this aelion.
n. STATEMENT OF BASIC FACTS AS TO DAMAGES
Plainliffs have made no allegation of there being damages in this action.
Ill. STATEMENT AS TO PRINCIPAL ISSUES
OF LIABILITY AND DAMAGES
Defendants respeclfully submilthallhere is substanlial issues between lhe
. parlics 118 to whcther or not the lands purchased by the Plainliffs altax sale have
any relalional all to the lands of t\tc DefenJants. Defendants arc prepared to prove,
by leslimony from their Lille abstractor and survcyor, that the lands claimed by the
Plainliffs have no idenlity with lhose of the Defendanls.
IV. SUMMARY OF ISSUES REGARDING
EVIDENTIARY MATIERS
Mr. Heiscy will not he available for courl because he died in November of
1998. Mr, Heisey's deposition was taken in 1997 and Defendanls requeslthat his
deposition teslimony be made parl of lhc record in lhis action. The Defendants will
calla Lille examiner to testify regarding the chain of Lille for the tracts of land
owned by the Plainliffs anJ Defendants. InadJilion, the Defendants will call
William Burch who performed lhe survey in December of 1981, whieh should
resolve the issues raised hy the Plainliffs. Defendants expeclto show lhalthe lauds
of Plaintiffs are not tile same tracl of lanJ as tlllll of tile DefenJanls, anJ lhat

6. Plaintiffs are the owners in fee simple absolute of a
tract of land situate in East pennsboro Township, Cumberland
County, Pennsylvania which they acquired from Ellsworth Fisher and
his wife Gladys Fisher by deed dated June 3, 1985, and recorded in
Deed Book 31, Volume H, Page 80, Cumberland County Records. An
Abstract of Title for said premises is attached hereto as Exhibit
A.
7. Plaintiffs tract is referred to as Tract No. 09-11-3007-
029 in the Cumberland County Tax Map Office, hereinafter referred
to as Tract No. 09-11-3007-029. A copy of the Map Record Card and
current computer printout are attached as Exhibit B. A copy of the
Property Record Card is attached as Exhibit C.
8. Ellsworth Fisher and his wife Gladys Fisher purchased the
tract at a Sheriff's Sale by deed dated February 26, 1969, and
recorded in Deed Book 23, Volume C, Page 560, Cumberland County
Records. An Abstract of Title for said premises is attached hereto
as Exhibit D.
9. The Cumberland County Tax Claim Bureau Notice of Tax
Sales describes the tract as: "Approximately 6 acres (Mt Land back
of SWlUUerdale) [on map] A-50." Copy of the Tax Claim Bureau Notice
of Tax Sale in attached as Exhibit E.

10. B.F. Shuman, predecessor in title to Ellsworth and Gladys
Fisher for Tract No. 09,-11-3007-029 was a lessee of that tract; he
owned a 99 year lease on the land. An abstract of title for said
premises is attached as Exhibit F.
11. The Deed which conveys B.F. Shuman's interest in the
land, was purchased from Zacharias Quigg and Connie, his wife, and
describes the tract as follows:
lying in East pennsboro Township, County of Cumberland and
State of Pennsylvania, bounded and described as follows,
to wit: On the East by mountain land formerly of Michael
Hinecka, on the North by division line of Perry and
Cumberland Counties, on the West by mountain land formerly
of Francis Quigg, and on the South by mountain land of George
Luther. Containing about six (6) acres more or less, and
being the same land which was leased by the grantor () herein
for the period of ninety-nine years from Rudolph Swab by
instrument in writing dated the 6th day of January, 1886.
A copy of that Deed is attached as Exhibit G.
12. After a thorough search, no deed has been found
evidencing the transfer of the land from Rudolph Swab, predecessor
in title to Zacharias Quigg and his wife in 1886.
13. It is believed an therefore averred that George
Livingston, Michael Livingston or their successors in title
conveyed ownership of the land described in paragraph 12 to Rudolph
swabb in 1886.

14. Defendants claim George Livingston or Michael Livingston
are the source of title which permit them to establish ownership by
prescription. This is the conunon source of the adverse title
claimed by the parties.
15. In absence of an agreement to the contrary, the lessor is
responsible for taxes against demised premises. Kitchen v. Smith
101 Pa 452, 456 (1882).
16. Because the Lessor of tract No. 09-11-3007-029 failed to
pay county real estate taxes on the land, title to the tract
reverted to the county in fee simple absolute on or about 1969
prior to the tax sale.
17. Plaintiffs believed they and Ellsworth and Gladys Fisher I
predecessors in title, were making use of Tract No. 09-11-3007-029
from the date of purchase until the mid 1980's.
18. In the late 1970 's, Plaintiffs cleared approximately
three (3) acres of timber and placed a mobile home trailer on Tract
No. 4-361-6 in the belief they were using their Tract, No. 09-11-
3007-029.
19. Plaintiffs gave permission for logging and right of way
access to take place on Tract No. 09-11-3007-029 during the year
1982.

