TEMPORARY PROTECTION ORDER
7' day of March, 1997, upon presentation
and consideration of the within Petition, and upon finding that
the plaintiff, JoEllen Lee Foose. now residing at 501 Middle
Road, Newville. Cumberland County, Pennsylvania, is in immediate
and present danger of abuse from the defendant, John Edgar Foose,
the following Tempo~ary Order is entered.
The defendant, John Edgar Foose, (SSN: 166-52-4302 and date
of birth: 9/30/64) now residing at 501 Middle Road. Newville,
Cumberland County, Pennsylvania, is hereby enJoined from
physically abusing the plaintiff, JoEllen Lee Foose, or from
placing her in fear of abuse.
The defendant is excluded from the plaintiff's residence
located at 601 Middle Road, Newville, Cumberland County,
Pennsylvania, a residence which is jointly own by the parties,
and any other residence the plaintiff may establish, except for
the limited purpose of transferring custody of the parties'
children. The defendant shall remain in his vehicle at all times
during the transfer of custody.
The defendant is ordered to refrain from having any direct
or indirect contact with the plaintiff including, but not limited
to, telephone and written communications, except for the limited

County Courthouse, Carlisle, Pennsylvania,
The plaintiff may proceed without pre-payment of fees
pending a further order after the hearing.
The Cumberland County Sheriff's Department shall attempt to
make service at the plaintiff's request and without pre-payment
of fees, but service may be accomplished under any applicable
rule of Civil Procedure.
This Order shall be docketed in the office of the
Prothonotary and forwarded to the Sheriff for service, The
Prothonotary shall not send a copy of this Order to the defendant
by mail.
The Pennsylvania State Police Departments will be provided
with certified copies of this Order by the plaintiff's attorney.
This Order shall be enforced by any law enforcement agency where
a violation occurs by arrest for indirect criminal contempt
without warrant upon probable cause that this Order has been
violated, whether or not the violation is committed in the
presence of the police officer. In the event that an arrest is
made under this section, the defendant shall be taken without
unnecessary delay before the court that issued the order, When
that court is unavailable, the defendant shall be

A. ABUSE
1. The plaintiff, JoEllen Lee Foose, is an adult
individual residing at 501 Middle Road, Newville, Cumberland
County, Pennsylvania 17241.
2. The defendant, John Edgar Foose, (SSN: 166-52-
4302)(Da~e of Birth: 9/30/64), is an adult individual residing at
501 Middle Road, Newville, Cumberland County, Pennsylvania.
3. The defendant is the plaintiff's husband.
4. Since approximately 1988, the defendant has attempted
to caUse and has intentionally, knowingly, or recklessly caused
bodily injury to the plaintiff, placing the plaintiff in
reasonable fear of imminent serious bodily injury, and has
knowingly engaged in a course of conduct or repeatedly committed
acts toward the plaintiff. This has included, but is not limited
to, the following specific instances of abuse:
a. On or about March 1, 1997, during a discussion the
defendant threatened the plaintiff saying that she was
not to "mess with him," he then held his hand like a
gun again threatening the plaintiff by telling her she

