7. It is denied that there was any discussion about the
pricing of "teacup" poodles. Moreover, it is averred that
Defendant advised Plaintiff that toy poodles were more expensive
than regular poodles and that toy poodles cost $629.99, which was
the price agreed upon by the parties.
8. It is denied that plaintiff relied on any
representation regarding the classification of the poodle as a
"teacup". Moreover, it is averred that the only discussion
regarding the poodle in question was that the poodle was a toy or
small poodle, which in fact it was.
9. It is denied that Plaintiff learned that the poodle he
purchased was not a "teacup" poodle. It is admitted that the
poodle was a toy poodle.

22. The parties also executed a statement of Understanding,
which is marked Defendant's Exhibit B, and incorporated herein by
reference. Said statement of understanding sets forth the only
guarantee to Plaintiff and clearly indicates that Plaintiff
examined the poodle, which is described as a male poodle and not
a "teacup" poodle.
23. Said Defendant's Exhibit B likewise states that all
Pet land animal sales are final and that animals are sold for
companionship, and not to guarantee show qualities or
breedability.

7, The Defendant advised Plaintiff that "Teacup"
poodles were more expensive than larger poodles and that a
"Toy" poodle, which is larger than a "Teacup" sold for
$350.00.
B. The Plaintiff relied upon the representations of
the Defendant and purchased what he believed to be a
"Teacup" poodle.
9. Several months after the purchase the Plaintiff
learned that the poodle he purchased from the Defendant was
not a "Teacup", but was a "Toy" poodle.
10. Plaintiff sought to be refunded the difference in
purchase prices from the Defendant but the Defendant refused
and continues to refuse to refund Plaintiff monies
representing the difference in the purchase price.
COUNT I - MISREPRESENTATION
11. Paragraphs 1 through 10 are incorporated herein as
if set forth at length.
12. The Defendant knew or had reason to know that the
poodle in question was not a "Teacup" yet he misrepresented
the classification of this poodle as a "Teacup" to
Plaintiff.
13. Defendant charged the Plaintiff an additional
$279.99 based upon this poodle being a "Teacup" and not a
"Toy" poodle.

WHEREFORE, Plaintiff demands judgment against the
Defendant in the amount of $279.99 plus the amount of sales
tax plus costs and such other relief as the Court may allow.
COUNT I I - BREACH OF WARRANTY
14. Paragraphs 1 through 14 are incorporated herein as
if set forth at length.
15. Defendant expressly warranted to Plaintiff that
the classification of the poodle in question was a "Teacup".
16. Plaintiff relied upon Defendant express warranty
to purchase the poodle.
WHEREFORE, Plaintiff demands judgment against the
Defendant in the amount of $279.99 plus the amount of sales
tax plus costs and such other relief as the Court may allow.
COUNT III - UNFAIR TRADE PRACTICES
17. Paragraphs 1 - 16 are incorporated herein as if
set forth at length.
lB. The conduct of the Defendant as described above
consititutes "unfair or deceptive acts or practices" as that