20. In 1979, Defendant Kenneth H. Heisey and Helen B. Heisey
his wife purchased Tract No. 09-11-3007-24 from Harry Gutshall and
Mary E. Gutshall by deed dated August 10, 1979, and recorded in
Deed Book 28, Volume P, Page 121, Cumberland County Records. An
Abstract of Title for said premises is attached hereto as Exhibit

21. In 1981, Defendant Kenneth H. Heisey and Helen B. Heisey
his wife began an Action to Quiet Title No. 194 S. Civil 1981, for
the parcel today numbered Tract No. 09-11-3007-024-BB. Copy of the
Complaint is attached as Exhibit H-1, attachments and Exhibits to
the Complaint are omitted.
22. The deed described in Paragraph 19 did not mention any
ownership interest claimed by the Defendants to the disputed tract
on the conveyance from the Gutshalls to the Heiseys.
23. Tract No. 09-11-3007-24-BB is the same tract as No. 09-
11-3007-029 as indicated by Cumberland County Tax Maps, Real Estate
Atlas of Cumberland County, Pennsylvania, Map Volume 1, Series 1-
17, published 1982 attached as Exhibit I. A copy of the relevant
portion of the current Tax Map is attached as Exhibit J.

24. Although Defendants made publication notice of their
claim to the land which is numbered as Tract No. 09-11-3007-029,
they did not give Plaintiff's actual notice regarding their claim
in Quiet Title to that tract on file at the Cumberland County Tax
Mapping Office.
25. At some time after the Defendant Heisey's action to Quiet
Title, Tract No. 09-11-3007-029 in 1981, the Tract was renumbered
Tract No. 09-11-3007-024-BB when the County Tax Maps were updated.
Copies of the maps before and after the renumbering are attached as
Exhibits I and J.
26. On August 28, 1985, Defendant Heiseys entered into an
agreement with Alton B. Hower and Shirley A. Hower his wife,
granting a portion of the land in Tract No. 09-11-3007-024-BB to
the Howers, recorded as a "Agreement For Consentable Boundary
Line." A copy of said agreement is attached hereto as Exhibit K.
27. Prior to this agreement, that parcel was part of Tract
No. 09-11-3007-24-BB or 09-11-3007-029.
28. An Order was issued on September 22, 1981 granting
Defendants title to the disputed tract. A copy of the Order is
attached as Exhibit L.

29. At all times since purchase in 1969, Plaintiffs and their
predecessors in title have paid county real estate taxes on Tract
No. 09-11-3007-029.
30. ThEl Heiseys began paying county real estate taxes on
Tract No. 09-11-3007-024-BB after November 18, 1981. A copy of the
property Record Card is attached as Exhibit M.
31. The Howers began paying county real estate taxes on the
acquired portion of Tract No. 09-11-3007-023 after August 29, 1985.
A copy of the property Record Card is attached as Exhibit N.
32. Both the Plaintiffs and the Defendants Heisey have been
paying county real estate taxes on the same parcel of land numbered
09-11-3007-029 and 09-11-3007-024-BB.
33. Both the Plaintiffs and Defendants Hower have been paying
county real estate taxes on the same parcel of land numbered 09-11-
3007-029 and that portion of Tract No. 09-11-3007-023, which the
Howers received by the Consentable Boundary Agreement. A copy of
said agreement is attached hereto as Exhibit K.
34. At all times relevant, Plaintiffs and their predecessors
were and are the owner of Tract No. 09-11-3007-029.

