STIPULATION OF THE PLAINTIFF AND DEFENDANT
FOR THE ENTRY OF JUDGMENT
AND NOW, this 27th day of March, 1997, the Plaintiff and the Defendant in the above-
captioned action hereby stipulate and agree as follows:
I. The Plaintiff is Alan G. Kreitzer, an adult individual residing at 4 Mill Road,
Mechanicsburg, Cumberland County, Pennsylvania 17055.
2. The Defendant is James Pautz, an adult individual whose current mailing address is
P. O. Box 204, Franklintown, Pennsylvania 17323.
3. On February 4, 1997, the Plaintiff filed a Complaint against the Defendant with
District Justice Glenn R. Farner (Magisterial District No. 9-30-04) lor unpaid rental amounts due
from the Defendant to the Plaintiff in the amount of Two Thousand Two Hundred Fifty-Five
($2,255) Dollars, together with costs of suit.
4. On February 12, 1997, after hearing, District Justice Farner entered a judgment in
favor of the Plaintiff and against the Defendant in the amount of Two Thousand Three Hundred
Forty-Three ($2,343) Dollars.
5. On March 7, 1997, the Defendant filed a Notice of Appeal from the judgment
rendered by District Justice Glen R. Farner with the Prothonotary of the Court of Common Pleas of
Cumberland County to the above teon and number and thereupon the Prothonotary of Cumberland
County entered a Rule upon the Plaintiff to tile a fonnal complaint with the Court of Common Pleas
of Cumberland County.
6. To dispense with the necessity of Plaintiff filing a fonnal complaint in this matter
with the Court of Common Pleas of Cumberland County and to forego the expense of service and
litigation, the Defendant hereby agrees to the entry of a judgment in favor of the Plaintiff and against
the Defendant in a stipulated amount as hereinafter provided.
7. The Defendant hereby stipulates and agrees to the entry of a judgment against the
Defendant and in favor of the Plaintifi'in this case in the amount of Eight Hundred Seventy-rive
($875) Dollars, representing a stipulated and compromised settlement of unpaid rentals due from
the Defendant to the Plaintiff for the lease by the Defendant from the Plaintiff of that certain mobile
home site, Lot No. 105 at the Silver Spring Mobile Home Park. owned and operated by the Plaintiff.
8. The Defendant, James Pautz, hereby authorizes and directs the Prothonotary of
Cumberland County to enter a judgment in f.1Vor of the Plaintiff, I, 'an G. Kreitzer, and against the
Defendant, James Pautz, in this case for Plaintiff's claim in the amount of Eight Hundred Seventy-
Five ($875) Dollars and. in so doing and so authorizing the Prothonotary to enter said judgment
against the Defendant. the Defendant hereby waives the fonnal filing of a complaint by the Plaintiff
and the service of the same upon the Defendant and hereby waives all requirements of law as to
notice of intention to enter judgment and notice of entry of judgment.

9. The Def-::ndant understands and acknowledges that the aforesaid judgment, when
entered. shall provide the Plaintiff with the right to thereafter file a writ of execution against the
property of the Defendant to satisfy the judgment. However, it is hereby stipulated and agreed
between the Plaintiff and the Defendant that if the Defendant shall pay to the Plaintiff the sum of
One Hundred Seventy-Five ($175) Dollars per month, commencing on the first day of May 1997
and on the first day of each succeeding month thereafter for a period of five (5) months, then, in such
event, Plaintiff shall not file a writ of execution against the property of the Defendant to satisfY the
judgment or any part thereof; provided further, however. that should the Defendant fail to make such
payments timely and faithfully, as aforesaid, then Plaintiff may resort to writ of execution against
the property of the Defendant to satisfy the judgment or the remaining unpaid balance, as the case
may be.
IN WITNESS WHEREOF, and intending to be legally bound hereby, the Plaintiff and thc
Defendant have cxecuted this Stipulation for the Entry of Judgment the day and year first above
written.
