TO THE HONORABLE, THE JUDGES OF SAID COURT:
WAYNE F. SHADE, ESQUIRE, counsel for plaintiff in the above-
captioned action, respectfully represents, as follows:
1. The above-captioned matter is at issue; and
2. The claim of plaintiff is $17,952.36 plus costs,
interest and attorney fees in a combined total amount of lesS
than the compulsory arbitration limits of cumberland county,
pennsylvania. There is no counterclaim.
The following attorneys are interested in this matter as
counselor are otherwise disqualified to sit as arbitrators:
None.
WHEREFORE, petitioner prays that your Honorable court
appoint three (3) arbitrators to whom the case shall be
submitted.

Plaintiff LANE ENTERPRISES, INC., is a corporation organized
and existing under the laws of the commonwealth of Pennsylvania,
with offices at 1244 Claremont Road, Carlisle, Cumberland County,
pennsylvania 17013.

Defendant TIMBER CREEK EXCAVATING, INC., is a corporation
organized and existing under the laws of the Commonwealth of
Pennsylvania, with offices at 109 North Mountain Road,
Harrisburg, Dauphin County, Pennsylvania 17112.

On or about November 6, 1996, Plaintiff delivered at the
request of Defendant 7 12-inch diameter 18-gauge 10-inch wide
dimple bands for a total cost of $31.46.
4.
On or about November 13, 1996, Plaintiff delivered at the
request of Defendant 2 18-inch diameter risers for a total cost
of $879.80.

The foregoing dates were the invoice dates.

The delivery dates were, in all cases, the date of the
invoice or within no more than three days prior to the date of
the invoice.

The terms of the invoices were all "NET 30 DAYS".
14.
In spite of repeated demands therefor, Defendant has wholly
failed and refused to make any payments on account of the
foregoing deliveries.
15.
On or about February 28, 1997, Plaintiff credited Defendant
with $55 for repairs to one of the risers referenced in paragraph
4.
WHEREFORE, Plaintiff demands judgment against Defendant in
the amount of $17,952.36 plus costs and interest from the thirty-