COMPLAINT
1. Plain~iff, KENNETH H. HEISEY, and HELEN B. HEISEY, his
wife, are adult individuals residing in East pennsboro Township,
Cumberland County, pennsylvania.
2. Plaintiffs, after due investigation are without know-
ledge or information with regard to the present whereabouts of
Defendant, GEORGE LIVINGSTON. Plaintif~believe that due to the
long passage of time, said Defendant must be deceased, however,
plaintiffs have no knowledge regarding his death or the present
whereabouts of any of the legal heirs, successors or assigns of
the said GEORGE LIVINGSTON.
3. plaintiffs are the owners in fee simple absolute of a
tract of land situate in East Pennsboro Township, Cumberland
county, pennsylvania, which they acquired from Harry Gutshall and
Mary E. Gutshall by deed dated August 10,1979, and recorded in
Deed Book 28 , Volume P
, page 121 , Cumberland county RecordS.

they and their predecessors in title have possessed and claimed
and claimed ownership to a tract of land adjoining said tract of
land which premises arc described as follows:
BEGINNING at a stone at line of lands now or late of
Samuel Newcomber and land now or late of Stephen
Livingston1 thence by lands late of said Stephen
Livingston, North 28 3/4 degrees West, the distance
of 78 perches to stone at lands now or late of Samuel
Mumma 1 thence along same North 72 3/4 degrees East, the
distance of 10.6 perches to a block lands now or
late of Simon Aysterl thence along same South 28 3/4
degrees East, the distance of 77 perches to a stone at
lands noW or late of Samuel Newcomberl thence along same
South 62 1/4 degrees West, the distance of 10.3 perches
to stones at the place of BEGINNING.
CONTAINING 4 acres adn 158 perches, strict measure
5. Plaintiffs aver that said Defendant, GEORGE LIVINGSTON,
acquired an ownership interest in said premises as an heir in the
Estate of Michael Livingston which tract was partitioned by the
orphans Court of'Cumberland County, pennsylvania and awarded to
oefendant, GEORGE LIVINGSTON,in 1853.
6. plaintiffS aver that from and after 1853, t~e said GEOro
LIVINGSTON never conveyed said premis6s of record and plaintiffS
aver that since that time no persons claiming a succession to the
said GEORGE LIV!NGSTON have ever challenged the possession of the
plaintiffS or their predecessors in title.
7. plaintiffS aver that their long standing adverse pos-
session of said premises has now ripened into fee simple by virtu
of the passage of time greatly in excess of the period required t
establish ownership by prescription.

8. plaintiffs aver that since they have no deed to said
premises described in Paragraph 4, a cloud exists on their owner-
ship of said premises which can only be remedied by an Order of
court declaring that plaintiffs are the owners in fee simple of
said premises, free and clear of any and all rights, title, in-
terest, claim and demand of said GEORGE LIVINGSTON, his heirs,
successors and assigns and enjoining the said GEORGE LIVINGSTON
and his heirs, successors and assigns from denying, impeaching
or attaching the Plaintiffs' ownership of said premises, hence
this suit.
WHEREFORE, plaintiffs request Your Honorable Court to enter
an Order declaring plaintiffs to be the owners in fee simple of
the premises set forth in paragraph 4 of this Complaint, free and
clear of any and all rights, title, interest, claim or demand of
the said GEORGE LIVINGSTON, and his successors and assigns and
enjoining the said GEORGE LIVINGSTON aUd his heirs, successors
and assigns from denying, impeaching or in any way attaching the

RESPONSE TO NEW MATTER WITH
COUNTERCLAIM
40. Plaintiffs incorporate the allegations of its Complaint
contained in paragraphs 1 - 39 as if they had been set out in full.
41. Admitted in part, denied in part. Admitted that a Action
to Quiet Title docketed No. 194 S 1981 exists in the Court of
Common Pleas. Denied that the outcome of the pleadings have any
bearing on this action as Plaintiffs did not receive notice of the
Action to Quiet Title docketed NO. 194 S. 1981, any orders entered
are void and must be stricken from the record. Further an Action
to Quiet title by adverse possession can not issue where the
plaintiff has been in actual possession of the land for only two
years.
42. Admitted in part, denied in part.
Admitted that
Defendants had a survey performed. Denied that the said survey
purports to convey boundaries or any ownership rights of the
Defendants. By way of further answer, in Defendants Quiet Title
Action docketed No. 194 S 1981, paragraph 6 states that Defendants
could not evidence a transfer from George Livingston to the
Defendant's chain of title. Even if the surveyed tract is
accurate, it can not therefore trace title to the Defendants.
43. Denied. Denied that title for the lands in question run
back to Abraham and Harvey Gutshall, as the break in the chain of
title which Defendants allege by George Livingston occurred prior
to 1881. By way of further answer, the land described in the Deed
at F-8, Page 541 does not match the description relied upon in
Defendants 1981 Complaint at Paragraph 4.
44. Denied. As the Defendants can not establish a transfer
of title from George Livingston or Michael Livingston, Defendants
can not prove that title to the land was not conveyed to Zacharias
Quigg or Rudolph Swab prior to 1881. By way of further answer,
plaintiffs allege the disputed tract measures six (6) acres more or
less.
45. Denied. Denied that Plaintiffs have not asserted any
ownership to the lands subject to the survey. By way of further
answer, Defendants survey speaks for itself. If the survey is an
accurate, an accurate survey of the parcel in dispute does not cure
Defendant's defective title.
46. Admitted. By way of further answer, Plaintiffs have been
unable to inspect and / or survey the parcel since access to the
parcel has been unlawfully blocked by the Defendants.
47. Denied. Denied that posting of lands establishes
ownership of a parcel of land. It is specifically denied that tax