"could be easily taken care of" causing the plaintiff
to fear for her safety.
b. On or about February 28, 1997, while the plaintiff
was taking a bath, the defendant came into the bathroom
and forcefully shoved his finger into her vagina
causing her pain.
c. In or about November of 1996, after an argument,
the defendant came into the bedroom with a steak knife
in his hand, and threatened to cut up the bed where the
plaintiff lay as he made stabbing motions in the air
about the plaintiff causing her to have to move to
avoid getting stabbed and placing her in fear for her
life.
d. In or about the Summer of 1995, the defendant
punched the plaintiff in the arm causing a bruise. On
another occasion, the defendant punched the plaintiff
in the mouth causing a lacerated and swollen lip.
e. On several different occasions since 1988, the
defendant has forcefully shoved the plaintiff, hit her,
and threatened to kill her.
5. The plaintiff believes and therefore avers that she is
in immediate and present danger of abuse from the defendant
should she remain in the home without the defendant's exclusion
and that she is in need of protection from such abuse.
6. The plaintiff desires that the defendant be prohibited
from having any direct or indirect contact with the plaintiff
including, but not limited to, telephone and written
communications, except for the limited purpose of facilitating
custody arrangements.
7. The plaintiff desires that the defendant be enjoined
from harassing and stalking the plaintiff, and from harassing the
plaintiff's relatives.
8. The plaintiff desires that the defendant be restrained
from entering her place of business at 1420 Center Road,
Newville, Pennsylvania, except to transfer custody of the minor
children.
9. The plaintiff desires that the defendant be enjoined
from removing, damaging, destroying or selling any property owned
Jointly by the parties or owned solely by the plaintiff.
B. EXCLUSIVF. POSSESSION
10. The home from which the plaintiff is asking the Court
to exclude the defendant is owned in the names of the plaintiff
and the defendant.
11. The plaintiff currently has no permanent place to stay
with her children except the marital home, and the defendant's
mother and sister live in the area with whom he can stay.
12. The plaintiff desires possession of the home so as to
give the greatest degree of continuit~ to the lives of the
children and to continue the two self-employment businesses which
are as follows: providing child care in the marital residence
and providing nursing care to her grandfather, grandmother, and
aunt. who live very close to the plaintiff's residence.

C. REIHBURSRHENT FOR COST OF CASE
13. The plaintiff asks that the defendant be ordered to pay
$260.00 to reimburse one of Legal Services, Inc.'s funding

following phrase: "Burnin' down the house; burnin'
down the house" when the mother told the father that
their relationship was over; and saying that he was
going to commit suicide and later saying that he was
going to admit himself to the hospital because of his
mental state.

7. Based on the father's behavior including that referred
to in paragraph 6 above, indirect criminal contempt charges were
filed and on May 29, 1997, an Order was entered setting a
contempt hearing for Tuesday, June 3, 1997, at 3:30 p.m.
8. Because of the father's actions and instability, the
mother has concerns for the children's safety should they be with
him without supervision pending psychological or psychiatric
evaluation to determine whether the children would be at risk if
they were in his care.
9. The father's attorney, Scott Moore, has been notified
of the filing of this Petition for Special Relief.
WHEREFORE, the plaintiff requests that this court enter a
Temporary Cuatody Order modifying the Order of April 14, 1997, by
restricting the defendant's custody rights to supervised
visitation either with a person agreed upon by the parties or at
the YWCA in Carlisle, Pennsylvania, until after the father has a
psychological evaluation which indicates that the children are
not at risk, and until further Order of Court.
The plaintiff requests any other relief which is just and
proper.

AND NOW, this 14th day of April, 1997, upon
agreament of the parties, as announced in open court and in
their presence, the custody order of March 14, 1997, is amended
to provide that the father shall have partial custody of the
children at issue on alternate weekends, on Saturdays from 3145
p.m. until 8100 p.m., and on Sundays from 11100 a.m. until 8100
p.m. In addition, the father shall have partial custody of said
children every Monday and every Thursday from 3145 p.m. until
8100 p.m.
On Mondays and Thursdays the father shall pick up
the children from the residence of the mother. At all other
times the exchange of custody of the children shall take place
at the T & C Market in Newville.
This order is entered without prejudice to the
parties to agree upon other or different periods of partial
custody in the father. In addition, it is anticipated that when
the children are older they will commence overnight visitations
with their father, from Saturday at 3:45 p.m. through Monday at
8:00 p.m on those alternating weekends when the father has
Saturday and Sunday partial custody.

AND NOW, this 14th day of April, 1997, upon
agreement of the parties, as announced in open court and in
their presence, the custody order of March 14, 1997, is amended
to provide that the father shall have partial custody of the
children at issue on alternate weekends, on Saturdays from 3145
p.m. until 8100 p.m., and on Sundays from 11:00 a.m. until 8:00
p.m. In addition, the father shall have partial custody of said
children every Monday and every Thursday from 3145 p.m. until
8100 p.m.