assessments failed to identify the proper legal title holder. By
way of further answer, Plaintiff's parcel and ownership interest
was marked on Tax Map No. 09-11-3007-029 of the Cumberland County
Tax Mapping Office and indexed to Tax Mapping Office ownership
cards, computer records and Residential Real Property Card open for

48. Denied. Denied that Plaintiffs must file an Action to
Quiet Title.
By way of further answer, marketable title was
conveyed upon the Plaintiffs and their predecessors in title,
Ellsworth and Gladys Fisher by deed dated February 26, 1969, and
recorded in Deed Book 23, Volume C, page 560, of Cumberland County
RecordS, making an action in ejectment the appropriate remedy.
49. Denied. It is specifically denied that the Defendants
maintained open, notorious and continuous possession of the land in
question to obtain title by prescription.
By way of further
answer, the Defendants purchased the land adjacent to the disputed
tract in 1979, and began their action to quiet title by adverse
possession in 1981. Twenty-one years is the requisite time period
for adverse possession.
50. Denied. Denied that Defendants have proven ownership of
the triangular tract by the Howers. By way of further answer, the
Howers recorded an "Agreement For Consentable Boundary Line" with
the Heiseys in 1985. Strict proof is demanded that the Howers used
the tract and made improvements in excess of twenty-one (21) years.

Objections.) On April 25, 1997, the Plaintiffs tried to file a praecipe for default
judgment against the Defendants for falling to file an Answer, but the prothonotary
refused the praecipe because the Defendants' preliminary objections had not yet
been settled. (Plaintiffs' Preliminary Objections to Defendants' Preliminary
Objections.) On May 7, 1997, the Plaintiffs filed preliminary objections to
Defendants' preliminary objections asking to have Defendants' preliminary
objections stricken and a default judgment granted for the Plaintiffs. (Plaintiffs'
Preliminary Objections to Defendants' Preliminary Objections.) Plaintiffs'
preliminary objections to Defendants' preliminary objections were listed for
argument to be held on May 28, 1997. (Praecipe For Listing Case For Argument.)
The Defendants subsequently filed an Answer on May 22, 1997. (Defendant's
Answer.)
Discussion
Pursuant to Pa. R. Civ. P. 1 037 (b) , the Plaintiffs are not entitled to a default
judgment because a praecipe for judgment has not been filed with the
prothonotary. The presence of preliminary objections on the record is a fatal
defect, preventing the granting of a default judgment and, until the preliminary
objections are settled, the defendant is not obligated to file an Answer. Advance
Building Services v. F&M Schaefer Brewing Co., 252 Pa. Super. 579, 582, 384

3. Contrary to agreement, Preliminary Objections were filed
by the Defendants on April 17, 1997.
4. Defendants agreed to withdraw the Preliminary Objections
and file an Answer on April 23, 1997. A copy of the agreement
signed by Defendants' attorney is attached hereto as Exhibit C.
5. On April 24, 1997, the Plaintiffs served via u.s. Mail a
Notice of Praecipe to Enter Default Judgment, pursuant to Pa.R.C.P.
237.1 et seq. A copy of the Notice and Certificate of Service are
attached hereto.
6. No Answer has been filed in this matter.
7. Defendant's Preliminary Objections have not been
withdrawn.
8. Pa.R.C.P. 248 provides that:
The time prescribed by any rule of civil
procedure for the doing of any act may be
extended or shortened by written agreement of
the parties or by order of the court.
9. As the Defendants have failed to file an Answer and
withdraw their Preliminary Objections, their preliminary Objections
are violative of Pa.R.C.P. 248 and must be stricken.
10. On May 6, 1997, counsel for plaintiffs attempted to seek
Default Judgment via Praecipe to the prothonotary, but the Praecipe
was not accepted due to the pending Preliminary objections.