AFFIDAVIT of PROBABLE CAUSE
On this date the defendant went to the residence of Barbara CLINE at 70 Asper Rd. Lower
Mifflin Twp. Cumberland Co. to drop off Iheir son, Dakota FOOSE ( 4 YOA), Mrs, Cline is the
molher of the victim, JoEllen FOOSE, While at Mrs. CLlNE's residence Ihe dofendant wanled to
speak to the victim. The victim told the defendant that her attorney told her not to talk to him, The
defendant stated the she ( the victim) needed to talk to him by next Tuesday. The defendant staled
that he had hired a hit man and that if she did not speak to him by Tuesday two members of her
family would be gone, The defendant also staled that he had already paid the hit man and all he had
10 do was tell him to do it.
The victim slated to this officer that she was in fear of the defendant and that there may be merrit
to his threat. This officer spoke with the son of the parties involved. The couples' son stated that his
father ( the defendant) was mad at the victim and he was yelling at her.
The actions of the defendant violate the PF A the victim has against the defendant in that he ia to
refrain from harassing the victim or her relatives.

AND NOW, this ~ day of March, 1997, upon consideration
of the Consent Agreement of the parties, the following Order is
entered:
1. The defendant, John Edgar Foose, is enjoined from
physically abusing the plaintiff, JoEllen Lee Foose, or from
placing her in fear of abuse.
2. The defendant is enjoined from having any direct or
indirect contact with the plaintiff, except for the limited
purpose of custody and other marital related matters.
3. The defendant is ordered to refrain from harassing and
stalking the plaintiff and from harassing the plaintiff's
relatives.
4. The defendant is prohibited from removing, damaging,
destroying or selling any property owned by the plaintiff or
jointly owned by the parties.
5. The defendant is excluded from the plaintiff's
residence located at 501 Middle Road, Newville, Cumberland
County, Pennsylvania, and any other residence the plaintiff may

establish, except for the limited purpose of transferring custody
of the children or to visit with the children at times mutually
agreed upon by the parties.
6. The court costs and fees are waived.
7. This Order shall remain in effect for a period of one
year or until modified or terminated by the Court. The Order can
be extended beyond its original expiration date if the Court
finds that the defendant has committed another act of abuse or
has engaged in a pattern or practice that indicates continued
risk of harm to the plaintiff.
8. This Order may subject the defendant to: i) arrest
under 23 Pa.C.S. g6113; ii) a private criminal complaint under 23
Pa.C.S. g6113.1; iii) a charge of indirect criminal contempt
under 23 Pa.C.S. g6114, punishable by imprisonment up to six
months and a fine of $100.00-$1,000.00; and iv) civil contempt
under 23 Pa.C.S. ~6114.1. Resumption of co-residence on the part
of the plaintiff and defendant shall not nullify the provisions
of the court order.
9. The Pennsylvania State Police Department shall be
provided with a certified copy of this Order by the plaintiff's
attorney and may enforce this Order by arrest for indirect
criminal contempt without warrant upon probable cause that this
Order has been violated, whether or not the violation is
committed in the presence of a police officer. In the event that
an arrest is made under this section, the defendant shall be
taken without unnecessary delay before the court that issued the

an Order providing for the following regarding custody of their

a. On or about November 30, 1997, after the father returned Dakota 10 his
grandmother's residence, the child infonned the grandmother that a friend of his father's
had sexually molested the child in his father's truck. The mother reported the incident to
the Pennsylvania State Police who are in the process of investigating the matter. In
addition, the mother took the child to a therapist at Helen Stevens Center, where the child
repeated the story of his being sexually molested to the therapist.
b, The child, Dakota, has also reported and demonstrated to his grandmother some
inappropriate sexual behavior engaged in by his father in the child's presence.
e. The mother saw thc child, Dakota, looking at his father's "Play Boy" magazines
while he was sitting in his father's truck.
d, The father has on several occasions requested that the mother give him money for
food and diapers when he has thc childrcn for his periods of custody.
7. Because of the pending investigation and thc father's inappropriate behavior which
is adversely affecting the children, the mother has concerns for the children's safcly should they be
with him without supervision pending the oulcome of the Pennsylvania State Police's investigation.
WHEREFORE, the petitioner requests that this court enter a Temporary Custody
Order modifYing the Order of August IS, 1997, by restricting the defendant's custody rights to
supervised visitntion either with a person agreed upon by the parties or at the YWCA in Carlisle.
PelUlSylvania, pending the PelUlllylvania State Police investigation, and until further Order of
Court,
The petitioner requests any other relief which is JURt and proper.

2. The parties shall have shared legal cUll.tody of their minor

3. Mother shall have primary physical custody of the children
subject to periods of pertial custody and visitation with Father In
accordance with the following schedule:
A. For a period of one and one-half months Father shall

Instructions of the psychietrlst or psychologist, including the taking of
any and all medication prescribed by the psychiatrist or psychologist.
He shall provide proof to Mother's counsel that he is continuing in the
care of a psychiatrist and/or psychologist and Is following the
psychiatrist's or psychologist's treatment regimen.
7. The parties shall reconvene for another conciliation before
Michael L. Bangs, Esquire, on 6 November, 1997, at 10:00 a.m.

AND NOW, this 3rd day of June, 1997, the
defendant having appeared in open court and having admitted that
he is in violation of at least the exclusive possession
provisions of the protective order heretofore entered, he is
adjudged in contempt,
Sentence of the court is that the defendant pay
the costs of these proueedings, a fine of $100.00, and undergo
unsupervised probation for a period of six months on condition
that he again abide strictly by the terms of the protective
order heretofore issued, and that he continue with his current
psychological counseling program.
The court makes no findings with respect to
allegations that the defendant made phone calls or threats in
violation of the protective order.

COMMONWEALTH'S PETITION FOR A I-lEARING ON CHARGES
OF INDIRECT CRIMINAL CONTEMPT
William J. Gabig, Senior Assistant District Attorney of Cumberland County,
Pennsylvania, brings the following Petition for a hearing on charges of Indirect Criminal
Contempt:
1, A Protection from Abuse Order was issued by the Court, A true and correct
copy of the Order is attached,
2. The defendant's violation of this Order is averred in the attached criminal
complaint.
3. The victim requests the filing of an Indirect Criminal Contempt Charge.
4. The District Attorney's Office approves the filing of this criminal complaint.
5. The Commonwealth is requesting a hearing on the charges ofIndirect Criminal
Contempt pursuant to 23 Pa.C.SA !l6113.
6. The plaintilTand/or the defendant may seek modification of the Order based on
the filing of this petition as the Court deems appropriate following the trial in addition to
any other sentence. 23 Pa.C.S.A. !l6l13.
WHEREFORE, the Commonwealth requests the defendant be commanded to

by their son, Dakota Sleven FOOSE (4 YOA), While at the residence, the defendant removed a shovel and an edging tool from
the victim's storage shed. The victim was working during the lime the defendant was at her residence and was informed later
by her son that the defendant ceme to the residence and took the items,

of the ConRent A~reement of the parties, the followin~ Order is
enterpd:
1, The defendant., John Edgar Foose, ill enjoined from
physically abusing t.he plaintiff, JoEllen Lee Foose, or from
placing her in fear of abuse.
2, The defendant is enjoined from having any direct or
indirect contact with the plaintiff, except for the limited
purpose of custody and other marital related matters.
3. The defendant is ordered to refrain from harassing and
stalking the plaintiff and from harassing the plaintiff's
relative!'!.
4. The defendant is prohibited from removing, damaging,
destroying or selling any property owned by the plaintiff or
Jointly owned by the parties.
5. The defendant is excluded from the plaintiff's
residence located at. 501 Middle Road, Newville, Cumberland
County, Pennsylvania, and any other residence the plaintiff may

establish, except for the limited purpose of transferring custody
of the children or to visit with the children at times mutually
agreed upon by the parties.
6. The court costs and fees are waived.
7. This Order shall remain in effect for a period of one
year or until modified or terminated by the Court. The Order can

be extended beyond its original expiration date if the Court
finds that tbe defendant has committed another act of abuse or
has engaged in a pattern or practice that indicates continued
risk of harm to the plaintiff.

This Order may subject the defendant to: il arrest

under 23 Pa.C.S. ~6113; iil a private criminal complaint under 23
Pa.C.S. ~6113.1i iii) a charge of indirect criminal contempt
under 23 Pa.C.S. ~6114, punishable by imprisonment up to six
months and a fine of $100.00-$1,000.00; and iv) civil contempt
under 23 Pa.C.S. ~6114.1. Resumption of co-residence on the part
of the plaintiff and defendant shall not nullify the provisions
of the court order.
9. The Pennsylvania State Police Department shall be
provided with a certified copy of this Order by the plaintiff's
attorney and may enforce this Order by arrest for indirect
criminal contempt without. warrant upon probable cause that this
Order has been violated, whether or not the violation is
committed in the presence of a pol ice officer. In the event that
an arrest is made under t.his section, the defendant shall be
t.aken without unnecessary delay before the court that issued the
order. When that court is unavailable, the defendant shall be
taken before the appropriate district Justice. 123 Pa.C.S. S

CONSENT AGREEMENT

1'hls Agreement is entered on this _,-3___ day of March, 1997,
by the plaintiff, JoEllen Lee Foose, and the defendant, John
Edgar Foose. The plaintiff is represented by Joan Carey of LEGAL
SERVICES, INC.; the defendant is represented by Scott D. Moore of
SAIDIS, GUInO, SHUFF & MASLAND. The parties agree that the
following may be entered as an Order of Court.
1. The defendant, John Edgar Foose, agrees to refrain from
abusing the plaintiff, JoEllen Lee Foose, or placing her in fear
of abuse.
2. The defendant is enjoined from having any direct or
indirect contact with the plaintiff, except for the limited
purpose of custody and other marital related matters.
3. The defendant agrees not to harass and stslk the
plaintiff and not to harass the plaintiff's relatives.
4. The defendant agrees not to remove, damage, destroy, or
sell any property owned by the plaintiff or Jointly owned by the
parties.
5. The defendant agrees to stay away from the plaintiff's
residence located at 501 Middle Road, Newville, Cumberland
County, Pennsylvanill, and any other residence the plaintiff may
establish, except for the limited purpose of transferring custody
of the children or to visit with the children at times mutually
agreed upon by the parties.
6. The defendant, although entering into this Agreement,
does not admit the allegations made In the Petition.
7. The defendant understands that the Protection Order
entered in this matter will be in effect for a period of one year
and can be extended beyond It original expiration date if the
Court finds that the defendant has committed another act of abuse
or has engaged in a pattern or practice that indicates continued
risk of harm to the plaintiff. The defendant understands that
this Order will be enforceable in the same manner as the Court's
prior Temporary Protection Order entered in this case.
8. Violation of the Protection Order may subject the
defendant to: i) arrest under 23 Pa.C.S. ~6113; ii) a private
criminal complaint under 23 Pa.C.S. ~6ll3.l; iii) a charge of
indirect criminal contempt under 23 Pa.C.S. ~6l14, punishable by
imprisonment up to six months and a fine of $100.00-$1,000.00;
and iv) civil contempt under 23 Pa.C.S. ~61l4.l.
9. The defendant and the plaintiff agree to the entry of
an Order providing for the following regarding custody of their
children, Dakota Steven and Natasha LeeAnn Foose.
a. The parties shall share legal custody of the minor
children.
b. The mother shall have primary physical custody of
the children.
c. The father shall have partial custody of the
children at times agreed upon by the parties.
d. The mother and father agree that each shall notify
the other immediately of medical emergencies which
arise while the children are In that parent's care.
e. The mother and father realize that their
children's well being is paramount to any differences
they might have between themselves. Therefore, they
agree that neither party shall do anything which may
estrange the children from the other parent, or injure
the opinion of the children as to the other parent or
which may hamper the free and natural development of
the children's love or respect for the other parent.
WHEREFORE, the parties request that a Protection and a
Custody Order be entered to reflect the above terms.
